PPI Claim after a CCJ award?

I have a HFC loan account which stupidly I accepted a CCJ on in 2007 for the interested front loaded loan, PPI costs, Solicitors Collection Charges & legal fees.

 

At the time I wasn't aware of how loe HFC and Restons success rates were so I agreed a monthly payment plan as part of the CCJ.

 

I know the CCJ is enforceable but could I also start a claim against HFC for being misold the PPI insurance which they told me I had to have to get the loan. Or have I missed the boat with this because of the CCJ?

 

I was thinking an alternative would be to sue the solicitors for fraudulent misrepresentaton as they had lied or made a reckless statement in their claim inducing me into loss and damage.

 

Fraudulent misrepresentation would be quite a good one because it may get the solicitors struck off.

 

Am I losing the plot or do I have valid points?

You need to do some research but IMO you would no doubt have a claim on the PPI issue as 90% of PPI policies have according to the Financial Ombudsman Service have been mis-sold. I believe the CCJ issue to be irrelevant the main fight here is the PPI mis-selling.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

When I took the loan from HFC I was told that I must have the PPI to get the loan.

Can anyone advise what my PPI entitlement would be? The PPI cost was £1508.22 for a 5 year loan at 22.6%apr. The interest on the PPI was detailed as £915.19 in the CCA. I defaulted on the loan and then tried claiming in September 2006, which they refused to pay as I had defaulted. They therefore cancelled my insurance policy and refunded me £502.47 reducing the loan amount.

 

The amount of PPI I paid including interest was therefore £1,920.94 after the refund.

 

I then had a county court judgement made against me in October 2006 where the solictors had the loan amount plus the insurance plus the interest for the 5 years, plus legal costs, plus a collection charge. Less the refund they already gave me.

 

I know I'm entitled to claim the £1,920.94 but can I claim for interest after the judgement date? If so at what rate 22/6% or 8%? Also could I claim the legal fees and collection charge as consequential loss and damage on the basis that if the PPI had not been added to the loan that I would never have defaulted.

 

I currently have over £11k on a CCJ for a £6k loan so any advice on how to maximise this claim entitlement would be greatly appreciated.

Does anyone know what the latest with this test case is?

 

PPI claim sent to HFC, they told me that it was on hold due to the case.

 

PPI claim sent to Ombudsman. Called Ombudsman today who told me that they will not investigate until HFC respond, HFC are refusing to respond due to case.

Ombudsman said that they are continuing to request PPI to be to be investigated by can't do anything without a response.

Anyone know what's going on?
