  1. I've recently received a letter from Fredricksons chasing a debt and advising me they may take me to court. I have copies of the Prove It and CCA letters but I'm unsure which one I should send. The debt does exist and is from before my divorce 5 years ago but I haven't acknowledged it or entered into any correspondence with them about it. Additionally, last year I received a letter from Bryan Carter solicitors about another debt and I sent a CCA request to them with the £1 postal order, they acknowledged receipt and said they passed it on to the creditor but I've heard nothing since and certainly didn't receive any CCA - can I now assume that debt is now unenforceable or do I need to do anything more? Any advice is greatly appreciated.
  2. Hi All, This is a long running dispute with Lowell, first prove it letter I sent them was Dec '09 requesting a CCA, Statement of accounts and Notice of Assignment. I only received a CCA 6 months later, which isn't proof at all as I was able to request the same document from CapOne providing nothing more than an account number and £1. There has been no proof provided as to the amount of monies owned or that they own this alleged debt. I have had various recorded delivery letters back and forth between Lowell and Bryan Carter (previously "appointed" solicitor) in which I clearly stated the account was in dispute. Now I've recieved another CCJ threat from Buchanan Clark + Wells acting on behalf of Lowell, I'm just wondering what action to take? I have half a mind to fight this as they have dragged their feet for well over a year since my prove it letter I don't think they have anything beyond a signed CCA, I have bank records from the time showing I had been paying the card off regularly each month. However the other option is keep my head down as the debt is 6 months from being statuate barred. Any advice is welcome. Also if I do call their bluff do I have the right to request and CCJ/court proceedings get done in my local court? Thanks all
  3. The Situation Clarity writing letters claiming I owe them money. I sent them a prove it letter. They are asking me now for my personal details even though they have pursued me for this debt on behalf of their client .. Aktiv Captial. I am reluctant to give out my details cos surely they will already have them if they are writing me letters saying I owe them? After going through my credit report I see the debt is a Debenhams account I settled in 2005 account numbers match - Just 15 days before it was settled - Aktiv Kapital opened their claim on the debt. .... (on the same day it was opened it was also listed as defaulting and for double the amount I owed & previously settled) I have sent prove it letter to Clarity I received this Now my question is whats my next step? Do I send Clarity my date of birth & address history? or a copy of my credit report saying my account is settled or both?? Thank you for reading this & any advice would be muchly appreciated I'm sick of debt agencies fishing around on my credit report.
