I've been in a difficult marriage for 26 years. I want to sell / trade in my car for a newer model but my husband is refusing to let me saying I'm not allowed because its his car. I am the registered keeper & I have always paid for tax, insurance and any repairs & upkeep. Would it be against the law for me to trade in the car without his consent? When we bought the car, he paid for it (& he says he can prove this), I sold my old car and wanted to give him all the money I got for it to pay for the new one. He refused to accept it, telling me to put the money in my bank account. This was 2 years ago. I feel trapped. He says if I want a new car of my own then I have to go and buy one but I should just give him the one I presently have because he says its all his. I'm concerned that he's going to be awkward and sell my car even though I'm the registered keeper. Can he do this? Sorry - I know there's a few questions here but I fell very intimidated. -
My husband left a credit card debt of £5000 when he passed. It was on a tesco credit card. Tesco agents are now chasing me for the debt which in theory should come out of his estate. This comprised one commercial property that I can't sell cause I am dependent on the income. Is anyone familiar with their agents and how vigorously they will pursue the debt? Or how likely they will be to write it off? -
My wife died just over a year ago. The house we live in was bought in her name only, and the mortgage is in her name only. I obtained Probate and I am the beneficiary of all assets and debts. Last week I phoned up the lender - assuming it would simply be a case of switching the deeds and mortgage to my name and continuing payments. I was concerned when the person said that in those situations they usually required the mortgage to be repaid - which i couldn't do without selling the house - and I would have no-where to live. Despite my late wife owning the house/mortgage, ALL monthly payments have been from MY account and have never been missed. Anyone have any advice on this? Thanks

My daughter is throwing her husband out as he is an alcoholic and wants to apply for a legal separation. Is a judicial separation good enough to show that her belongings are not the goods chattels of her hubby? Very likely that the bailiffs will call at some time in the future to collect for unpaid motoring fines. If the answer is yes, when will the protection kick in? the date of the separation or will a bailiff be able to levy items that were jointly owned at the time of the court order allowing the execution of a warrant-burden of proof lies where? any help appreciated as I dont want all of her stuff in my loft for the next 2 years. -
My father has died and the joint property needs to pass in title to my mother. There is already a good chain of title with two conveyances dating back to early 1960s and a good abstract of title so it would seem that all that is needed is a transfer of title from him to her. Is there a standard form of deed that can be executed under seal to do this? Are the parties the executors of.... as transferor and the wife as transferee. It sounds easy to do without a solicitor but where can you get the deed? Would there be any advantage in registering this as registered land at the same time?
