I successfully claimed back bank charges from the Halifax last july, i then started with halifax credit card, then test case started and heard nothin until today got a letter from hbos stating my claim has been stayed pursuant to part 15.11 of the civil procedure rules due to inactivity on the case, plus a letter which has been sent to court to request the stay of my claim remain in place on revised terms, plus a letter saying take this letter and enclosures to be placed before a district judge at the earlier convenience, and a letter me vs halifax at wigan county court no date on it just a claim number, can anyone help please

I believe that is wrong . It's only bank charges not cc charges.

Hello Dolphin.

When did you file the CC claim ?

At what stage was it stayed?

Did you object/reply to the notification at that time ?

What are the revised terms ?

 

As you are aware CC charges are not part of the OFT v Banks litigation.

You will need to apply to have the stay lifted.There is info on the site to do this as which includes the arguements to allow it to continue.

 

can you give the HM courts reference numbers of the stuff you have ?

you can find this at the left hand lower portion of the forms.
