i am following your thread with interest as im also on the mbna radar,

 

got a few threads going - but wanted to wish you continued luck

 

share with you the other morning i had a call possibly off the same grumpy woman - she asked for my first name and i replied yes (at 8.16 in the morning picked up the phone without thinking!doh) and it was mbna, then confirmed with my full name, and she wanted to speak with me, i said cant taking daughter to college when could she, i told her well all in wiritng pls as ive already informed mbna of this, she replied we are a telephone bank as you well know and will call you again later. To which i replied " well no one will pick up the phone"! bye bye.

 

i am no longer afraid! hahahahh

well you are doing all the right things -

 

from what ive read and understand, by continuing to pay them what you can afford should they take court action you have your records to show the judge

 

also - await the sars and if not responded by day 41 then report directly to information commissioner office,

 

the final letter you have had from them is sufficient now for you to complain to the fos, it will ask you in their form if you have had the final letter and to include a copy in your fos complaint, (i do know this for sure for my Fos complaint im currently doing)

 

im sure the regualar guys will come along but i wanted to at least help in the meantime

 

am hanging about a bit but also doing some more cca and sars requests myself...lol

 

it will be worth it when you do get the sars, if you dont then i figure there is something they would rather you not know about and no problems the sars request legalities do state should be provided within 40 days, if not Report them ,

so i know what you are saying, just put it all in writing and that way its recorded

im going to do a seperate complaint for each card to fos, i think info by citizen on my allianc/leics thread, Yes its there on that thread -

 

just copy each info relevant to that card number and a copy of the Final letter you have previously had for each card ,

 

i m not even going to bother letting the mbna crew im doing fos, they will get told by fos so they can then throw their dummy out if they want,

 

am so cross im thinking of a further complaint by them more or less coaxing my child to take a telephone number for me to call them back,,,,,no way im not and i wish to complain that they have tried to involve a child in acting as my PA....not right, not just and damn immoral¬! rant over

you are just so brilliant at those replies,,,i feel so in awe of you, it looks good to me, again as a point of reflection when you include that in your fos bundle at least its showing that you are trying,

 

me ive got the pc to myself today so reading up further info still

 

had a call today but i didnt really give the horrible woman a chance to get confirmation that it was i, who they wanted just told her to put all in writing and no one is giving out personal info over the telephone, and whilst they may have i dont which one it was so yet again await if any letters arrive at all!

 

i wish you luck, as we continue but if nothing else, i can at least say hiya and keep going gal

hey brill idea there AA99, i was actually thinking the same

 

however, to tell you the truth, ive already attended one of those rooms not for myself yet....lol but for my friend who link was trying to get a court order

 

the judge was very kind and the solicitor from link was not well informed and although we thought we had planned it well, with a letter stating link should not have preference on a charging order over the other creditors it got stayed for a few months because link had not responded to an offer from a previous hearing but the debt been sold to link in the meantime

 

im now in the process of getting a cca for my friend, sorry off topic

 

i just wanted to say though, now ive been its very informal yeah their person and you and if you took someone else in like i was my friends support, and the judge

 

the judge said couldnt help us but if we had taken in court case law that we could argue a point of law would have considered our defence more

 

so what i learnt and yes it was a bit scary as i didnt know what to expect and in a way i wanted to know what happened anyway - in hindsight now that i now know all this knowledge, im no longer afraid, i just now understand that you have to go in with lots of info and get your court bundle in the best possible format to win your case and present legal info correctly and hope the judge takes on board the legal points readily.

 

i m happy to go with anyone i now want to reassure you all, its how you get your case prepared and whether the other side turn up at all,

just read the updated info, i cant believe that mbna are such impersonal muppets, you see its good to take the option on getting signatures for our letters, keep those confirmations safe, it can be part of your complaint to the fos

 

i do hope they have taken your number off finally a bit of peace

 

im still doing my fos, but want to check something out with RMW first and then once gone, i promise i will see if i can help you to fill yours a bit more quickly - am off for the rest of the week this week, and this is now my priorty for me

Just jumping in here and I have contributed to another thread which is here

Personally I have my doubts as to whether the copy of your agreement is an exact copy of the one signed – as has been said before the column (conveniently containing the prescribed terms) on the left hand side looks out of place and it is highly unlikely that the form was designed to look that way when it was printed.

 

When MBNA respond to your s78 request they can interpret the regulations and get a little creative with the copy they send but under a S.A.R they are supposed to send exact copies of documents and they don’t have that same creative license.

 

May I suggest that because you have already had the results of a S.A.R that you question the copy of the agreement they have sent and request that they confirm that the copy of the agreement sent in reply to your S.A.R is in actual fact an exact copy of the original agreement.

 

If you don’t get any where with this then try the same thing with the FOS – don’t accuse MBNA of fraud (at this stage) – just tell the FOS that you believe the copy of the document sent in response to your S.A.R is an altered version of the original. There is a trail that can be followed to verify if the document was indeed printed the way they are inferring and the FOS would be in a position to follow that trail – we aren’t.

 

Remember, without that column of terms the agreement is completely unenforceable and I am about as sure as I can be that the original document wasn’t printed this way – I used to work in an artwork department and I doubt that a graphic designer would throw that together.

sorry to jump in here, im sure lexis wont mind as she is aware of my full situation with mbna too

 

im also in battle with mbna, they wont deal with me any longer so fos it is , but have been mulling over my actual request for them to deal and for me to be given accurate info on the cca copy, i got the same copy via sars and cca, so in theory could i then ask fos to investigate the copy sent in my sars as i believe its an altered version of the original - as we all want to know exactly what mbna actually have this may be the point i want to make with fos, which is what i had tried to do by disputing the legibility of my copy sen to me anyway but they closed me down with a final responce and told me to go to fos

 

could this be the road for fos to fully investigate like you say that we cant?? this would be so useful if they did do that, it would save a lot of stress for us all
