Pac Man, if you feel that you're not getting much help then you've got to try to help yourself. This forum has loads of info, draft defences and templates you can consider. If you were to say "I've read up, I think I should do x next" then that gives people here something to advise you on. If things aren't moving fast enough on your thread then being pro active will really help.

Not at all, you have quite a long thread and it has become very confusing. As already explained, all those advising on your thread are volunteers - they too have families and day jobs. They do their very best to provide advice to as many people as they can within their own time constraints.

 

This is a self help forum and you need to provide clear and detailed information - every now and again, copy forward and updated summary of where you are to date and what advice you are requiring - this will help others to help you :)

Can you let us know what route you want to take here. Are you looking to file another set aside application, or prevent the bailiff from coming by setting monthly payments, or something else?

 

I'm afraid my personal view in post 125 has not changed. It is a requirement that set aside applications are made promptly, which case law says means 2 months. I think you are now out of time for getting this judgment removed and unfortunately I think your best option might be to contact the creditor and try to reach an arrangement. Especially if you don't qualify for an exemption from court fees.

I agree.

 

You cannot file another set aside, IMO. You must appeal, and you will need a very good reason for the delay in appealing. You really do need to consult a solicitor.

 

The alternative is, possibly, to issue a claim against them.

I would appear that grounds for appeal are simple here:

 

 

Pac Man was not at any time a partner/director nor a sole trader in relation the company and the purchase order, the sales representative has entered in correct data on the order form,

 

 

Often such orders require identification of the person placing the order e.g. xxxxxx. Director, proprietor many will require a managers signature to be countersigned by a principal.
