      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all...

 

Received a letter on the 11th March from Meritforce demanding payment for a debt I didn't recognise (doesn't appear on my credit file either).

 

Sent a CCA request to them later that week... received a letter this morning making a 50% reduction offer for an immediate payment which is a "time barred offer" never to be repeated! Wow... so anyway they provided a link in the letter where you can have an "online conversation" with a DCA operator... here's what happened. Enjoy :-)

I think the debt is possibly Statute Barred but, hey, until they provide a CCA how can I tell? ;-)

 

I can't say too much obviously yet but they are falling over themselves to avoid sending out the CCA.

 

I've never asked this before but it's something that has caused me to wonder...

 

If I do not acknowledge a debt, and pay not a dime on it, then after 6 years it is statute barred from my understanding...

 

BUT...

 

If the company provides proof of the debt... how can you wiggle out of the acknowledgement if the company have provided proof of the debt upon me asking for it? Is this not an acknowledgement of some type?

 

Answers not appreciated on a postcard... here will suffice :D

I love the replies people... I didn't expect to get this many to be honest. I was just getting frustrated at the same old letters coming through time and time again.

 

Regarding the statute barred debt... what I was trying to get at was this...

 

Debt is 5 1/2 years old... no acknowledgement/proof in all that time... say you contact the DCA and ask for a CCA if they wrote to you... does this count as ascknowledgement? I have written "I do not acknowledge this debt" in all my letters but I always wondered whether there was a stance on this?

Good good... just checking my actions aren't in breach of that :-) I think this is a statute barred debt to be honest and that they are trying it on... I mean the "client" is actually Lowell Portfolio who have a habit of enforcing statute barred debts... surprised to see another DCA take over work from another DCA though... not seen this with my other creditors... they doubling up?

I'm not sure if it was me that caused this but the Meritforce "online chat" facility has been offline these past couple of days...

 

...would hate to think I gave them a nervous breakdown :D

Seriously... it's been offline all day today and all day yesterday! I must have had something to do with that surely? :D

 

Seriously though... I think it's made them think twice about having this facility, particularly if fellow CAGGERS have been gorging themselves on the facility lol - it's so funny

Just got back from shopping and found this wonderful post - really cheered me up (and btw I did buy undergarments.... and cleaning gear....)

 

It really surprises me that you got somebody who could write English quite clearly, usually they are very brief and basic.

 

A lot of it was company line stuff though... cut and paste jobs to save time.

 

When he was actually challenged with legal information he didn't really have an answer and especially when he was tripped up towards the end... I kept asking if they were going to stop demanding payment and at first he said "no"... I did a "Paxman" on him and he eventually backtracked... small success but pleasing and I'm glad it cheered you up... we all need something to keep us all motivated in our fight with the DCA's!

Can you tell me please how I can get screenshots as I'd like to do the same.

 

Ok... I did it like this...

 

I started at the top of the conversation history... then on my keyboard I pressed a button labelled "PrtSc" which is a print screen request...

 

I then opened "MS Paint" and pasted the screen into it... (I pressed and held down) the CTRL button and pressed the letter "V"

 

Then I blanked out the names and any other identity related info... then clicked "save" - I then uploaded to photobucket.

 

Look forward to see those screenshots!

Congratulations, I've just found this thread and seen what an inspiration it has already been to other CAGGERS. Keep up the good work:D

 

I do feel proud to be noticed on here... it's hard to be unique on this site as it sometimes appears people have seen and done everything... I'm just pleased to have inspired, given a laugh and hopefully raised spirits.

Always good when someone comes up with a new idea to annoy the DCA's with. I have a feeling that there's a lot of life left in the "taking the pee out of the DCA's" attitude.

 

They've taken the pee for years. Now it's our turn to show them how to do it properly. :D

 

Now who's up for an episode of Jeremy Kyle featuring some real lowlife DCA employees? :D

 

I'm sure there are plenty more things to do... I'm actually looking at preparing a documentary possibly about the debt collection industry... if I could find the backing for the project then I think it could be really interesting.

Busy learning more about video editing and things as I have a documentary to make. Nothing to do with DCA's though, but it will have the same fuzzybobble humour and views on life. If all goes according to plan, it will be brilliant. Not just the end result, but filming it will probably be a life changing experience too. :D

 

Can say no more at this moment in time, but CAG members will be the first to see the end result. ;) But you may have to wait 2 years.

 

I feel a project coming on ;-)

Pity they didnt do a webcam chat. Now that would be HILARIOUS.

 

Notice how they have a different attitude than when they are on the phone.

 

I feel sorry for them in one way actually... it's clear that the operators are minimally skilled in a number of areas and simply there to take a badgering from disgruntles debtors. The ONLY saving grace is that it is written proof of their misdealings.

 

If they try to claim harrassment I would just claim the same back quite easily for the number of calls they make, the number of letters etc

Suicide is the only option for **** like those who work at DCA's - in fact it should be an honourable way out of their ****e lives IMHO.

 

Hell I wouldn't wish death on Gary Glitter wannabes and granny rapists... they should rot in jail instead... DCA employees though... hmmmm... some sort of mercy killing seems the only logical choice ;-)

There was a slight pause actually... but not long enough. I am stupid enough to think that the half intelligent phrases came from their fair hands but they were extremely quick to get off when I had informed them of their glaring mistakes.

 

They do let you take the **** a little actually... (see the "bear with me" remark about being "undressed") but when you actually get down to the nitty gritty they fall apart.

 

Like I said I think they have closed the online chat down because it has been replaced by a clock lol... counting down the hours to closing time!
