  1. Can anyone help me with this one urgently please ? I received a Charge for Payment of Money posted through my letterbox by Glasgow based Sheriff Officers (Hannah's) on 4th July. It states I have 14 days to pay or I face wages arrestment or attachment and auction of articles belonging to me. This was a small claims action and subsequent decree extracted on 29th May 2014. Total charge inc expenses etc is £1035.60 I do not have the money to settle this matter with them. ..can I go back to Sheriff Court and make an offer to pay in instalments ? What is the procedure for doing so ? it is a number of years since my last major issue with dealing with this kind of thing but I do remember just how valuable this forum can be in assisting with advice and knowledge. Thanks everyone in advance !
  2. i would first like to thank you for all your help re this matter, as i have used information from other links to get me this far, thank you all, i am being taken to court by arrow global, and they issued the summons in northhampton, for alleged credit debt from mbna, i first sent acknowledgment to court, recorded delivery, i then hit arrow global with sar request, letter provided by you, and then hit shoosmiths with cpr31.14 request again letter provided by your good selfs, sar recorded delivery sent 11/10/2012, to arrow global cpr31.14 recorded delivery 17/10/2012 to shoosmiths, i today recieved the sar details back from global, well what i thought i was getting, and all i got was a computer print out, of details off account the very basics, no copies of credit agreement, no default notices, no termination notices, no noitce of assisgment , nothing apart from there history of looking into me, now on the guidance section notes sent along from arrow, it states this. data subject requests under the data protection act 1998 do not entitle a data subject to gain access to all documents they care to mention nor even all documents which may be relevant to them. under request 1 orginal signed agrement and terms, (arrow response This is not personal data which we process in your case, you may be entitled to a copy of this documentation, if you make a request under the consumer credit act 1974. under request 4, copy notices of assigment (arrow response to the extent that this comprises personal data which we process in your case this is included in response to your request, how ever it is unlikely that such documentation would be held in a manner which relates to you as an identifiable indivual) they sent no copies of assigment this whole response from them just looks like a computer print out, the only real document they have is the courts copy of acknowledgment of service i sent back, and 4 copies of threat letters sent to me by shoosmiths, nothing else, what arrow does say on the covering letter, is they will not provide copys of details they have sent to me as i am assumed to all ready have them( what a joke) now i served the cpr request to shoosmiths confirmed deliverd 18/10/2012, giving them 7 days to reply and supply documents, as yet i have heard nothing, as yes letter advises them of extension to time limits to prepare my defence, which i have already prepared, but not heard a thing from shoosmiths, i would be very grateful if you could advise, what to do next, as i think arrow are playing games and have no documents, as this account was opened back in 1998, with abbey national run or taken over by mbna, the account has been in dispute since 2010, after i challenged them to prove charges, argue over charging me on rates, and late payment fee's be great to hear from you, sorry for long thread.
