      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just a belated update of this thread -

 

As previously mentioned RBS didn't keep their promise to send out their decision regarding our complaint, so on 14th December our file was passed to the FOS.

 

I was actually most surprised that RBS didn't keep to their word, as until that time they had been very forthcoming with updates on our complaint. Now I'm a little concerned that they may be intending to hide behind the fact that this PPI dates from 1999, as I recently read in another thread that other Caggers have experienced this situation lately with RBS and that the FOS have said that due to the date of the agreement it's not within their jurisdiction. At the moment all I have received is the standard acknowledgement confirmation from FOS, so will just have to wait and see with this one................

Hi everyone:)

 

Today we received the good news that after FOS involvement Direct Line (RBS) has decided to uphold our complaint!

 

As this loan was paid off early way back in the mists of time and I'm not sure whether the closing balance took into account a PPI rebate, I'm not certain how much to expect on this one and (as usual) the FOS letter/acceptance form have no figures. Therefore I'll have to have another play around with the figures to establish how much we're going to get :D

 

Anyway, one the cheque has been received and has cleared that will be another 'won' to chalk up!

Just a quick update on this -

 

I contacted the FOS adjudicator dealing with this complaint regarding the whole issue of signing the acceptance form in 'full and final settlement' with no prior knowledge of how much the refund would be and emphasised the point that as this loan was settled way back in the mists of time (10 years ago) that I wouldn't really have a clue if what we receive is correct or not. I got the usual response that RBS (Direct Line) will send out their calculations and if I disagree with the figures or the refund itself I can go back to the FOS - they just don't get it do they? This whole thing about signing an acceptance form in 'full and final settlement' is fundamentally flawed, yet the FOS can't (or won't) see it :confused:

 

How many financial institutions actually send their calculations to you before issuing the refund cheque? Not many I reckon!

 

I also enquired about compensation for the distress and inconvenience of having to file a complaint and was told RBS are not offering any compensation!

My Direct Line claim finally reached an adjudicator in April this year (sent to FOS in Mar 2009).

 

I have been abroad for a few weeks and returned beginning May and rang the adjudicator to find out what was happening. Was waiting for a response from RBS to his letter upholding my claim due on 6th but as he hadn't received anything gave them a bit more time.

 

I e-mailed him again on 20th may as I hadn't heard anything. he said he had received a response from RBS and would write to me shortly, nothing yet received and he didn't mention whether they had agreed with his findings or not.

 

Quite a substantial amount which would be most welcome. Guess I should just be patient. Your turnaround was quite quick. Did it move quite quickly once with an adjudicator?

 

Have you now returned your acceptance of offer?

Sorry to hear your claim is still not fully resolved, but pleased the adjudicator has upheld it!

 

Mine went to an adjudicator in mid-March and the letter upholding my complaint is dated 28th April at which point the FOS said there would be a likely delay of 8 weeks until the refund was received.

 

I returned the signed acceptance form on 6th May, then received a further letter dated 17th May from the adjudicator saying to allow 8 weeks from the date of that letter for payment to arrive and to let him know if I'd heard nothing by then - I had assumed it was 8 weeks from the date of the previous letter, but obviously not :(

 

As yet nothing has been heard or received from RBS..........

 

It's definitely best to keep on top of them I think - otherwise I'm sure they just forget and move onto the next complaint they are dealing with - after all the last letter does state 'I am now arranging to close my file' which is obviously implying they assume all will be well and that we are satisfied/will patiently await the return of our money!

 

Keep at them and keep me posted as to how you get on.

You're quite right Landy, they do seem to forget. I had an Egg claim with an adjudicator before i went away at the end of march. She resolved it and i asked really nicely if she could get the offer letter to me before i went away but alas, not. When i returned 5 weeks later, still no offer letter, she forgot to send it! Then had to wait a further few days before it was sent on to Egg by the adjudicator. In their defence, I'm sure they are drowning in claims.

 

I will just keep pestering! Hope it's not dragging because RBS don't agree but I'll just have to wait and see.

Meant to say they certainly are taking their time with refund. I would ring RBS PPi office after a week or two to make sure they have the acceptance form.

Yes, Dec is right there is a new FOS questionaire which you have to send to the company concerned along with a cover letter - it is supposedly to assist both the finance co and (if you still have to go to them later on) the FOS.

 

If you go onto the FOS website and look at the section regarding making a complaint, there is a note specifically about PPI claims and the form to download I believe. This has been brought out since I made my complaints so I don't know if it improves the system..........hopefully it does!

Rang FOS on 2nd of June and my file was on it's way back from the offer approval team back to the team manager for an offer letter. Rang again today and was told that it is still with the manager waiting to be allocated to an adjudicator (original one has left) to send out offer letter. Wasn't able to speak directly with the team manager (no name given) as he woouldn't be able to tell me when letter would be sent out. Really annoying, don't know why it is taking the FOS so long!!

 

Now I've had a whinge I feel better! Any sign of your refund yet?

Hi everyone:)

 

I was going to call RBS to chase our refund today, but before I had a chance the postman delivered a cheque from them for just over £1500.

 

The accompanying letter says this is in full and final settlement and that it 'represents a refund of the premiums and associated interest you paid to date (£****) and also interest on each premium of 8% net of 20% tax (£***).'

 

I'm not sure if these figures are correct - I had estimated closer to £2000, but as this was from so long ago I couldn't remember if we ever received a partial rebate on the PPI when we settled the loan early.

 

Sorry for being Mrs Thickie but what do they mean about the 20% tax?

 

As I expected, other than what I have quoted above there was no actual detailed breakdown of how they reached their figures included.

"Interest is usually taxed at source, the payer being mostly banks and building societies, deducting 20% then paying it over to HM Revenue & Customs. (Even though a person's income is in the 22% rate band, say from employment plus the interest itself, they are not liable to pay the additional 2%. I assume these would have to be declared to HMRC on your tax return, and if you are a higher rate tax payer, you could get a bill for additional tax at year end?

See you've had an explanation about the tax, some take it off others tell you to advise HMRC yourself.
