  1. Hi I had a kitchen installed, floor, electrical appliances etc, I live in London but the company is based in Edinburgh Scotland. The company name is Edinburgh Kitchen Company. Ekco. There was no contract, only a quote which was emailed and verbally agreed to over the telephone. I chose Ekco, because they offer an affiliated mediation based company KBSA, should any issues arise during or after the project. Essentially, the issue is the floor, since the project completed, the tiles have come loose, its quite unstable. I have had an independent flooring tiler who informed me that the floor would need to be removed, and a proper sub floor constructed. Ekco, have offered to pay back the costs of the floor, which on the quote is listed as £650, but they are asking to deduct £150 from this for the costs of having to fly a rep down from Scotland to view the floor and its problems. Of course, this offer to me feels derisory, I would need to again outlay on new tiles £700, new labour(god knows how much) so this offer doesnt compensate me for these additions. I have tried exhaustively to get an appointment at my local CAB, its impossible! I have now contacted two solicitors, each with varying opinions and fees, one stating for a look over the case and an initial hour appointment, would be £215 plus VAT, and subsequent hours thereafter will be the same, and would need a minimum of 5-6 hours of this time. Costly! These fees I am told would not even be recoverable, so IM kind of left balancing out whether its worth taking things forward. I understand I can kick of litigation myself, to the small claims court, but as this company is based in Scotland, and I England, I dont know which country courts would be responsible, some things I have read is that it has to be the court of the defending party, so Scotland, but then other inquiries seem to have a nuance that its all down to where the contract was signed, but as I say, it was all done via email and telephone. I really need to get started on this, lawyers have huge up front costs, CAB seems to be so overbooked, I cant even get through on the phone, and the queue when I visited there was never ending, any help advice on this from the community in this forum would be really useful. PLEASE HELP!
