Parking tickets are a pain in the ...and I have recently received another, caught again anpr with a well known operator who has just received a recent Judgement.... My court case is beginning of next year,OR not. I will put full post up in a day or two...I just need to clarify 1 thing with these people first. ( the people have a job to do )....Its the Co.that sucks... Anyway I look forward to sharing my experience and advice/comments with you all:amen:
  2. I notice from the reaction I received when I mentioned the basic procedure for processing criminal actions, that there seems to be confusion as to the procedures and terms involved. It is not really surprising as most of the matters discussed here are of a civil nature. But for those not familiar with the fundamentals, here is my take on it. Firstly all criminal proceedings must start in the magistrate’s court. I have read people saying that you can chose where to start an action on say a private prosecution, you cannot. There are two kinds of offences which can be considered at the MC, these are defined by their seriousness, and the maximum fine or term of commitment that can be imposed on conviction. These are: A “summary offence” and “indictable offence” A “summary offence” is for less serious criminal offences. The sentencing is limited to a far lower level than in more serious(indicatable) cases which are passed up to the Crown court An “indictable offence” can only be heard at the crown court, this is after the defendant has attended the magistrate’s court. The magistrates will remand or bail them to appear at the Crown Court after consideration of the case in question. These more serious offences such as theft rape or murder are generally heard by a jury. In addition to these there are also “each way” offences; this is where the action could fall into either of the two categories. On application to the magistrate, they will make the decision as to which court is most appropriate for the offence, and assign it to the relevant one. Most legislation which presents the possibility of criminal charges will also state the kind of action which may be taken. For instance in section 68 of the Tribunals Act schedule 12, the action which may be taken for obstructing an EA in the course of his duty, is prescribed as “on summary conviction”. 68(1)A person is guilty of an offence if he intentionally obstructs a person lawfully acting as an enforcement agent. (2)A person is guilty of an offence if he intentionally interferes with controlled goods without lawful excuse. (3)A person guilty of an offence under this paragraph is liable on summary conviction to— (a)imprisonment for a term not exceeding 51 weeks, or (b)a fine not exceeding level 4 on the standard scale, or ©both. Similarly the theft act of instance will say by indictment and the fraud act may say either way.
  3. Hello everyone. I'm dave, about to hit 40 with 3 kiddywinks and a band of silver around my ring! I was formerly a very active member of Steven Hone's penalty charges forum (Disco Dave) and had quite a bit of success thanks to the guys over there. Sadly that site has become very quiet, and looking for advice on a disputed debt hat is now heading to court I have stumbled upon you guys.
  4. Some new posters may have some questions relating to Universal Credit (UC) here is a basic guide including many links to any questions you may have see here https://www.moneyadviceservice.org.uk/en/categories/universal-credit Within this link you can clink on further links and see what is what with UC. There are now many areas of the UK that have already transferred to UC and this is for those that have not. This guide will let you see what you will need to do now and also allow you to see what you can learn before this happens to you. If you have any questions please post them up so others may be able to help you come to terms with the changes before it affects you in the very near future. What you will need to do now is to put some money if possible away before these changes happen as your first payment which will be monthly will happen FIVE weeks after you are on UC. In other words the last payment you receive will need to last you till you get your first months benefits. This will include your housing costs I.E your rent. In this link you will see what areas are going to go through the changes now, then you will see when your area maybe added in the very near future. see below http://www.consumeractiongroup.co.uk/forum/showthread.php?441364-Universal-Credit-national-expansion-–-Tranche-two If you have any questions and require some help please feel free to ask now before the changes make things difficult for you......

  6. Hi everyone, I am a big fan of this website as it helped me to avoid a lot of trouble. I was caught using a friends freedom pass and summon to court, after reading countless posts I decided to plead not guilty. After months of battling. TFL then sent me a letter saying they dropped the prosecution. Now with all the information and help I gathered, I would like to offer my help in defeating TFL. Thanks again for the posts you guys provided, without them I would have been in trouble.
