Help and advice required to get Deposit and Rent Back £1191

Hi,

Actually I stayed in the property for 2.5 month. After that I have found a tenant for my landlord.

I have moved from the property on 15th march 2008 and my friend has occupied the same property on 17th March 2008. As my friend occupied property immediately, so in this case landlord doesn’t loose any rent amount or any loss.

Now I have paid him full rent for the March month which is £625. As well as I have given £725 deposit before moving into house. My deposit is with DPS (thank god).

So total money I owe is as below

I owe :-

Deposit = £725

Rent for 20 days = £416.66 (Which I already Paid to him)

Tap Repair charges = £50 ( I paid to plumber when he came to repair the tap washer )

Total = £1191

Now after moving out from the Property Land Owner is saying that he has to repair the Tab and it is costing as below.

Lost agents fees = £312.50

Carpet cleaning = £75.00

Replacement taps (purchase cost) = £350.00

Plumbers fitting charge = £150.00

Total is = £887.50

Detail Description about his above charges:-

He has paid the 725 pound to agent to find me as a tenant and he is charging half the money to me.

In previous mail owner is saying that the Tap polish is removed and now he said that he has replaced the taps and costing as mentioned above. He has replaced the tap for £350 and fitting charges are 150.

I know that I have not damaged anything and taps are working fine when I was in the property, I am not at all happy with the price which he has mentioned.

2 days back he asked me to sign the DPS form with the above figure and return him £525 pound from deposit and I will only receive £165 something...and he said , if I will not sign the joint agreement within 7 days then he will take me in court.

After I replied to his email and asked for receipt, he said I have done everything in emergency so I do not have receipt for the same.

Now would you please suggest in such a Case what I need to do?

I will really appreciate if you could provide me some suggestion. Shall I go in Small claim court or not?

1 more think I forget to mention about my owner is He himself is a Solicitor, So just do not want to do any mistake.

The dates are correct and yes my deposit is with DPS. I have DPS account number and all details.

 

I have only recived your reply, I thought that I am dealing with the Solicitor so no one has replied to my thraed, Just to update you all .

 

2 days back, I have send a 1st notice via post as a recorded delivery to his home address and wating for his reply.

 

I mentined the following things in letter.

I write in response to your continued refusal to refund the outstanding balance of my deposit for XXX propery. I disagree with your assessment and charge.

Today I went to Citizens Advice Bureau in Ilford, London and have discussed my issue with them, Have discussed the below money which I should get from you. They have suggested me to

Go in small Claim Court.

As I have paid Council Tax, Electricity, Gas and water bills during my stay in the property.

It is my calculation and therefore seeking the below of the remaining money.

Remaining Rent for 20 days for March

£416.66

Already Paid 50 pound for Tab repair, have given receipt to Neil

£50.00

Deposit

£725.00

Total

£1,191.66

 

I should be grateful for a prompt acknowledgement of my request, followed by your detailed response. If I will not receive a satisfactory response from you within 10 days including bank holiday from the date of this letter then I intends to issue proceeding against you in the county court without further notice

If you do not pay me the money by 22 November 2008, I will issue a county court claim against you.

But i can not offord the solicitor to work for me. How much will it cost?

 

How to raise a dispute with the Rent Deposit Organiser.?

 

I have not got any reply from him..

ur LL is a solicitor doesn't mean that he has knowledge about housing law. he could be specialized in other areas.

 

You have dispute over rent and over the deposit, i thinnk u should treat both as separate case. Go to your deposit protection service and raise to them that u have a dispute over the deposit, and for rent dispute, i don't know how i could help.

Contact the Deposit Protection Scheme organiser and state that you wish to raise a dispute.

 

You will need to make a Claim at your local County Court. Go to your nearest county court and ask for the N1 Claim Form. Complete this a home. Attach any evidence you have. Copy everything twice. Take two copies to the Court and pay the fee (unless you have a low income in which case ask for "fee remission").

 

You now wait until the court sets a date for the hearing.
