Morning all, My mother received a letter around a week ago from the HMRC advising that under MARD they are chasing her for an overdue Income Tax bill from when she lived in Portugal around 5 years ago. Firstly, they had a business over there which turned a negative balance during its short few months trading, my mother was not employed as a secretary and did not draw a salary during trading, so quite confused where they reached this figure. Have already sent a letter contesting the validity and sums and requesting full documentary evidence of liability and full breakdown of the alleged debt, but yet to hear anything back. Does anybody have any experience with the Mutual Assistance in Recovery of Debt department within the HMRC that could offer any assistance, as this is a grey area for me unfortunately. We have a mortgage on a second home in Portugal. We live in Canada and are no longer able to pay the mortgage for it especially as they want the whole amount repaid before we turn 75 in 10 years time. We have tried to sell it but can't, even at a low price. The mortgage is worth just over half of what we paid for the property so we have paid nearly 50% of the cost of the place. We think the best thing is to let it be repossessed Is the Portuguese system like the Spanish one where they can only pursue you up to 50% of the value of the original valuation? If so are they likely to pursue us in Canada for the ten to fifteen thousand shortfall? Any help would be really appreciated.
