  1. Hi all I lent my car to my brother who took it to London and whilst there was imaged entering/stopping a boxed junction. I have received the penalty charge notice which I intend to appeal. However, a technical issue exists on the form. It says I can make representations on any of the five grounds listed which summarised are; I was not the owner, the offence was not committed, the car was stolen, it was a hire car, the penalty amount is wrong. My personal defence is that I was not the driver but nowhere on the form is there an option to state that. As I am the registered keeper of the vehicle am I personally liable for the driving offences carried out by people using my vehicle? I somehow think not. I would be grateful for any advice and opinions on how to respond to this form. I guess at some point the offence may find its way back to the true defendant in the form of an amended notice in which case I guess I would continue the thread as my brother was forced to stop in the box by pedestrians obstructing his exit.   2. Hi, I received a Penalty Charge Notice yesterday (13/09) for Entering and stopping in a box junction when prohibited... It occurred in : BOX JUNCTION - NEW KINGS RD J?W BAGLEYS LANE Date: 08/09/12 @12:17 I have pictures but can't add any I feel this is unfair as I entered the junction with moving traffic. The cars in front of me entered the junction just in front of me and were moving. At the point of entering the junction all the traffic ahead of me seemed to be moving I had not reason to believe it would stop. The next traffic light it very close after this one and when turning red quickly caused the traffic to back up. The light of my junction was and remained green throughout and I believe I exited the junction while the traffic light was still green. Any advise would be greatly appreciated. Karl
  3. Today I received a nasty PCN by Waltham Forest Council for my alleged contravention 31. I don't deserve it because I was waiting before a red light with cars in front of me. There was a yellow box at the road junction. The light changed to green and cars in the front began to move and so did I. Just after a few seconds suddenly the car in the front stopped and I had to stop too to avoid collision. But I was on that yellow box. The reason of that sudden stopping was that one car ahead stopped to give way to pedestrians crossing and the other cars stopped too because of that and the ripple effect was upon me. I moved only after the car in my front moved. It was for a very brief period. But the stupid CCTV sent me a photo of my car on yellow box but it does not show the whole process of my moving into and stopping in the yellow box. Please help me how to appeal. Many thanks.
  4. Having just stumbled across some old box junction threads on here, I'm posting this in case it helps anyone in future. The Highway Code guidelines for box junctions are an inaccurate interpretation of the law, which says - "Prohibition conveyed by markings in diagram 1043 or 1044 7. - (1) Except when placed in the circumstances described in paragraph 8, the road markings shown in diagrams 1043 and 1044 shall each convey the prohibition that no person shall cause a vehicle to enter the box junction so that the vehicle has to stop within the box junction due to the presence of stationary vehicles. (2) The prohibition in sub-paragraph (1) does not apply to any person - (a) who causes a vehicle to enter the box junction (other than a box junction at a roundabout) for the purpose of turning right; and (b) stops it within the box junction for so long as it is prevented from completing the right turn by oncoming vehicles or other vehicles which are stationary whilst waiting to complete a right turn." The Traffic Signs Regulations and General Directions 2002, Schedule 19, Part II, 7 My understanding of this is - Legal to stop - Turning right and not blocked by stationary vehicles Turning right & oncoming traffic Turning right & queued behind vehicle turning right Not turning right and not blocked by stationary vehicles Illegal to stop - Not turning right and blocked by stationary vehicles Legal to remain stationary - Turning right & oncoming traffic Turning right & queued behind vehicle turning right Not turning right. Illegal to remain stationary - At head of a queue turning right & no oncoming traffic
