Hi, i am cosidering bamkcruptcy i am in so much debt about 14.000.00,the worst one is from welcome car finance,i have a car on finance i havnt paid it scince nov 2007 i have had no letters or phone calls,then yesterday i got a letter from a company called D.L.C.(Direct Legal and Collections),saying my account has been referd to them and i owe 9.675.88,i also have a debt with capital one it was 230.00 H.F.O. have now taken over that and say i owe over 600.00,and i get letters nearly every day stating i owe money but dont stae what its for or who from,i read somewhere i can send a letter and send 1.00 ,to ask for proof of what i owe does any one know what i should put in the letter,as i believe i may be able to sort my debts out without going bankcrupt,as for the company who want 9.675.00 i will offer them 1.00 a week,any help here would be great,but before i go one more thing:now i have a car on finance it looks like the debt been passed on to this collection agency,its obvious welcome finance have no interest in the car,so what do i do with it! do i keep it,do i sell it and get a cheaper car then pay off some of my debts,as its not mine to sell,but that means i would have to keep it for the rest of my life,thank you,steve

Hi Steve,I can see you already have threads in 2 other forums here and so are not new.

I Think you should start a thread in the CAP one forums for those issues.

For the Welcome Finance-I will move this post and see if we cant get you some good advice.Maybe you can post more about this in here.I will change your thread title so people can give some pointers.

If it is your view that you are not the creditor, s.175 of the CCA 1974 applies in the case of a simple assignment, and places a duty upon you to pass this request to the creditor. Hi,Martin,can i just say thank you for your reply,however when i post something i can never find it after,ok so firstly i got the car from welcome 6.995.00,the guy in the garage said i must have ppi but i can cancel within a month,so i take the car and inform welcome i dont want ppi,they done nothing so i continue paying for about 5 monthes,then eventually they made a new agreement for 5 years for 6.995.00 but no ppi,so i questiond about the money i had already paid,they basically said tough its a new agreement,2 months later we get flooded 3 times in 1 week,we had to move home start from scratch etc,the n my debt problem started,i informed welcome of new adress and phone number,but they never botherd asking about payments,6 months later i phoned them to say i would start making payments plus a bit extra,the girl at welcome said o' ok i also confirmed they had my new adress and phone number and they did,so still no contact 6 months later i get a letter from welcom saying i am in arears by 1 month in fact i hadnt paid for 1 year,so i phoned them up and they said to carry on with the payments and pay a bit more when i can (what payments) i thought,then 3 months later i get this letter from the debt collection agency,so it seems to me welcome dont want my car back.its 6 years old in march.

Ida,thanks so much for this i will do it now,however i dont have the adress for HFO as they only phone me but i always pi-- them off,the last 2 times i told them i was making my selfe bancrupt,before that everytime they phoned i blew a whistle down the phone,and one time i told them to hang on and i put the phone on the side and left it,

Sounds like you need a quick lesson in how to use CAG

 

You should get an email when someone replies to a thread you are subscribed to. This always has a clickable link back to the thread, so you can pick up where you left off.

 

On the site itself, click on 'User CP' at the top of the screen, first item in the menu bar. This will often show the latest subscribed threads, which you can expand to show all the ones you are involved in by using the menu to the left. List Subscriptions/View All

 

If all else fails, and it shouldn't, use Search form the menu bar and find threads with your username in.

 

Bear in mind this is meainly a self help group, it helps if you can help yourself, especially in keeping track of your own posts. If you can't keep on top of them you will not see the very helpful answers you get. :)

I've a lot of the pages I visit regularly set as bookmarks/favourites. Just hold down CTRL and press D on a page you want to save. You can create a 'folder' for all the CAG pages and just go back there when you need them next.

well one thing i dont understand here:looking at other posts if you miss just one payment welcome are knocking on the door and repossesing the car,i wonder why that is not the case with me!

 

Just how bad is the car you bought? Would anyone in their right mind actually want it back?

 

Seriously, worth thinking about - if the car value has dropped below a given level, they'll not want it back as they could lose out on any re-sale.

 

I do wonder why DLC have got this one though - Welcome are part of Cattles PLC, who also own Lewis Debt Services(LDS), who use the aliases CL Finance and Howard Cohen Solicitors as well. Their own debt collectors are often first on the job. Oh well.

 

Be patient, follow procedure, and see what they do to try and prove their case. A CCA request may seem to take ages to arrive, but after the 12+2 days you can take another step by telling them what to do if they've not complied.

 

Just to note - try and keep your threads seperate, don't deal with several issues at once as people get confused. I've kept this reply to the issue of Welcome as I note the site team have noted you have other threads running for the other matters.

Ah, I confused you. Sorry, I was making the point that they may not want it back if it wasn't going to cover their loses. Much easier to demand the full amount from you.

hi all,well i have moved a sep further now with this,the collection agency has contacted me,they wanted the money in full,i said no chance,so they said 240.00 per month i still said no,now they say 160.00 per month so i have agreed to that,however they seem to think its a loan not hp,so i didnt say any thing further,i am unable to lay my hands on the agreement,but i think welcome have messed up and seem to think its a loan not hp,and thats why they hav'nt repossesed the car,
