How much are the charges and the outstanding balance?

 

Do you have a claim against Cap One for the charges?

The default would simply be in the name of the company that were dealing with the account. So really it could be either Cap One or Cabot.

 

Have you asked for a copy of the credit agreement from Cap One?

yes sent the £1.00 fee which they returned and Capital one have said they have not been able to obtain the relevant information for my account? do you think this is why they havent contacted me for the remainder of the balance?

Quite likely. Even if Cap One can find the agreement they are usually (for usually ready nearly always) completely unenforceable as they contain none of the prescribed terms.

In all likelyhood the default would just change from being registered in Cabot's name to Cap One's.

 

Cap One don't like writing debts off but you can always try a little gentle persuasion. I would take a look in the default forum for strategies on how to remove the default.
