Hi there postggj,

 

Netcars are the broker they are on the internet (Used Cars, Used Car Search, Buy & Sell Car, Car Loans, Car Insurance - Netcars.co.uk) they are called Netcars 2000, they find you the finance for the car you want.

 

As far as I am concerned Welcome arranged the loan as Netcars passed all of my details onto them. Welcome are the ones which called me and asked if I would be ok to afford the payments, Welcome are the ones I asked if they could reduce the payments in any way and they reduced the payment little by taking off mechanical breakdown insurance but they never offered to take off the PPI which is what makes me think they are liable not Netcars.

 

Is there a letter template for the letter before action? I have already done a S.A.R is this the same kind of thing?

Hi There,

 

Welcome have now replied to the above letter and they advised me that all information they have on me was sent to me in the subject access request, they have said if the information I requestes is not in the subject access request they do not have it.

 

What should I be looking for in the subject access request?

 

What would you reccomend for my next step?

Hello Waz,

 

Most certainly follow postggj and submit non compliance letter. :)It may be worth sending a complaint to the Information Commissioner Office (ICO) stating Welcome have not complied with your SAR which is a legal requirement under Law namely the Data Protection Act 1998.:)

 

The more complaints the better and it will let them know you will take appropriate action on their failure to abide by the Law of the land.

Bank charge successes:

Halifax - Full settlement incl interest.

HSBC - Settlement, goodwill no admission of liability about 75% of claim.

RBS - Settlement, goodwill no admission of liability about 70% of claim.

2 ongoing claims for bank charges with HSBC with more to come. (Supreme Court ruling could have upset these claims) They did :mad:

PPI Successes

PPI 4 settlements on 9 loans. FOS involvement on 7 added on the 8 % Statutory interest another 30% to both.

2 claims settled in full with LV without FOS involvement.

2 claims settled in full with HSBC without FOS involvement

 

PPI Claims ongoing with:

Cap one Now with the FOS

Barclays. Paid up today 24/04/10 cheque received for over £4,500 and in the bank.

LTSB still have to decide on this as their SAR production was abysmal. Papers data mixed up documents missing etc

 

1 Complaint not upheld by FOS they said it was ICO issue. Complaint upheld by ICO. See this..

Keep at them. Do not give way and do not accept all they tell you, they will delay and stall for as long as they can to prevent repaying you your mis-sold PPI.

I took out a loan with welcome finance in 2002. I was told I had to take out PPI with the loan as insurance or they couldn't give me a loan.

 

I few years later I took out another loan with Welcome FS and which paid of the first loan in full (i'm pretty sure but have no paper work that they didn't take of any PPi or interest on that loan for early repayment). A few years ago i got into financial difficulties and agreed to pay welcome 35 a month which i'm still paying. Again my new loan had PPI added on.

 

Can i claim this back/ How do i go about doing this when i do not have either of the original contracts?

 

any help would be greatly received.

OMG having read this post i am in no doubt i will have to pay maybe £15000 in charges and interest on a £7000 loan , i work 12 hours a night 5 nights a week for minimum wage , can't afford a spare pair of shoes and don't have time to play Sherlock and become a financial genius !

 

Why aren't there simple laws that can be quoted by the consumer to prevent these criminals from sidestepping the issue ?
