  1. Hi. Can any one offer some comments please. I suffer from a disability and the solicitors in question new about this how ever they still failed to make reasonable adjustments as indicated in my medical reports. In short the solicitors have kept £10,700 from a settlement of around £15,000 and neither the solicitors or my legal insurers will tell me why? I engaged a firm of solicitors last year ( Doyle Clayton) to assist in a dispute for disability discrimination. I had originally instructed a different law firm and the bulk of my case up to completion of the ET1 and disclosure to the other party had already been completed. I changed solicitors because I needed a local solicitor who I could talk to face to face because of my disability. The solicitors were fully aware I have difficulty reading and writing. In the eventuality I never met the solicitors face to face because the company reached a settlement with me shortly after engaging the solicitor. There were about four letters of offer of settlement before the company and I agreed to the amount of settlement. The solicitors drafted the compromise agreement. In total I estimate that the solicitors probably did less then 10 hours work as the whole case was already set out and I had already had a pre tribunal hearing with the previous solicitors. During the short time I engaged the solicitors they never sent me any estimate of costs, agreed to work within the terms of my legal insurers and never mentioned to me until after the event that I would be liable for any money or that they would recover that money from my settlement. I have now found out that they negotiated with my legal insurers to change the standard terms of engagement so that I would be liable for any charges my insurers found unreasonable. My insurers say they have had the companies final bill independently assessed and will not pay any amount the assers feel is unreasonable. Till today I have not had any details from the solicitors of what their final bill was, how it was made up or any details from my legal insurers on what they are willing to pay or how the solicitor charges were assessed. The solicitors have not responded to my complaint through their complaints procedure and have not provided me with any of the information I have requested. Thanks
  2. I hope someone can offer me some advice. I've read the sticky but I really don't have a clue about insurance. Ten months ago I was on a main road in a low gear, close to the centre line and indicating to turn right. I began to turn when the other side of the road was clear but was then hit on my drivers side wing/door by a motorcyclist overtaking. He was on the wrong side of the road. Police attended and said it was clear that it wasn't my fault. There was an independent witness stating that they saw me indicating. I reported it to my insurance company and got a quote for £1700 for repair. Car is only worth maybe £1300. Huge excess of £500. I had fully comp. a month later i needed new policy and ended up paying double what I would usually pay as I lost 6 years of no claims bonus. In the meantime, the other driver has not accepted liability, and states that the accident is my fault and states that I wasn't looking. it's my understanding that they are also claiming injury. I call insurance company every month but even though they have police report nothing is happening. Wondering, is it usual for a claim to take this long? And what can I expect? insurer says that if they ever do accept liability that they would still only give me the £1700 less excess and are talking about writing the car off but that wouldn't leave me with enough to buy another. They said I could claim full amount direct from other driver but what about my not insured loss such as the big increase in premium. I thought I could go to current insurer when they accepted liability and get no claims bonus added and a part refund but it's not that long til this policy expires and I will likely change insurer again. Excuse my ignorance in this. Never had to claim on any insurance before and just viewed it as a legality and not something I would use
  3. CEL rode into Whitby Town in midsummer 2012 and caused uproar with Co-op customers and visitors, especially since Spring 2013 with their "Ten Minute Rule". I've been waging war on them since, and started a Facebook protest page. October 2013 they were sacked! Rumour has it they've lost dozens of other Co-op sites too!! Having had both of my PCNs cancelled I left the Protest Page running, even though a second one started. Where we are now up to is fighting their "ten minute rule" - a moneymaker if ever I saw one, and we now have a set of images and an independent witness letter from myself initially - but we will soon have several. I'd like to hear from anyone either still being chased for payment under this rule, or else who has paid it under pressure. Even if you've lost an appeal to POPLA, all is not lost - their evidence seems to trump yours ..... so far. but I'm confident that is about to change. At present we have a chance with the small numbers we have recruited. They reputedly check these forums so I don't want to put more details here, but if you care to PM me I'll let you know how to take it forward. Remember, no addresses, vehicle or PCN numbers, NOTHING WHICH ENABLES YOU TO BE POSITIVELY IDENTIFIED! I'll post any progress here.
  4. I have been following some similar threads on this site but wondered if anyone has a definitive answer for me. I have been living in the same flat for over 10 years. When I brought the flat I rang the usual suspects in advance, in those days it was really just Scottish Power and British Gas, and was able to change over my electricity supplier but neither of these companies had any record of my new address as one they supplied with gas. In the process of moving I checked with the previous owner who confirmed that he had never received a gas bill. He left me a promisory note saying he would pay for the gas for the period he had lived there with the appropriate readings. I initially had every intention of sorting this out but one way or another have just left it and have received no bills whatsoever for Gas. One of the gas infrastructure companies even came into the property and disconnected and then reconnected the supply as part of upgrading the pipes leading to the property but at no time has anyone from a supply company communicated with me, taken a reading or sent me a bill. I am keen now to try to sort this out if at all possible and from the threads I have read I suspect that my meter is 'shipperless' but what I am keen to know is that if I successfully source an MPRN number and register with a supplier what my position might be in terms of back-billing. I have no record of my attempts to contact the obvious suppliers all those years ago as this was done by telephone and while I did not pursue the matter once the previous owner had told me of the situation, I did at least make initial contact with suppliers prior to moving in. They by contrast have never sent me a single bill. I am very conscious that I have a duty to pay for utilities and indeed have never defaulted on any other utility bill sent to me but the point here is that I at least made a little bit of effort to have bills sent to me for gas but to no avail. No gas supplier has ever sent me a bill for this property. All advice very gratefully received.
