Under what circumstances can an 'arrangement to pay' be applied to a credit account.

 

My understanding - from the Information Commissioner's office - was that these are to reflect an agreed reduction in the sums being paid.

 

I have had one applied to my account as a punitive measure for being slightly late (1 week) with two consecutive payments previously. I have never missed a payment, nor have I paid anything less than the full amount. I am also using the FOS to challenge Abbey for the reason why I was late (they refused to take payment each time because their systems said no payment was due).

 

Are lenders allowed to apply an 'arrangement to pay':

 

1. Without notifying the borrower

2. If I haven't missed any payments

3. If I've paid in full

4. As a punitive measure to reflect 3 consecutive months's of 'slightly late' payments?

 

The arrangement to pay only lasted one month, but the month for which it lasted I paid fully and faster than any other month where I didn't have a (1) placed against my report.

Good news!

 

I've challenged it and won!

 

Abbey called me on Saturday to say that they are going to remove the arrangement to pay and also to remove all late payment markers on my credit report.

 

I will post later explaining how I did it, but a combination of different attacks from FOS and also Information Commissioner did the trick!
