hi everyone

 

just wondered if anyone could please give me some advice on MBNA...theyd been v quiet for a while which i thought was odd and then out of the blue i got a letter on the back of mine saying that my CCA is legal and that they have now dealt with my case and basically its not up for discussion anymore.....

 

i have already posted up a copy of my cca up here a while ago....

 

i need to send them something this week, any ideas what? AIC are also on my case BIG TIME....

 

please help!!

Was the CCa enforceable?

They would say it was no matter what. We need some more info so we can try to help, are there unfair charges on the debt, is there any PPI Can you post up the CCA again so it can be checked.

im really worried, can these people put a charge on my house and take me to court?

 

i have it on my desktop at work so will copy across to hotmail then scan in tomorrow....

 

mbna are quite nasty tho arent they...so i hear!

These people can do a number of things if you are having financial difficulties have you spoken to them about it, you could then offer a token payment and have interest frozen for a period of time.

I have no legal training, any knowledge I have has come from this forum, and my own experiences. Always balance up any advice you get with your own common sense.

well, made redundant last year and am trying to get them to be a bit more accomodating and they are not.....they are being really quite obtrusive....have sent them a letter albeit a while ago but they never really respond. is there a letter i can send them again?

original creditor, was there Payment protection insurance. Just offer them a token payment what you can afford explain the circumstances.

Yes there was but cancelled half way through the agreement. Was what was paid ever refunded?

I have tracked down your CCA, an on-line application which by 7 April 2007 no longer required a signature, merely a tick in the box, so valid on that score. All of the Precribed terms are there, however non of the multiple pages are numbered so there is now way of telling what was part of the original agreement. They may well have to do better if they wanted to take this to court but it's not a complete get-out-of jail.

 

Be aware though, you have an interest in a property. They will be able to see this and it does make you a viable target for court action.

 

I cannot see that you have posted up the default notice anywhere. MBNA DN's are often far from legal, can you post it up?
