Hi

 

My date for hearing is monday 23rd at 9.30 - 2 day before eviction is scheduled.

Ell-en, what do you think our chances are? I am so nervous about this as it's only 2 days before eviction! If the judge will not suspend is there anything else I can do?

Can you get proof of this payment? If so, you need to take it to the hearing with you.

 

If you are able to show on your budget sheet that you can afford the payments you have offered, then you should be OK.

Have just had a phonecall from RBS suggesting the mortgage rescue sceme and have said that we should look at this option and if the CAB fax them and say we are eligible then they will hold off eviction. As I see it we will only be eligible for the rent back option. as based on current market value i think we have only 15% equity. I assume that if we do the mortgage rescue scheme we will not get any of the equity out of the property?

 

Difficulty is if courts do not suspend eviction, we barely have time to get these schemes in place.

What is your advice??

There's no harm in exploring the mortgage rescue avenue, at least you will have the paper trail to prove that you have enquired about it. You don't have to accept the MRS offer if you think it will not benefit you, but.....

 

............ you should definitely think about what the real prospects are of you keeping up with your mortgage for the forseable future - if you escape eviction this time and miss another payment, you may not escape again. If you are evicted in the future, you would most definitely kiss goodby to any of the equity as the lender would sell for what they could reasonably get and if that was less than what you owed, you would be liable for the shortfall.

 

Similarly, if you were to sell your property yourself and there is only 15% equity you would lose most of that equity in estate agents fees and solicitors costs, plus you'd have to look for somewhere else to rent.

Ok will definately look into this

 

If I get the ball rolling, can I still attend hearing Monday and try get suspended in an attempt to get repayment plan or will the judge say I should do the mortgage rescue plan? My first choice would be to stay owning the property to be honest - I am just trying to think of back up plans really - although having said that if the MRS do make an offer, like you say we could get our equity and have lowered rent payments. Will have a serious discussion with Hubby tonight.

Hi

Eviction has been cancelled as we have had a metting with CAB who confirm we should be eligible for MRS.

 

I am not sure it is the best option for us though and wondered if I can still go to hearing on monday and request the repayment plan??

The hearing is to suspend the eviction order, as it has been cancelled there is no order to suspend. Ring the court and ask them if you are still able to attend.

Just wanted to update you on my situation. The bank suspended the eviction to give us time to apply for the mortgage rescue scheme. In between then and my appointment with the council I got a full time job which I start in Jan so the bank have said we can pay interest only in december and then pay usual payment plus £100 towards arrears from Jan now I have a job!

So we get to keep the house, I hav a new job (in education so little risk of redundancy!!) and hopefully a brighter new year to look forward to.

Sorry to jump the thread, but this has just happened to me, and I am in a blind panic as to what to do...

4 or 5 years ago we defaulted and went to court, the possession order was essentialy suspended, with us instruced to pay back arears and sort ourselves out.

This year has been a nghtmare, partner on materninty for most of it, I ot ade redundant earlier and got way behind, letter was hand delivered today giving an eviction date of 8/01/10. his is because we got way beind, and I was owed bit of money that I kept getting promised, and never showed up, so I kept promising Northern Rock, and now I am nearly 6K behind.

I have just last week got myself registered self employed as I have found work including a job that will pay 3 times what I have ever earned for the next three years, but cant see any money till the first payment at end of January, wifes earnings are pittance...

What can I do???

Please help, I am feeling very very concerned, and not wanting to sound melodramatic, all sorts of silly things are going through my head...

Hi there Bronn, Can you start your own thread in this Repossessions forum and I will help you with an N244 application to the court.

 

If you can demonstrate that you will have the ability to make payments from January you should be ok. Does the amount of your arrears include charges?

My arrears are aprox £6300 i AM SINGLE AND ON JSA, DSS is paying £917 per month my installment is £1267/month at the moment I cannot make up the full installment my fixed period is coming to end in July 2010 than the installment will be £820.

 

What options do i have, Pls help.
