      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

when times are hard and things are not going our way the good old british public find a scapegoat.yes we found gordon brown .i actually dont beleive brown is to blame for the credit crunch at all . this is a global situation effecting everyone worldwide not just the uk.he was a person who came to office and had a horrid start as prime minister glasgow terrorist attacks, foot and mouth, also bird flu epedemic. then we have the severe credit crunch .the conservatives said we would have done nothing for the banks just let them go bust .but rightly or wrongly we ploughed billions into there coffers.but the thing is the loss of jobs the repossesions of homes, the collapse of high street big boys.but brown tried to help brought intrest rates down lower mortgage repayments lowered the time limit on dpp paying mortgage intrest out in benefits .got agreements with mortgage companys and the courts repossesion was to be the last resort. intrest rates at an all time low surley this has helped some people in the uk.conservatives last time dont u remember job losses high unemployment also intrest rates at 15%.i think we all have short memories.when conservatives come to power did mr cameron say he would abolish sure start. i think this was a good policy for all and strenghens the links in the comunity for all families with young children .really has been a sucess in the comunities of the uk.i have seen hospital rebuilds all over new modern schools being built surley this is the kind of thing that we need to see under any goverment. the mps exspenses well that is all parties involvement there it is corrupt dishonest and morally wrong .we lock people up for benefit fraud .so why are these mps claims not dealt with the same way .people want to see justice cant have one law for one and a diffrent law for mps.what will a genral election do know life might become harder we have to have a genral election by june 2010 latest. let brown carry on and see if his policies get us out of this mess .indications show it might be .last year we was going to be last out of credit crunch there saying know we will be the first .if browns policies on credit crunch not working why is most countrys adopting browns policies worldwide?????????????????????????????????

well said bookworm im pleased your living in the real world.also u see real problems .well i think browns policies are showing signs of working .the conservative policies abolish sure start sop building schools and hospitals abolish the 50p tax for the rich .thats just in the first few months .i bet a lot of us are enjoying low mortgage payments at present .last tory goverment 15%then u will see repossesions .cant understand why the exspenses thing cant be sorted.that is corrupt dishonest and mps cant behave like this .

let me say each contribution made on this topic is personel opinions i my self think thats what is good about this country we have the freedoms to voice our opinions .but in my case whatever your political views are these are respected .such a debate like this is good for opinions to be voiced . as regards to fringe parties yes they should be part of the political situation 3 party system not the best for a democracy but i must make an exception i would never vote for the bnp.but perhaps we need to see there policies lay them out and we shall decide in the next 12 months .suprise no one has mentioned the green party they have been on the go for years do they represent the world today

Nah, that's just wishful thinking. All you have to do is look at other countries and you'll see that no matter what their policies are, they all have been badly bitten. You can blame Brown all you like, but I'd take a bet that there is an overwhelming feeling of relief in the Tory HQ that they weren't in power when the bubble burst or they'd be the ones carrying the can on that one.

 

Ah, someone too young to remember the Thatcher years then. :razz: Yes, those years where the recession was home-grown, interest rates soared, mines were closed, milk for kids in school was stopped, child benefit got frozen for yrs on end, the poll tax was introduced, the NHS got dismantled brick by brick, the railway sold off piece by piece, need I go on?

oh yes i remember bookworm intrest rates over 18%lowest was 15%.schools crumbling no new re builds at all like we have now not even a minimum wage .long n h s waiting lists massive waiting lists for operations. dont forget these days there worth remembering especially in the polling booth...
