Hi all,

 

Joined the site yesterday and, after reading around a little and having some replies to my first post, have started to try a few small, light actions today.

 

3 issues I decided to have a go at:

 

1. Constant & persistently harrassing phone calls from HSBC RE: my overdraft.

2. Interest freeze on Barclaycard.

3. Interest freeze on Egg.

 

Now, decided to play nice to begin with and picked up the phone to make some feeler calls. Spoke to Egg but, due to cutting myself off and not using the service in soooooo long, couldn't remember my security info and didn't manage to get anywhere - will re-visit when security re-set form arrives and is done.

 

In terms of Barclaycard, will have to see what happens. Explained my opinion and essentially asked that they cut me some slack with interest for a couple of months maybe so I can have my minimum payments hit the core balance and get things actually going downward. They actually vaguely entertained the idea and am due to receive a call on Tuesday with some solution packages they'd like to offer. Not holding my breath but will see what they say and begin a postal campaign on the subject once they've probably not offered me anything of use!

 

Now, to the little win! Called HSBC and quoted the following acts in relation to the harrassing phone calls:

 

'As I am sure you are aware Harassment of debtors is a criminal offence in England and Wales under section 40 of the Administration of Justice Act 1970.

Furthermore, continued telephone calls after the receipt of a request not to call may constitute a criminal offence under section 127 of the Communications Act 2003

In addition every individual has a right to be free from harassment under the Protection from Harassment Act 1997.'

 

After much wrestling on the phone and being transferred around they've agreed to pay me £30 compensation for call costs (I was on hold earlier for ages!) and distress and have logged a formal complaint.

 

Now, I know £30 doesn't sound much but I'm still mildly pleased I've been given something back! 30 quid is nearly a tank of petrol after all!

Cheers guys.

 

Like I said - only a little win & £30 isn't really much but just goes to show how much information is power - by quoting some small peices of legislation I garnered off this site I've got them to back off and made a few pennies back.

 

I might claim the distress has been so much that they now need to compensate me by paying for a holiday! ;) *smirk*
