Hi I wonder if anyone could give me their thoughts on this.......

 

Trevor Nunn (the solicitors behind Arc debt Collectors..... Have threatened me in respect of a debt I don't owe....the usual response if you don't pay we will take you to court and all hell and high water will come upon you. I pointed out If I don't owe the money then you won't stand a chance as a Judge will want strict burden of proof from you and documentary evidence will need to be shown. I also pointed out to Mr. Nunn that it is illegal to send out letters on their letter heading purporting to be solicitors and then putting Arcs Contact details on it and their address. The Law society are very interested to say the least....its called misleading.

 

Anyway my hypothetical question.....If a debt collection company did take you to court and you did not owe the money and could prove it, could you at the same time file a defence and counterclaim, for the costs involved in fighting the case. I.e. time, telephone calls, letters - as long as it was reasonable could you go for a counterclaim in a small claims court and put the fear up them that if they lose you are going to be enforcing your counterclaim.

On another note, I know there are a lot of people out there (me included at first) who get the fear put up them with legal debt collecting letters. Most of these collectors act illegally. But always remember if you don't owe the money, or what they say challenge them, to give you the burden of proof. Tell them that if they take you too court no Judge is going to give them judgement without them demonstrating that the debt is legally owing....I've done this too Moorcroft and Westcot, I put the fear back into them that if they took me to court and lost I would go after them for damages....needless to say they don't write back....but they sell it on to the next idiot debt recovery company.......and it starts again.

 

I just wanted to say this too everyone as I know someone very recently who tried to take their own life due to debts and it turned out that they belonged to someone else but a debt company kept turning up at their house insisting they were responsible.

 

This forum has helped me so much.....If you can do donate some money no matter how small to keep it going for the small person on the street like you and I.

Of course you could claim costs for defending,in addition to a possible claim for distress and harrassment.

 

I wouldnt stop there either.You should be reporting these people.
