I think, having read a lot of the posts on here, that a number of people have/will be reporting their Banks to the Information Commissioner for failure to respond to DPA requests.

 

My questions are:

1) Has anyone done this yet and if so what was the reaction/response/action taken by the Information Commissioner?

 

2) If nothing was done or your complaint was not investigated by the Information Commissioner - how did you proceed with your claim without knowing what your charges were?

Status:

 

Halifax - DPA sent 03/03/06.

Prelim Letter - Sent 27/03/06 ignored.

LBA sent 10/04/06 - Ignored

Moneyclaim filed - 26.04.06

Acknowledgement received 3rd May. Halifax state they intend to defend.

Halifax Settled in Full - 17 May 2006

Nat West told me that they wouldn't comply with a DPA request because I was no longer a customer. It was blatant time wasting as I am running up against the 6 year limit with them.

 

I complained to the IC and sued for an estimated amount. The IC took 3 weeks to tell me that they are going to investigate the complaint. I suspect that the result will be that the IC will slap their wrists and tell them to provide the information. Nat West will accept the slapped wrist and comply. I would be very surprised if there is any other sanction. Frankly, the only reason I complained to the IC is that it lends greater weight to my court case against the bank.
