      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Bloody hell!!!! :shock: Mum has just phoned me, we only sent the letters on the 8th and she has had one back from Citi already.

 

Not got all the details, they have sent some forms for the disclosure and asked for a tenner which is fine. This bandwagons rolling!!

Have been at Mums today, have helped her to fill in the form to the Data Manager at Citi and copied the 2 proofs of ID and sent the 10 cheque. Its all ready to go Recorded Delivery on Monday.

 

Mum took so many letters last week for Recorded Delivery last week that the Post Office gave her loads of forms so that she can complete them all before taking them down to post - hee hee!!! We are well prepared!

By the skin of their teeth and only because we were kind to allow them so extra time because of Easter, the statements have arrived this morning (loads of them!!). my little sister is going to pick them up tonight and bring them to mine tomorrow. The final ball is now rolling!

Well this is the one that I am most determined to get back for my Mum. My Sister picked up the docs from Mums last night and rang me absolutely gutted and upset, it seems that the whole thing with Citi stems from something that was their fault in the first place. It seesm that Mum made a payment which for whatever reason they accepted and then a couple of days later returned to Mum, charged her a late payment fee for it and then the charge tooke her over the limit and therefore on the downward spiral.

 

I wont know the true facts until I meet my Sister after work tonight, but my Sister did tell me that she had briefly totted up the charges that she could find and that it came to almost £1600 - God I feel sick to the stomach about it. When me and my Sister discovered (by accident) the extent of my Mum's financial difficulties in December 2004, the balance on Citi was approx £2300, which we now know is made up almost entirely of charges. Lord only knows what state she would be in now if I wasn't sorting through some paperwork in order to finalise my own mortgage. It doesnt even bear thinking about.

 

I am absolutely fuming, I though I was mad before but this has made my blood boil! I am going to channel my anger in the correct way however, and make sure that a letter is fired off to Citi at the earliest opportunity - probably tomorrow once I have got the info from my Sister.

citicards are a complete nightmare! I have an outstanding balance on my credit card with them of £160.00 and £125.00 of that amount is THEIR charges for late payment fees! :shock:

 

Can you believe these jokers - the stupid thing is that I only have an available credit limit of £300.00 and I've never even gotten close to owing that amount on my card.

 

I've sent off an LBA, and they've got another 8 days left, so the clock is ticking, and omigod, am I really gonna hit them with it if they don't get back to me,

 

I'm so sorry about your Mum, its typical that these people ALWAYS target the most vulnerable and just keeping adding, adding and adding those charges, it makes me sick, it really does.

 

Still, keep going, and keep me posted on how you go. You are in the right, its your money/your Mum's money, stick to the timetable that you set, keep up the pressure on them and truly hit them with it. :D

Hi Rachel 2609, keep the pressure on Citi Cards. I have been having the same difficulties as your Mum. I probably have been charged more over the last 6 years. I have not used my card since 2001 and am now just inside the credit limit.

Second letter back from Mark Clibbens, the guy keeps referring to my Mum's account in the present (which is now closed!) - fool! Basically says again, we weren't party to the OFT investigations but will wait until the 31st May before contacting all our customers, until then our T & Cs remain in force.

 

Just waiting for Mum to get paid next week and will be filing the Moneyclaim that is already prepared. If they want a fight they can have one!!!

 

I think they think that they are untouchable, is the Office of the Chief Exec like the Office of the Deputy Prime Minister (i.e. useless)? I am starting to feel that it is ;o)

Yeh, I got that same letter last week and so I fired off another letter saying that they have 10 days to reconsider their position (!!) and if they do not refund the full amount, I will issue court proceedings without further notice.

 

oh but they did refund me £25.00 as a 'goodwill gesture' out of the £125 that they owe me !

Just submitted Moneyclaim, for £1600.00 charges, £361.46 interest and £120.00 court fee. Will email details for Litigation Section.

 

My Mum with my help now has 4 claims in the court system, they should start soming to come sort of conclusion (excluding this one!) over the next 2 weeks or so, fingers crossed

Our first success!!!!

 

I got home last night to find a letter addressed to me enclosing a cheque made payable to my Mum for £2081.46 in full and final settlement :o)

 

Mum was made up, she had seen the Trevor McDonald programme which renewed her belief in what we were trying to achieve was correct.

 

I am so thrilled for her, just waiting for LTSB and YB to cough up now, shouldnt be long I wouldnt have thought - fingers crossed.

 

Will get Mum to make a donation to the site as soon as possible. She said that she wanted to take me and my Sis and our other halves out for somethign to eat but I would rather ther donate 5% here instead.

 

Best of luck to those still fighting the good fight with Citi!

That's great news Rachel, congratulations.:p:);) I am about to do the same. Citi cards have sent me the same fob off letter twice, in response to my intial claim and the LBA letter. I'm just waiting for the 14 day expiry on 15th June and I will then issue the claim against them.

I have a question that you may be able to answer.

According to the courts leaflets, the court allocation questionaire requires payment of a £100 fee. Did you have to pay this fee as well as the £120?

I have a question that you may be able to answer.

We didnt get as far as Court Allocation Questionnaire stage with this one, it had merely been acknowledged in the Moneyclaim system. I think if it had got that far we would have had to pay the further £100 as the claim was for over £1500.

 

Citi have been by far the easiest one to deal with, couple of letters both ways, filed Moneyclaim on 15th May, cheque and letter dated 6 June - I think it has taken approximately 6 weeks in total.

 

Incidentally I have just logged on Moneyclaim out of interest and it says the Citi have filed a defence! Going to get the cheque paid in sharpish!
