FIRST

 

NEVER EVER SPEAK TO THESE PEOPLE ON THE PHONE. THEY WILL TRY TO GET YOU TO AGREE TO ANYTHING.

 

The first thing you should do is establish whether these muppets have proof of the debt and proof of their right to collect on it. This is simply done by sending them a CCA request along with a £1 postal order. Once they prove the debt exists and they have a legal right to collect then you can agree a payment plan that suits YOU.

DO NOT CALL THEM!

 

Write to the address on the letter they've sent requesting your CCA (consumer credit agreement) and statement of account. This will establish thier right to collect any alledged debt.

 

Use this template letter:

With reference to the above agreement, we would be grateful if you would send us a copy of this credit agreement.

 

We understand that under the Consumer Credit Act 1974 (Sections 77−79), we are entitled to receive a copy of our credit agreement and statement of account on request. We enclose a payment of £1.00 which represents the fee payable under the Consumer Credit Act. This payment is NOT to be paid used for any other purpose.

 

We understand a copy of our credit agreement should be supplied within 12 working days.

 

We understand that under the Consumer Credit Act creditors are unable to enforce an agreement if they fail to comply with a request for a copy of the agreement under these sections of the Act.

 

We look forward to hearing from you.

many thanks matei think that it is just the in house debt collecters but do not want them at my door so wanted it sorted a.s.a.p

They have NO legal right to appear at your door. If they do threaten a doorstep call there is a vey simple letter to send to stop them in their tracks

As the other guys have said, you should NEVER just pay up without establishing that they are collecting lawfully.

go through the CCA procedure first, then, IF the debt is enforceable, set up a payment you can afford - but do it all in WRITING, NEVER on the phone.

 

You'd be surprised how often these debts are unenforceable - just spend a bit of time reading a few other threads....
