Hi All, Seen a lot about Stat Demands on here but a bit confused as how to deal with this one?

The story so far......

Capquest have been chasing my partner for a credit card debt so we sent CCA request 'July2008'.

Received CCA 'August2008'.

Wrote back to capquest 'August2008' disputing CCA, stating it was a application form not a true CCA.

Capquest responded 'August2008' highlighting relevant text 'allegedly' proving it was a true copy of CCA. However they also confirmed they where requesting additional details from card provider on her behalf.

The next correspondence from capquest came 'Nov2008' "Following our previous correspondence, we are still endeavoring to obtain the required information from card provider regarding your account query. We are discussing your case with card provider personally and we hope to resolve this matter very soon".

Unfortunately the only other correspondence came two day's ago in the form of a Statutory Demand:-x

Chantry Collections - CCA sent

You obviously need to apply to have this set aside on the basis of a dispute. If the "CCA" is not a compliant document, in that it lacks the prescribed terms, it should be possible to get this set aside.

 

You should also be trying to contact the person whose name is given on the Statutory Demand. Was it O'Keefe by any chance? If you keep trying and cannot get put through, then the Statutory Demand is invalid.

 

Capquest are one of the worst issuers of these frivolous statutory demands by post. Often they don't even turn up at any hearing. Try to get costs off the buggers as every time they get hit with expenses for pulling this stunt, the less likely they are keep pursuing it.

 

Was there any default notice issued by the original creditor before the account was terminated and passed to a DCA? We need to build up as strong a dispute as possible regarding this alleged debt.

Hi 42man, We decided to offer them payments of £5 per month. Unfortunately they replied accepting £15 per month(go swing that's not what we offered).

Have yet to reply to them! But was thinking, even though we made an offer could we retract that and go back down the route of a disputed debt??
