I have taken two actions against Lloyds Bank in the past. The first one they caved in after the summons and without putting in a defence.

 

The second time wasn't really an action, I suppose because I only threatened them with a summons and they caved in. Very unsatisfying in a way.

 

Now I've got another battle with them. I threatened them and sure as eggs is eggs, they offered me my money back as a matter of goodwill. However, the sting was that if I accepted the goodwill payment, they would close my account and demand immediate repayment of my overdraft etc.

 

Any advice?

Refuse. Tell them that they owe you the money back, that goodwill has nothing to do with it, and that therefore you refuse their offer and will continue with legal action to recover the costs if they don't comply without attempting to put terms and conditions on it.

 

And if they don't pay, sue them. But refuse to be led and make a point of saying that this is NOT a situation where a "goodwill offer" is recognisable - they've taken the charges illegally, and must by law refund them. Make it clear to them you do NOT accept the terms of their "goodwill offer" and expect to continue the contract for services you have with them.
