  1. I’ve got a PCN by TfL for contravention: 46 : Stopped where prohibited (on a red route or clearway) recorded by CCTV at 4:10pm. It was a loading bay operational between 10am – 4pm. I think the loading bay markings are wrong because such bays should be always one rectangle outlined by dotted lines. In my case, the loading bay consists of two rectangles – one long one with another small one – without any separating line in between. I parked in the small one. There was only one parking restriction sign near the longer box. I’d be grateful if somebody can tell me if the loading bay markings are right or wrong. Many thanks
  2. All, I received a PCN from TFL for stopping on a red route (46:Stopped where prohibited), but the PCN did not contain any photographic evidence to support this. I replied that "In your Penalty charge notice you fail to show any evidence for the alleged contravention - photographic or otherwise. This appears to be a procedural error on your part. We would request that you give us access to this evidence, and provide us with an explanation as to why they were not included on the original PCN." My request for information was met with a 'rejection of appeal' and 2 inconclusive photos were sent back in their reply along with a passage reading "Please be advised that it is not a legal requirement to send photos along with the PCN. However, I will supply you with the photographic evidence that you require, at the bottom of this letter." However, on TFL's own website, under their Terms & Conditions it clearly states "If you've received a Penalty Charge Notice, there will be two images on the Notice itself." I believe that I probably did stop on the red route, albeit for 30 seconds, but was wondering if I have grounds to appeal based on their incorrect issuing of the original PCN (i.e. without photos). Any advice would be much appreciated. I only have 2 more days (18th May 2011) to either pay or appeal. Regards
  3. I recently received a parking ticket for parking in a red route bay outside my house in south east London. However, I am convinced that when I parked my car there it was not inside the red route bay. In other words, I believe that the bay has been extended around my car while it was parked there. Looking on the road, there is a clearly visible line where the bay used to go up to. I'm very conscious of this are as it's right outside my house. I challenged the ticket on this basis (firstly, that the car was not in a red route bay when I parked it there; secondly, that as a resident of the street and in the property directly opposite the bay, I was not informed of the change to the bay). However, Transport for London have rejected my challenge on the grounds that there have been no recent changes to the bay area. I have photos of the clearly visible old boundary, the spray paint marking the new size for the bay, and also an image from Google Streetview, taken in 2008, showing the previous, smaller size of the bay. However, I don't have any proof that the bay size was recently changed - in other words while my car was parked there. So it's my word against there's until they can prove when the extension took place. My questions are: 1) Does anybody know how I can find out the date when this extension to the bay was made? I know the red route bay was originally installed in December 2007, and that it was still in the smaller size in Spring 2008 according to Google Streetview. Should I contact my local council (Lewisham) or should I contact Transport for London as they manage the red routes? Are either of them likely to give me the date? 2) Does anyone think I've got a chance of winning my appeal??
  4. Hello, I recently got sent a PCN for parking on a red route parking spot outside of the time (18:32). The offence was recorded by a camera operator. My problem is that the clock in my car was set incorrectly (after 7pm) and there was already two vehicles parked up. When I saw this I didn't even think about being in the wrong (after all - time was okay and people were also parking in the allocated spaces). Frustratingly I moved from the wide loading spot where i had initially parked to the actual car spot thinking that I would get in trouble for being in the space for delivery vans. Doing this put me right in view of the camera operator! Would I have any grounds to argue my case? I'm considering doing an FOI to find out if the other two vehicles (clearly parked in the images) were also fined. I was parked for approx 5 minutes in which time both vehicles were there before and after i left. If they have not also been fined would I be right to argue the whoe 'one rule for one and one for another' case? Technically I did commit a traffice offence but when I went back I did also notice that one of the signs is quite clearly obscured by a large tree and didnt help that a van was also up against it. Just want to see what opinions are on whether I have any chance of appeal. Many thanks!
