Apart from his bad manners, Milthorpe's execrable use of English indicates that his position is considerably beyond his abilities.

So, now got a court date of 5 Oct. Have received from Phoenix copies of my statements and a not particularly legible credit agreement which does not have a signature for the bank on it - oh yes and print outs of this thread

No they sent a local solicitor who had to admit Largo had lost ( allegedly ) all documentation when an employee left over 12 months ago and did not leave his password.

No didn't get my costs,

i got slated as well as i was referring to extracts of case history but had not printed out the whole cases for her to refer to.

She also wasn't happy that i was saying the CCA was incorrectly executed as it hadn't been signed by HSBC.

Fantastic news - well done. Another CAG success against a slimeball company that can't be bothered to do things properly or legally.

 

Also, no documentation = no default. So they took you to court knowing they had no documents? Unbelievable... deserve everything they get.

Not sure but their figures don't add up, I sent £1 for the CCA on 2 accounts and they have taken that as a credit. the opening balance is allegedly £639.6, they have writtain off £540 and then re-debited it added 2 sets of fees and come up with a total of £133 and a closing balance of £854.64 even the opening balance plus £133 doesn't add up to £854.64 or is it my maths??????

Surely they wouldnt be foolish enough to go back to court or try to get you to pay them

 

Who knows .. some of these companies do appear to be on suicide missions :rolleyes:

 

Pblackie.. in respect of that £1.00 for the CCA request. A lot of creditors apply it to the aco****. You can prove it was for a CCA request and not intended to be credited to the account.. so wouldnt worry too much about that.

I think (1) it's s bog standard print out of the (alleged) account and (2) they clearly expected to win as they'd added all the court fees to your (alleged) account!

 

It's meaningless given the judgment. Have you been getting these statements every month?

 

As they have absolutely no agreement, they have no right to process your data now, nor to post data with CRAs.
