      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hiya all

I got a acer laptop of BH which is 2 yrs old in August after about 6 mth the mouse pad collapsed sent it off to acer and it was mended within the week.

About 2 months ago the same thing happened again .Also the laptop will not charge on the mains when u plug in it says this charger is not compatible with this laptop. took it back to BH who sent it off to acer 6 wks later still paying the bill and not having a temperary replacement i have it back to discover the mouse mat has been mended but i am still having the same problem with the charger when u do eventually get it to charge u CANNOT move the laptop in the slightest or its game over . Went back in to BH that week to tell them n they said it must b a dodggy charger and gave me one out of a new laptop box guess what still not charging propley .

I know it dosnt take a genious to work out that its the laptop thats faulty and not the charger but they dont seem to think so .

Sent my hubby in to pay today and ask if they can provide a copy of the work sheet from Acer to see what has actually been repaired.

Does anyone have any ideas where to go from here as we cant b without the laptop for another 6 week as we need it for the things we sell on ebay. any help will be appreciated

right hubby back from BH they said bring it back we will mend it this will take 6 weeks.we only have 14 weeks left to pay then the laptops ours if this is a reacurring problem were gonna end up with a laptop that dont charge apparantly it dosnt get sent to acer BH mechanical team do it,she said seeing as the standard guarantee has run out we cant have a new one all though we got other cover from them. he ask about having a replacement till ours is fixed and she said because of data protection act with is impossible to do.any suggestions

could do with some help on this guys any suggestion on what 2 say or who to contact 2 get a new laptop

Hi sorry ive been working all week. 1st of all with regards to their comment bout gaurentee has ran out so cant replace the OSC extends the warenty in all avenues and this includes replacement though it only replaces if the item is beyond ecconomical repair. I would say to them that you are not happy as this fault is re-accurring and ask for a replacemnt data protection doesnt come into it as all items are completly referb'd before they can be sold, if they refuse ask for a loaner as they can supply these tho very often choose not to. Also they arent adhering to their side of the contract as the item isnt working and they arent carrying out satisfactory repairs ask for a credit for all the time it has been away and will be away (this is company policy if they cant provide a loaner they will credit the account until repaired) and I bet you it wont be away 6 weeks again. Hope this helps

took laptop back today and asked for a user one or to credit the account he asked how we knew about this and i said got a friend who works for bh he then tried to call me a liar saying that non of it was true .

 

After a few words he looked at the laptop and said it was beyond repair with it going funny lots of times

 

He suggested giving me a different one but it would have to b the next model up as they no longer sell the one we have,dont know if its got the same specs as mine as he didnt have one in the shop to show me .

 

I dont have to pay anymore money for the new one just pay the balance of 6 wks on the one thats broke

 

We have to go in store on Monday to collect the new one and take the old one back after taking pics and thing off.

 

What i want to know is would the new one be guaranteed for a year even though it will be paid up and what would happen if this one broke down during the year

 

He said we wouldnt have to have a new contract or anything my concern is how would i then prove i got it from bh if anything goes wrong with it and what if i dont like the one they are offering .

 

Any help on this .

Right picked the laptop up last Monday all they did was change the details on screen

I asked how long it would be covered for and they said 4 weeks cos thats when its paid up.

My concern is I actually paid for a brand new one in the first place and now ive ended up with a refurb one .

Having a few teething probs with this one as everytime I type the curser jumps and I start retyping over the stuff ive already done and when ur on games the curser freezes for ages

Im not very happy with this laptop is there any way of actually getting a different one (brand new and not a refurb)without paying anymore.

any help would b appreciated
