I had a court decree for a credit card (approx £6000) I used for expenses in a business that went bust It did not get paid back in approx 2006, Just checked my credit files with all agencies and nothing showing up, must be more than 6 years ago. I get letters from a solicitor every few months asking for a payment or they will enforce the decree. I have never responded to any of them as I have no income, no assets and no means to pay, Over the last 6 years they have sent debt collectors/tracers to my home 4 times and all have been told the same thing re my circumstances and if they wish to bankrupt me then go ahead and do it. The question that I have is how long does a Scottish decree remain live and enforceable. If they could enforce it what can they do and what am I actually obliged to tell them.   2. Hi All, I am new to the site, forgive my mistakes, I will really appreciate your kind help in this very stressful status. I hadn't received Northampton claim, the first thing I received was CCJ from District Court, managed to send form N244 and the court asked for witness statement and a draft defence and they fixed a hearing date, I had send CCA request as in your template letters, no reply yet. I don't have any original CCA nor DN and the bank admitted so its very old card 2001 the whole account closed 2005 due to severe financial loss. I managed to get a copy of the claim as below; Name of the Claimant - Marlin Capital Europe LTD Date of issue - 03-june-2014 What is the claim for By an agreement between LloydsTSB ("LTSB') & the Defendant on or around 01/05/2001 ("the Argeement") LTSB agreed to issue the Defendant with a credit card upon the terms & conditions set out therein. In breach of the Agreement the Defendant failed to make the minimum payments due & the Agreement was terminated. The Agreement was assigned to the Claimant on 28/11/2013 THE Claimant THEREFORE CLAIMS: 1.16534.84 2.interest pursuant to section 69 of the County Courts Act 1984, namely 4479.39 & continuing until Judgment or sooner payment at the rate of 3.62 What is the value of the claim? £16534.84 Is the claim for a current or credit/loan account or mobile phone account? Credit Card When did you enter into the original agreement before or after 2007? Before, 2001 I think. Has the claim been issued by the original creditor or was the account assigned and it is the Debt purchaser who has issued the claim. The account was assigned Were you aware the account had been assigned – did you receive a Notice of Assignment? Not Sure Did you receive a Default Notice from the original creditor? Not that I can find. Have you been receiving statutory notices headed “Notice of Default sums” – at least once a year ? Not that I am aware of. Why did you cease payments:- Financial difficulties Was there a dispute with the original creditor that remains unresolved? Not that I am aware of. Did you communicate any financial problems to the original creditor and make any attempt to enter into a debt managementicon plan? Yes I told them I was having problems but failed to stick to a payment plan Last Payment was Not Sure late 2007 NOW I do have a letter from Lloyds admitting that they cannot locate the original credit agrement nor the original default notice. I have spent a long time looking at your fantastic advice to the others with simillar status, Currently I am drafting my witness statement and a defence by myself, can I send you the draft to look at please... .I have till 1st Dec to submit it.
