Hello - unlike my user name I am no show gun assassin however I wish I had his confidence when it comes to tackling debt agencies!

 

Yesterday my elderly neighbour came rushing to my door and told me I had to contact some stranger and gave me his number, she seemed really concerned as this person had stressed it was very VERY important... we were baffled as to why he had phoned my neighbour I dont even know my neighbours number!

 

I had never heard of this person before but wary as always phoned the number and asked what company was calling and what for..

 

The person on the other end asked me for my Address - to which I did not reply as I had no clue who he was - he said had some post to send to me... I asked what it was regarding and refused to give him my address, lets just say he got nasty and told me he would repeatedly contact my elderly neighbour until I gave him my address.

 

During the rant he managed to inform me it was for a GE capital account to which I denied as all my accounts where paid off so I was certain he was just trying to get more money from me and hung up.

 

ignorance, stupidity (and the lure of topshop/Riverisland/New Look store card) during my student years got me in a mess so after spending what seems like an eternity paying off my debts I was certain I was debt free and life got loads better!

 

after that horrible phone call I purchased my Credit report online and checked out what is going on against my name.

 

I have 4 GE capital accounts to which all have satisfied or settled as their status.

 

however I now have listed a default against my name for Link Financial for an unsecured loan! (which they say is Riverisland)

 

aktiv capital also have a default against my name even though the same GE capital Debenhams account says Satisfied.

 

Also my Barclaycard Debt was paid off to Cabot last year but is still listed as under default even though I have the paperwork stating otherwise.

 

and last but not least Direct legal (Hillesden securities) had received full payment for the debt last year (after reviewing bank statements they got more than I actually owed - gutted!) status default.

 

 

now this is what I have done so far...

 

 

Contacted Barclaycard - they will contact cabot for confirmation and sort that status out.

 

Contacted GE Capital - They said write to them with all the details as they only have limited details on screen which where no use to me. I explained on my credit report I have 4 GE capital accounts - i wanted to know to what stores they belonged to as they are marked as satisfied/settled.

 

i contacted Hillesden/direct legal and they said they would contact compliance and update my records.

 

Aktiv capital want my proof from GE capital that this account is settled.

 

sooooo

 

the only issue I have is writing to GE capital requesting these details of my past accounts - surely if its marked as satisfied on my records then thats correct? as I have kept no records of this.

 

and I am reluctant to include my current address as they would pass it on to Link financial?? How do I avoid that?

 

20/03/02 over six years has passed for three of my GE capital accounts

26/04/03 is the date of supposed river Island GE capital account started.

 

until I get confirmation from GE capital and a list of the accounts I held from them I will avoid LINK like the plague cos as far as I am aware and my credit report tells me so all my GE capital accounts are satisifed.

 

its all rather confusing. I dont know my rights. I didnt know I had any and if I had found this site alot earlier I probably would have saved me alot of anguish and frustration.

 

whats a CCA?

Sorry for the long story but I am at a loss - even though I have paid all my debts and learnt a valuable lesson I am still being contacted as it appears my record has not been updated accordingly!

 

Any replies and advice would sinerely be appreciated. I want it out of my life!!

Hi Shogun and welcome to CAG.

 

"What's a CCA" - To see if DCA or OC (Original Creditor) has the proper Credit Agreement they need to enforce a debt, we often suggest using a CCA request. See letter N here - http://www.consumeractiongroup.co.uk/forum/debt-bailiffs-advice/20758-creditors-dcas-letter-templates.html

 

If they don't have or supply the document showing the "Prescribed Terms", the debt is not enforceable AND you can set about getting ALL CRA markers associated with the alleged debt removed. You can also repay the debt at a rate which suits you without the addition of further interest.

 

It's up to you about contacting Link - do you still owe them anything.

 

Spend some time reading other threads similar to your own - you'll learn loads.

You should also make a complaint to your local Trading Standards about them contacting your neighbour - that's against Office of Fair Trading Guidelines. You should also inform OFT of this. They don't deal with individual complaints but if you tell them that you are reporting this for information, they make a note of it on the debt collection agency's file. If enought people complain, it can affect the agency next time they apply to have their credit licence renewed. There has been a lot of contacting family members and neighbours recently and this has to be stopped!

I have written to GE capital recorded delivery and asked them to send me my account informations for all accounts they have for me (four in total - which have been satisfied)

 

once I have this information I will pursue Link requesting a CCA - they sent a letter to my address even though I did not give this to them.

 

I am reporting them to the trading standards for contacting my neighbour.

 

I have 4 defaults on my credit report - all have been satisifed, I have written to these debt agencies and requested that they remove these defaults, politley of course.

 

In some cases I have defaults for the same debt twice and a couple of my debts werent updated as soon as the debt was cleared. So my argument to them was I had cleared the debt nearly a year before my credit file was updated, therefore my credit file remained with a unpaid debt for longer than it should.

Its worth a try.

 

If I have already paid the debt off can i still request a CCA from them?

They are pursuing you for a debt you know is satisfied but they are trying to state isn't satisfied. Part of a CCA request is that they must send you statements showing how much is paid an how much is still outstanding. My guess is that they won't be able to get any of this. That puts the "debt" in dispute, after which you can ask them to remove the defualts form your credit records as they haven't produced a copy of the agreement.

Did you use the Letter N (linked in post #3 above) with the £1.00 fee when writing to GE.

I had written to GE requesting these account details straight after my phonecall to one of their advisors. I wasnt informed of a £1 fee.

Its recorded delivery so at least I have that.

I am waiting to hear back from the other agencies first to see what their response is.

 

If I dont hear back by the end of this week I will write another letter using them templates - thanks they are brill. unfortunatley I didnt see them until after i sent my letters. although I am sure I can request information any company holds on me through the data protection act

 

"under the data protection act 1998 I have the right to view any data your company holds on me and its under this same act I do not authorise GE capital to use my current address for updating my satisfied accounts or to be given to third parties without my consent"

Fair enough, but why waste more time for the sake of £1.00. I'd re-apply in the correct manner and get this moving properly.
