    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All,

Recently put a claim in for PPI I had on a loan I took out with Citifinancial, they wrote back recently to tell me that they would be paying me the cost of the PPi plus interest on the premiums (I do not see the 8% included in the costing, but that's another matter)

Something else which came to light which is more alarming is the fact that the letter sent to me advised that my loan had been cleared, but to this day Citifinancial are still claiming money from me approximately £2000!

I remembered this had been paid off afterwards as I remember taking out another loan and the loan company wrote a cheque for all of the debts I wanted to pay off!?...

I need to know if I can claim back the charges and all the instalments and default entered against me, this debt had been passed on to two different agencies which I am sure helped to increase the debt back up!

Could use some advise.

Thanks

Bizzi

I am not sure what you need to do here. You need to establish if the 2nd loan you took out did in fact clear up this particular loan.

I will ask someone with more experience to look in on you and advise.

Apparently you should send your Subject Access Request (plus a £10.00 fee) to the the original creditor using the letter in the link below.

http://www.consumerforums.com/resources/templates-library/86-debt-collectors/576-subject-access-request-debt-a-dca.html

It is best to send the fee in the form of a postal order or third party cheque so your signature isnt used.

This should enable you to establish if the company did in fact pay off the first loan for you.

Thank you Citizen B,

I had thought that would be the best route so I will do that.

Thanks again, will keep you posted.

Hi All Just to update you,

I have recieved diddly squat from Citi and to top it off, I made an amazing discovery today. I have found a letter sent to me in 2003 detailing how much I would need to pay as an early settlement to clear the balance. Now my guess is, that they did not bank the cheque straight away in fact, I am sure the other loan company that issued the cheque contacted me as the cheque had not been presented.

Really need some advice as I have been paid nearly £4K for the PPI, but the early settlement would have meant there would have been rebate of interest & insurance both of which combined would come to £6K plus, I need to know if I can claim for this & if so, would I claim also for the 8% on top of this & from the PPI claim payout which they did not pay me.

If someone could help, I would be really grateful.

Thanks

If Citi have not responded to your SAR within 40 days you can report them to the ICO. I had to do this with Morgan Stanley and for once the ICO did react by contacting Morgan Stanley. You really need all your paperwork. I did a SAR with Citi and they kept sending bits through and in the end I told them I would have to take action against them if they didn't provide all the relevant information. If and when you do get anything through check it with a small tooth comb, slippery. A complaint to the FSA wouldn't go amiss for their practices. A couple of us have already complained, whilst the FSA don't interfer with any claim all complaints are recorded.

This is great information, thank you very much.

In regards to the subject access, we are now in day 42, so 2 days overdue.

I will definetly be pressuring for all the information they hold on me as they are still claiming I owe them just over a £1000, but I believe this was completely cleared by the cheque I sent to them in 2003.

Crooks!

Thanks again.

Hi All,

I am back after the longest 40days in history!!...;-)

Low and behold I have only just received details from my subject access request in the last couple of weeks after having to go through the Information Commissioners Office!!... It's only taken nearly a year!!...

and all they have sent me is statements of payments made through my IVA.. but I have some major discrepancies that I need help answering..

First Issue

*I have Citi in my IVA- I don't believe I owe money on this debt, their 'initial balance' -they state there was a debt of approx £6,000- but when loan was drafted to the court the amount came in at £1900??

Second Issue

*Within the information sent, a letter from Citi explaining they had NO information on the account I was requesting access for (the ONLY account I had!!) a bit of a concern!?!?

Third Issue

*Is it worth writing to them again to try and get more information?... How do I make further complaint regarding no information in SAR?

Should I pass to the Ombudsman now?

Fourth Issue

*Can I get this account removed from my IVA and the balance reduced?

Would this deem my IVA invalid?

Would really appreciate some advice please?

Thanks you!

Bizzi

xx

I would write to Citi again advising them that the SAR is incomplete and note your concerns, give them a date by which to reply and advise them that if they do not adhere to your deadline further complaints will be escalating. Give them 14 days max.

Should you have had an agreement with these papers? if so, specifically mention this and any documents that you think they should hold.

I know when I did a SAR with them the papers came in bit by bit and after 40 days I sent them a letter before action and I was amazed just how much extra paperwork turned up.

I can't answer your 4th issue - no nothing about IVA, I only know how cunning Citi are!

Thanks for coming back so quickly Surprise.. Really appreciate it.

I will write to them again, they really are unbelievable in terms of the time taken to send what information they have!!

And what they have sent I could have got from the IVA company... They really have nothing according to them?...

I will let you know how I get on..

Thanks again

If you read up a little in here-you will understand how they are working-and so need to be shown the same contempt as they show their customers !
