Hi I wonder if anyone can advise, on the way forward, back in 2008 We purchased a sofa and managed to get some discount off the sofa and put it on finance, part of this was the purchase of the guardsman policy for 5 years, we were told that we had to take this as part of the finance deal, even when asking could it be removed!! In any case we were told that it would cover Accidental damage for any stains rips burns etc.. "we could even sit on some scissors and puncher the leather, this will be covered" their words not mine, they were almost reading out of the leaflet we got as part of the sale, which specifically says. "No Pains with stains For a Small additional charge you can increase your peace of mind with our superb Guardsman warranty. Available on leather and fabric upholstery, Guardsman covers you in event of staining to furniture or accidental rips, tears and burns for five years from purchase, ensuring the best protection for your new furniture (please refer to policy for full details). Guardsman protection will help to prevent permanent staining of a suite, it cannot prevent general soiling." My 2 year old Daughter unfortunately spilled nail varnish that she got hold of on the arm of the sofa and this has effectively stained the sofa, I called guardsman and they advised that it was not covered and under the policy it does say point 12 Any instance of staining. I called SCS CS who advised me to call the branch, I spoke to the sales manager who asked to see the leaflet, I faxed this off and he called back to say that there was nothing he can do due to the fact the leaflet states (please refer to policy for full details) which we received a couple of months after the delivery of the sofa. I have spoken to the Citizens Advice consumer helpline who have recorded the case and will pass on to trading standards, but that I should send a Breach of contract letter to SCS Customer services recorded. My concern here is that im not entirely sure what to put in the letter and wondered if anyone else has had this issue, I know there is a lot of people in a very similar situation and that they feel misled regarding this. Any help would be much appreciated
  2. sorry if ive posted this in the wrong forum I bought a sofa from scs in 2010 wasnt delivered till jan 2011 ( the sofa was garanteed xmas delivery and never turned up), i took the guardsman policy out which was £200, scs sold this to me as a "what ever happens policy" so as you can suspect i had piece of mind thinking what ever happens to my sofa can be fixed under this policy. the sofa is fabric and leather Well lately the leather on the arm has come off the wood of the arm is directly touching the leather and is damaging the sofa, so i called guardsman and they sent and inspector out and he said in his opninon theres not enough padding in the sofa which is causung the damage to the leather and he would consider it either needs repaired or he would consider it a manufactoring fault. he told me to wait for the report to come through from guardsman to see what action they were going to take. well to me my surprise ive getting their report through theyve stated "wear and tear" (apparently not covered under policy)and theyre not gonna take any action. Ive emailed them requesting a true report of what the inspector said to me, and am awaiting a reply. What action should i be taking next? obviously its an expensive sofa so dont wanna be left with a faulty ruined sofa
  3. Good Afternoon We purchased a 3 piece leather suite from SCS (Clydebank) store in August 2008, we took delivery in December 2008. Total cost excluding insurance £1795. We've had no real reason to complain until now 4 years later we've discovered an issue with one of the cushions, the leather appears to be stretching/peeling away and has now resulted in a 2cm hole. We are dog owners and the dogs do get to sit on them, however are very well behaved and never damaged the leather in anyway, we thought perhaps one of them had however been rubbing this particular cushion. As we had the Guardsman insurance which cost a whopping £427 for 5 years cover, we decided to claim pet damage. The upholsterer visited and claimed the leather on this particular cushion to have been overly processed during manufacturer and that this would not be covered. He did note that there was 2 minor scratches that could be covered, one on each of the 2 sofas and he'd submit the report on this basis. Guardsman have accepted the claim and even agreed to cover the cost of re-upholstering the 5 cushions to ensure a colour match - great I thought ! 4 months since we've received word that the leather can't be souced from the manufacturer, so a cash settlement will be made but we've to wait 7 weeks for this to be reviewed and confirmed in writing. The written confirmation is now in hand for a whopping £187 which is what Guarsman claim the repair would have cost if it could have gone ahead. At the point of purchase we were informed that the Guardsman insurance covered replacement in the event repair was not possible. Having just discussed this with their claims handlers, I'm told that this is discretionary, a blemished seat cushion would not consitute them paying out for a replacement suite. Now forgive my ignorance, but how can companies get away with this ? What are my next steps ? , I could obtain a copy of the report and claim from SCS for manufacturer defect, it just seems ridiculous that I have to go these lengths. Any advice greatfully received - I feel conned by both SCS and Guardsman !
  4. Hi all, I'm not sure on whether this is in the correct category and i apologise in advance if it is not. I bought a two and three seat sofa from SCS in 2010 and took delivery of them on the 8th of September 2010. At the same time we also took out extra cover for accidental damage as the salesman said it covered everything for 5 years. In around April of this year, one of the seat cushion covers had started to separate at the seam on the three seater sofa and this also happened on the back cushion for the two seater sofa. We called SCS who then gave us the number for the company Guardsman and we followed the process for making a claim for a repair. After about two weeks or so, Guardsman had called to say that there was an inspector available and if it was ok for him to come and inspect the sofa. We confirmed it was and a few days later he came and made the inspection. After around 8 weeks, we received a letter from guardsman stating that the damage was not covered under the policy we had as the 'independent inspector' had said the fabric had frayed and it was not because the stitching had come apart. Now, i was quite miffed at this because to me, there is no difference. The point at which each of these cushions have split both originate at the seams of the fabric. The other thing is, Guardsman stated that it is in the policy documents that we get along with the certificate, stating that 'our' damage is not covered. We never received any policy documents or certificate and to be honest i wasn't expecting to as i thought the extra insurance paid to SCS was so that they themselves would repair any damage. I'm now left with two sofas that one has no back cover and the other has one seat cushion without its cover. I contacted SCS via their website a couple of weeks ago and i've allowed the minimum 10 days in order to get a reply but i still haven't had one. Can anyone part with some advice on what i can do from here? I haven't gotten back in touch with guardsman yet and i thought it would be best to get a broader range of advice first.
