i have just learnt of this website, to which i must say well done to the mods and admin, but reading the faq's i have a question.

 

i have incurred several hundred, maybe thousands of pounds worth of penalties over the last six years but before i go ahead and start a claim against the abbey i am worried that because i have an overdraft of £1850 and i pretty much am close to the max of it every week that when i start the claim they may close the account and demand the overdraft money back, but obviously i could'nt afford that otherwise i would not have the overdraft in the first place.

 

what are my options and would that be their first course of action ?

It might not be their first course of action but it is certainly on the cards.

You might be better of getting a parachute account elsewhere.

If Abbey shut you down it won't be so serious and you can try and set the charges off against the OD.

Of course they also have th eoption to default you as well - and the stories show that by and large the banks use this power abusively.

I'm in similar position, open another account b4 you start, let them demand all they like, they cant take money off you that you dont have. What's the worse they can do? if in doubt contact the CCS, they will tell you you're rights with reference to debt.

being that my credit rating is not great i am worried i would not get the sort of account i got at the moment ie. debit card, chequebook and overdraft etc.

 

i am worried that i may leave myself in a far more worse position that i am now but on the other hand the thought of getting MY money back is all the more satisfying

This I'm afraid is a judgement you must make. This is not a get rich quick scheme. It is serious and you must be prepared to defend your position in court. Think carefully. Read the FAQs and around the fora and make up your own mind.

The law, in its majestic equality, forbids the rich as well as the poor to sleep under bridges, to beg in the streets, and to steal bread.
