  1. A small van hit my car last week. Rear ended me as I was waiting in a traffic jam on the way to work. It was weird because everybody had been in the traffic for a while and he just sails into me at about 30mph. The boot floor was crumpled up quite a bit, bumper damage etc. Anyway we exchanged details, I contacted my insurance, they tow the car away to the garage, and I got a hire car. So a couple of days later I get a call from the garage asking me if they can go ahead with repairs. I say no, I want the insurance agency to contact me first. He says, okay, you should hear from them. Two day later the garage calls me again saying the insurance agency have given them the go ahead for the work. I say, what about my go head? Where's my call? So I contact my insurance and they say they want to go ahead with £2400 worth of repairs. That's 65% the value of the car. I said, look I don't really want to be driving a repaired car that's been in a semi-serious accident. I also ask them about the repair related diminished value, and they basically say that doesn't come into it. I would have to prove diminished value. The insurer is Tesco, and I'm kind of regretting this choice now. They wont budge on doing a repair. Anything I can do?

  3. Dear All I finally sent my ET1 form to tribunal last Feb, and now I have a date for the CMD ( by phone in a week time). I am not sure on how to complete the document they ve sent me. I thought that the issues where described in the ET1 form, i need to complete a document as example the question is : what are the complaints or juridictions raised in the claim ( I am a bit surprised it is already mentionned in the ET1 ( unfair dismisaal, discrimination and other) what is a statuary questionnaire? do i need to answer already to " what the claimant seek by way of remedy? do i need to estimate the value of the claim? e.g 12 months salary for one year a bad treatment , loss of earning etc... ET1 contains a summary of facts and refers to some documents ( e.g grievance, GP assessment of my health etc..) I want to send some documents ( hearing bundles) do I need to agree on the list of document with my former employer ? I am not sure I really understand how to prepare myself for this CMD, do I need a solicitor? I already have been informed that my former employer requested delay as their solicitor is busy. this gives me some time. I am a foreigner so not used to this legal language and rules regards thank you for your help mariachida
  4. If anyone can give me any advice or their experiences of anything similar I would be very grateful. Two months ago my car went to the garage for 2 new front tyres, last weekend we were driving to Wales from Yorkshire. We had travelled 60-70 miles (mostly motorway) with no problems, after about 10 minutes of leaving the motor and driving on country lanes, we approached a tight corner, fortunately slowly 30-35 mph and the car didn't corner the front drivers wheel came off and shot off into a field and we swerved across the road for about 100m and came to a stop at the opposite kerb, with considerable damage to the drivers front and side, plus goodness knows what damage to the underneath of the car. Fortunately nobody or anything else was injured or damaged. On contacting the insurance company at the scene, they practically said "nothing to do with us it's a mechanical breakdown". As the car needed to be moved as it was causing a potentially dangerous obstruction, I contacted RAC and they came to recover the car but stated "you will have to pay for the recovery because it's an accident not a breakdown" Since returning home we have managed to persuade the insurance company to take the car to one of their garages to be assessed, after having a quick talk with the assessor today it looks like the wheel nuts were over-tightened and the extent of the damage means my car is going to be written-off and the insurance company are saying it's nothing to do with them as it's a mechanical breakdown out problem to deal with the garage concerned. Any advice and help would be much appreciated Regards

Hi.. 4 days ago my 61 plate ford fiesta which is on finance was involved in a rear end shunt involving a mini van ( Mercedes Benz Vito), The bumper is crushed right in.. the boot lid is damaged and slightly open at one end and the boot well has been pushed in. i dont know if there is any structural damage to the chassis but what i have been lead to believe is the boot well is structural damage?? My car has a value of £8,345. What i am worried about is if they write my car off... which then means they pay the finance company the cash! and im left owing maybe a few thousand to the finance company and have NO car! Is this possible? If there is someone who has had a similar experience much help and advice would be appreciated.. Thanks
  7. I am looking for some advise here please on the following problem i have. My car has been flood damaged and recently wrote of by my car ins as a Cat B. The car is a 2006 (56) plate Zafira 2.0T Design model done 67k in mint condition with recent bills for £2500 spent on engine work etc, I have looked around for these for sale online and there are only 6 on the auto trader in the design trim, others are Sri which my ins are totalyl dismissing as i have the design model not the Sri .... The 6 cars i have seen are : 07 plate with 61k at £3995 private seller 63 miles away 56 plate with 65k at £4750 private seller 70 miles away 57 plate with 38k at £4795 trade seller 80 miles away 57 plate with 38k at £4995 private seller 88 miles away 57 plate with 53k at £5200 trade seller 33 miles away 57 plate with 48k at £5490 trade seller 48 miles away. The problem i have is it seems these cars are quite rare, so i am struggling to get evidence together for what the car is worth, the ins has offered me £4300 first offer, and now £4670 which is the glass guide price. I have the normal £200 excess which i know i have to pay out of the money. I have argued the toss that with the offer i can only buy one of the cars out of the 6 and i thought the valuations had to be local to me... but the ins co say i am unable to include the last 4 cars as they are newer with less miles and the cars do not have to be local... Could someone please give some advise here as the ins co will not offer a higher amount and are advising me to go to the financial ombudsman if i am not happy as they insist they are within their rights. if its a fair offer then i may need to accept as i need a car for work, as im borrowing a friends at mo. Any help would be great. Regards
  8. Hi guys i have just cleared some debt off the past month and am now debt free but vodafone, o2, t mobile etc are declining me credit and im guessing it was related to this debt i have paid up. I have paid my Virgin Media bills every month on time if not before the pay date and keep getting mithered to take out a deal in my virgin media account i want a samsung galaxy s3 on virgin but bit worried they might also decline me
  9. We are currently paying BH £130 a week (TV, washer, sofa, laptop and fridge freezer), I have worked out that in OSC we are paying a whopping £18.95 a WEEK! I have read we don't need this as everything comes with a warranty, which it does as TV, washer and fridge freezer all came with them from the manufacturer. Plus the £9.08 a week for DLC. We don't have home contents insurance, and were told we need DLC because of this, also we were misled in to accepting the OSC on everything. I know we can cancel the OSC, but can we cancel the DLC as well? And can we claim back everything we have paid in regards to both? If we do cancel them (or just the OSC) and claim everything back, is it likely BH will terminate our contracts and want the items back? Any advice is really appreciated! Thanks!
  10. don't know if this the correct place for this but i need to know how to write a proper CV for my husband he has an appointment in the job centre to get help with this but its not till April Ive done a basic one but I'm just not sure about it any help appreciated he has worked in construction for 40 yrs and has a cscs gold card and loads of other qualifications in his field if that helps how do you set it out ,what do you put on it. what do you put in a cover letter

My problem is this, on 15th feb 2013 i bought a 2000 renault megane alize sport from a dealer it cost £500 has 82k on the clock and 8 months mot. initially before looking at it i did a hpi text checker and all showed clear. Car drove lovely and aside from a very tiny dent in the front passenger side wing and a scuff on the rear bumper all was fine with the car. i recieved the log book as well. Then the problems began. Went to the post office with the log book and told i cant tax it with them because the green slip has been stamped and as such us alreeady used. They told me i had to go to dvla in borehamwood to get the tax.So i went there only to be told that the stamp was dated 2007 and i would have to send off for a new log book for free as i had the green slip. As alarm bells were starting to ring i did some checking around online and found the DVLA's vehicle enquiry section, upon entering the new cars details it showed that a VIC check was required. Having never heard of this as this is the first car ive physically bought by myself i had a look around and was horrified to learn this mark was usually put on for cat c vehicles. So decided to do a 2nd HPI check but this time online and discovered that the car is in fact a category C write off. once in may 2008 for it being stolen but recovered and put back on the road and a second time for an accident. However there is no service history to see what the accident was and whether it was significant damage and been repaired. To me the damage i saw when buying the car was very minor as stated above and i dont think theres much majorly wrong with the car as i have also checked online the past MOT's and seen work has been done on the car the most recent being a brake change and an offside bearing change. What i would like to know is do i have grounds to request a refund or if necessary take the deaer to court for mis selling me a car as he did not state when buying it that it was an insurance write off. Should also point out that nothing was mentioned of this on the auto trader ad where i found the car. Have contacted autotrader to see if they still have a copy of the ad they can mail me as it has since been removed. From what i have read online without proof of a misleading claim because i dont have the original ad it seems like its a my word against his kinda thing. I dont mind using the car if there is nothing majorly wrong with it thats going to put my life in danger. I already know it can be insured with my current insurer because it was briefly when i picked the car up. Also on the subject of insurers do i have to inform them its a cat c write off. Reason i ask is because when i initially insured it i didnt know it was a write off and they didnt ask either. Obviously would like that info cos i dont wanna drive it thinking all is ok then have an accident and find my insurance void because of it. However i would have thought that in this day and age they would know that anyway with everything being done electronically. So basically just wanna know where i stand with all this. Thanks
  12. I hope you can give me some advice. My son, aged 20, bought an 02 plate Citroen Saxo VTR for £300. It has a year's MOT, and the bodywork looks OK for the year. The registration document stated it has had 'extensive repairs and/or accident damage', and upon checking via text, I have discovered the car is a category C write off. As the garage did not tell him this, does he have any comeback at all? Is the car actually safe to drive? Will he be able to get insurance? Is there any way to find out the details of the damage the car sustained? I really would be grateful for any advice you can give me. Thank you in advance.
  13. Hi all, I have just had my 22 day old 62 plate VW Golf mk6 written off due to flood damage. It is on VW PCP finance, insured through Churchill and I purchased GAP insurance from the main dealer. The car cost £24k in total (inc £1k worth of factory fitted extras) but was financed for £17k - the rest paid by £2k VW cashback and my part exchange. Churchill have offered me £19k cash or the option to replace the car under their less than 12 month old 1st owner scheme. Problem is as VW don't make the mk6 anymore so the only replacement I can get is the same car less the £1k in factory fitted extras. This means I will be out of pocket by £1k as if Churchill replace the vehicle they will not give me the difference. I have spoken to my GAP insurance and was hoping to use the £19k cash from Churchill and the £5k from the GAP to pay off the finance company and start again but because Churchill have offered me a replacement vehicle the GAP insurance say they will not pay out the difference and it is up to Churchill to replace the vehicle as it is under 6 months old. I really don't know what to do as I feel I am stuck between a rock and a hard place. Any advice will be greatly received. Thanks

  15. So who owns Marbles now? I have a letter from Halifax (address Fife) stating my account is now satisfied but it was actually sold on 2 weeks later, I think by BoS who owned Marbles at one point or still do. Do I write to Halifax, HFC or BoS?
