hey all,

My bank has refused to remove the defaults on my account after several requests. The defaults were caused due to the excessive amount of charges on the account (credit card account). The bank paid the charges back to me a while ago after I wrote them a letter. I have now decided to take them to court over the default but am having trouble making an online application on moneyclaimonline. I phoned up the courts and was told that i might need to speak to a solicitor for advice on how to pursue a default only claim.Has anyone filed a claim purely to do with default? any suggestions would be most appreciated.

Thank you,

Hi FC and sorry your post remained unanswered so long.

Have a read here - http://www.consumeractiongroup.co.uk/forum/legalities/24013-defaults-proposed-method-removal.html

You may find it better to file any claim at your local county court - it's less likely to get held up with all the bank chgs cases that are stayed.
