  1. Hi, Just over a month ago, I was told about a voucher that I could use online at the HP store, that knocked £40 off every order. At the time, I didn't know whether this was a pricing glitch, or a publicity-seeking promotion, but I decided to use it to purchase some ink. I put 2 ink cartridges in the cart,(2x£23=£46), used the discount voucher (-£40), to bring the total to £6, which was displayed at point of sale. My problem is NOT that the order was cancelled (I have seen a few of these on the boards). My problem is that I was delivered the items, but only later found out that my credit card had been charged without this discount (i.e. £46). The fact that the amount displayed at point-of-sale was different from the amount charged, is not in dispute by HP. In fact, the email response to my complaint seemed thoroughly unsurprised that this had happened. They have told me that my 7 day return period has expired (presumably they are trying to pass the statutory "cooling off period" at the limit to my rights), and have refused my demand to return the goods and reverse the transaction. Surely this constitutes theft and/or fraud. Are there any legal-eagles that could advise?
  2. Hi There, My sister has an iPhone 4S which was Replaced by Apple within the warranty period (Albeit only just). She was told that it would have 90 days warranty on the replacement handset and was sent on her way very happy indeed. exactly 110 days later the replaced iPhone 4S completely died. Won't turn on, no output from the screen so back to the Apple Store to see what could be done. As the iPhone was 20 days out of warranty, they wanted £129 out of a 16 year old girl to replace the handset. Pretty poor show if you ask me, but their rules were rules! I am aware of the Sale of Goods Act as I am Self Employed and I am curious on the best way to proceed? The original iPhone was replaced whilst it was still in warranty. The replacement died 20 days after that period had ended. Would this be grounds for "Unreasonable period of operational life for the product" It died less than 4 months in service. I am not paying £129 as the handset is insurance covered, but with an Excess I'd rather not go down that road either. Could anyone suggest the best way to proceed please? Do you personally think that they are in breach of the Sale of Goods Act? For the benefit of doubt. Handset was NOT: Jailbroken, Taken Apart, Dropped, Water Damaged and was always in a case which covered the screen also! Thanks Caggers
  3. Hi all, I'm a first time poster who has finally got around to reclaiming late charges & over limit fees from credit & store cards held now and in the past by myself or my wife. We have kept the majority of statements going back years and as a result HSBC and M&S settled after the first letter asking for charges back, actually paying us the contractual rate of interest rather than the standard 8% we asked for. We are at varying stages with two MBNA, Tesco, Barclaycard & Argos. After asking Argos for charges & interest we received a letter rejecting our claim. They have three separate listed points for rejecting the claim, extracts of which are as follows. 1. "You are responsible for making the required payments on time and for keeping within the agreed credit limit. If you fail to meet these obligations, we are entitled to recover the costs incurred by us. We have recently commissioned AlixPartners UK LLP to undertake an independent assessment of the costs attributable to contractual default by our store card customers. The report AlixPartners have produced clearly demonstrates that the costs we incur when customers default exceeds our default charge of £12. Our default charges therefore reflect a genuine estimate of our costs." 2. This point states that £181.50 of the default charges were longer than 6 years ago, although we weren't claiming for anything over 6 years 3."Further and in the alternative, we reserve our right to set off your claim (which is denied for the reasons set out above) against any debt owed to us." Has anyone come across anything like point one before ? At first we found it a bit of a worry, but then after rereading the letter a couple of times, point three seems to suggest that they're not that sure of the validity of point one. Also this account is closed so there is no debt owed to them. The letter finishes with " Under the terms of our Complaints Procedure this is our final response with regard to your complaint" plus the usual bit about our right to refer to the FOS within six months. I thought this a bit arrogant. It seems to me we have three options. Drop it, go to FOS, threaten court action. Any advice or experiences of a similar nature would be very welcome
  4. I bought a laptop from PC World in June last year, all has been fine with until yesterday it just stopped working during normal use. When I tried to boot it failed and gave a recovery message which I followed which then also failed and gave a message to refer to your supplier. I took it back to PC World today and in the middle of explaining what happened I was told by the 'Know How Expert' that software faults are not covered by the standard 1 year guarantee. I asked a few questions such as 'how do you know it's software, you haven't looked at it yet' and was then asked by the techie for a recovery disc - my reply was 'Everything that came with it is in the box' the techie then told me that as I hadn't made a recovery disc I would be charged around £70 for one to which I replied 'But it's under warranty and it has failed' cue long debate with techie where I quote the sale of goods act etc, goods unfit for purpose and so on. Of she goes to get the manager who seemingly didn't want to know as she came back and told me the same thing so I asked her to get the manager and bring him to me. I was then told he was busy but would try to get to me when he could. It turned out he was just on the shop floor as when (after the second time of asking) she went and got him he was a chap who had been wandering around the shop floor all the time I was there. From the moment he arrived his attitude was appalling, he huffed and puffed, asked why I hadn't made a back up disc and when I pointed out that nowhere did it tell me that if I didn't make a back up disc would that invalidate the warranty he said that I should know I had to do that and there was nothing he could do. I quoted sale of goods and he started raising his voice asking what I expected him to do - quite simply I replied fix it, replace it or refund my money - he then got even louder and said I was being ridiculous and that he would then be stuck with a broken laptop that he couldn't sell. The exchange went on a bit longer and few more repeated arguments from myself were not going to make this manager take any action so I asked for his full name and the store number, he asked why and I said that I would be raising it with the Consumers Association and taking advice and I would be complaining to PC World about the fact that he was refusing to deal with my faulty goods. He then started shouting and told him to calm down at which point he walked off saying 'you have a nice day sir' and emphasising the words so it was particularly nasty and sarcastic. My advice would be never to buy anything from PC World Lakeside as they clearly don't care at all about Customer service So what I need to know is who do I complain about this bloke to and who do I complain to about the service and how I was treated and how can I get my laptop sorted?
  5. Hi, I am looking for a bit of advice. I took a loan out with The Cash Store, high street shop, on the 25th of February. The loan was for £600 and I was due to pay back the loan in full (£766.72) on my next payday which was the 22nd March. I was arranged with an appointment to go into the store to pay this. Unfortunately I was sacked from my job on the 1st of March. This meant I had no income to enable me to make payment on the 22nd of March. I phoned The Cash Store on the 22nd of March and explained that I would be unable to pay this. I was told that I must still honour my appointment and bring a mini statement from my bank and my letter of dismissal from my employer to prove that I couldn't pay. I done this as requested and was basically grilled by two members of Cash Store staff as to how I was going to pay this loan and when I was going to pay it. I explained that I had applied for job seekers allowance and that I would be able to make a small contribution when I received it. At this point I was unsure as to when this would be or if I would even be eligible for it. Anyway the following day I woke up to find I had several missed calls on my phone from The Cash Store. They were calling to find out if my situation had changed but as I had missed then they also called my parents, my uncle and two of my friends regarding this issue and basically filled them in with what was going on with my job and my inability to pay this loan. Surely this cannot be right. I had to provide 4 names\contact numbers when I took out the loan as a means of contact should they be unable to get hold of me. It was a Saturday morning and I was sleeping which is why I did not answer my phone surely they shouldn't be phoning my family and friends and telling all about the situation? I went down to The Cash Store and they said they had to contact me every day to get an update on my situation. I explained there wouldn't be an update until I found out if I was getting jobseekers and asked them to stop phoning me. They said they had to keep doing this and if I didn't answer they would speak to my other contacts. I told them I wasn't happy or comfortable with them phoning my family and friends and asked them to remove these numbers from their system. The Cash Store refused to do this. Every day since, except a Sunday when they are closed I believe, they have been phoning me looking for an update on my situation. Everyday i told them there was no change and I would inform them if their was. That did not stop them hassling me everyday however. Eventually I found out I was entitled to jobseekers and would get my first payment within 3 days of my signing on date which was last Friday (4th April). The Cash Store said I must make a payment when I received this money and arranged for me to go in on Monday to make a payment that I could afford. I didn't receive payment on Monday so phoned The Cash Store and explained this. They said i had to again honour my appointment and bring a bank statement to show I hadn't received this and also my letter from DWP to prove I would actually be receiving jobseekers. Again I took this information with me where I was again grilled as to how much I would be paying. I stated that I was unsure and that I had other things to pay for such as food, gas, electricity etc. I said that I would hopefully be able to pay £30 towards they debt. They then said I should do this fortnightly when I receive my jobseekers allowance. I told them I couldn't commit to this as I had other debt aswell as my living expenses to deal with and I would only be getting £142 a fortnight. They then said when I received my jobseekers allowance I should go back into the store to discuss this further and explore my options. They said they would ring me again tomorrow (Tuesday) for a further update on my situation. I ask if they could contact only me and on my mobile and they said if I didn't answer my mobile they would phone my other contacts, basically threatening me. They contacted me on Tuesday when again I hadn't received my jobseekers which they seemed to accept. I missed their call (8am) on Wednesday morning so before phoning them back I checked to see if I had received my jobseekers money in. I had received £152.15 in but noticed my available balance was only £102.15. I contacted my bank who told me The Cash Store had taken 3 seperate payments from my account (2x£20 and 1x£10). I phoned The Cash Store who checked their system and said these payments were taken in "error" but could not be refunded becasue I had an outstanding balance with them. I told them this was nearly a third of what I had to live on for the next fortnight and I couldn't afford to pay as much as this. They told me there was nothing they could do and then asked when I could make another payment. I explained again that I wouldn't receive another payment for another fortnight. They then said I must go back into the store to discuss a budget for me going forward. They have booked this appointment in for 12pm tomorrow. That didn't stop them phoning me today for an update on my situation. I am not keen on attending this appointment tomorrow. I have spoken to my bank and asked them to cancel the CPA so that The Cash Store cannot take anymore money off my account going forward Sorry for the rant but has anyone had any dealings with this lot able to advise on the following 1, Is there anything I can do to stop these daily phone calls. They are actually stressing me out 2, Is there anything I can do to stop them calling my friends and family should they not get a hold of me. This loan is my business. I want their numbers off The Cash Store system. Can i force them to do this 3, Do i constantly have to bow to their demands and continually show them bank statements and or other documentation to prove what I am and am not getting and when I am getting it 4, Is there anyway of contacting this company by e-mail to arrange an affordable repayment plan. I have been finding the phone calls and visits to the store intimidating. Do I have to go to the store tomorrow to discuss a budget as they demand Thanks in advance...... Any advice on any of the above would be most helpful
  6. Hi, 1st time user and I'd like some advice please. In Harveys Furniture Store (speke) on the 13/1/13 purchased two reclining couches from the Bel-Air range that were on a weekend offer for £1132. Paid £300 more then the required deposit to make it easy on the final payment. A couple of days later the same couches were reduced by 15%. Contacted store, who told me to ring their customer service line if they say yes then they will refund the difference. Tried ringing their customer service line but gave up after 40 Min's and put it down to experience. Imagine my surprise when 12 days later the same couches were reduced by a further £240. Went to the store in person spoke to a salesperson who again told me to ring their customer service line. Finally after 30 mins spoke to an advisor who told me i should be ringing the store. Made contact with the store manager who was not very sympathetic to my predicament. Told him if wasn't going to meet me half way at least on the matter then i would cancel the order. He then told me I'd loose the full £300 deposit. Has anyone had the same thing happen? thanks
  7. Hi All, I had a Next Directory card which I had been paying with no problems until we faced very hard times and the account went into arrears (this was early 09). The debt was sold to CapQuest and I received two letters from CCS Collect chasing on behalf of CapQuest. I can't really afford to make payments to anyone at the mo as we barely get by as it is. What should I do, please help me? They are threatening to take legal action and I really don't want a CCJ as in two years time, most debts will be statute barred and we would have paid off our mortgage arrears as well, hopefully. Any help will be most gratefully received.
  8. Hi there i'm new to the forum. I have been browsing through a few posts but nothing seems to answer a question i have. I currently work for the ARCADIA group. Which is the business empire run by Sir Phillip Green. As an incentive for staff, like most retail companies we are offered a discount in store. To claim this discount we have to apply for an Arcadia staff store card which has an automatic credit value of £250. If we don't pass the credit check we are encouraged to apply again, then if again we are not accepted we have to wait for a photo id card (which i'm told by other members of staff takes forever). Is this legal? Can a company you work for actually force you to apply for credit to get a staff discount?
  9. Can someone please tell me exactly what powers store detectives/security guards have? Do they have the legal power to foricbly detain you? If the do have the legal power to detain you and they falsely accuse/detain you then who can you sue?
  10. Hello all I have (stupidly)maxed out my argos store card to the tune of £1200. Its got an APR of 29.9% on it and i had a few buy now pay later things on it. Ive only been paying the minimum payments for a few months and some of those buy now pay laters are due to expire.Ive not even scratched the surface of what i owe them yet and am fearing massive repayments ahead which I doubt I will be able to afford.Any advice as to the best course of action? Note,I am not yet in trouble,but suspect I may be soon! Apart from turning back time and not having it in the first place,any advice will be appreciated Regards
  11. I visited the Torquay branch of Comet yesterday and purchased two pairs of 'Monster Turbine' headphones at a discounted rate due to there current financial situation. Upon getting home and inspecting the supposedly two identical pairs of headphones it is clear there were differences between the two. Further research online suggests that one of the pairs are a fake set so i returned to the store to try and take action. Due to Comet currently being in administration they were unable to refund or exchange the items despite the store manager and fellow colleagues acknowledging one of the pairs were fake. I'm am now at odds with what to do, writing to the administrator will more than likely prove fruitless as i will merely become an unsecured debtor and at the bottom of the pile of those set to receive money. Regardless, my staturory rights have been infringed as the goods were definitely not 'as described' and as such is a legal matter. If anyone has any help or advice with what to do in this strange situation it would be most appreciated.
  12. Hi All. My wife had a Topshop store card from (approx) 2002-2006. She believes she was paying pointless PPI which she would now like to reclaim. I can't find any record of the card on her credit file. Who can I write to for confirmation of the card's existence and details of the PPI paid on it? Thanks for your help.
  13. I was really stupid about 2 years ago. I returned a product to a well know retailer. Did not have the receipt but from their product sticker they confirmed it was their product. They did not have another in stock at the branch and gave me a card with the credit on it. I have subsequently used the voucher to purchase something else. Is there a way to trace the initial credit card purchase to voucher refund to new product. If so I think my company had found out. Any info would be grateful.
  14. Hi. all I had a store card with style financial services which was taken over by RBS in 2009. I am still paying the balance although style cards were suspended when RBS took it them over. I have recently been told that my account balance should have been frozen at that point and no interest should have been payable on the balance. Is this correct? and can I reclaim all all the interest that has been charged on the account for the last three years. Regards. adamski01

I complained to Santander about the mis selling of payment protection on my house of fraser card dating back from 1995 ish to 2003 ish and they have replied saying because it it so long ago all the data has been removed from their records and that was their final response. I can only find 4 statements for this account do you think it I worth going back with these or do you think It will still make no difference? Any help would be gratefully received

Hi i need some help... first il outline this company, how they work, and what the present situation is. i had some PDL's and fter christmas i was walking along the high street and i saw this new shop. i called in and asked how it worked. the stated they needed bank statement, prof of address, payslip, 5 references. i explained i didnt have payslip as i was on day off, and would call back, they said its okay lets see your bank statement, and we will go from there. in filling the forms out they asked for 5 references, though they wanted to ring all 5.i explained i was happy for 2 calls but thats it. they then backed down and said ok, we will just ring the other 3 numbers to make sure the line rings. i thought there is no way they will give loan as i had other pdl's on my statement. they came back to the desk an said they can give 50% of my wage. i took £500. i was working lots of ot , so could afford it. Now with this shop their APR is around 59%, however they charge a brokerage fee, which brings the fee's in line with onlne PDL's. i called in on Feb to pay the loan, but needed to reloan. they looked t my bank statement and i had earned more in feb they increased my limit, again without askign for a payslip. gullible me, i took more, now it was around £700. i paid that back, and paid 1 or 2 of th epter pdls, but reloaned a higher amount in march. around £800. i get paid in the middle of the month an towards the end, work had scrapped the ot, and i was somewhat uo creek street, so i called in 2 weeks, and avised them i couldnt repay in full in march. the woman seemed nice enough saying i should pay as much as i can. i said maybe £50, she said that will cover interest. comes april i call in, pay £50. another member of staff came up, and bullied me into giving a figure to pay in may which was unrealistic, but i said aye so i could leave the shop. after this i decided i needed help and called PayPlan who have set up a DMP and have been paying them. In April i got a letter saying i owed £1020. ONce i defaulted in april i was harrassed for 3months by text messages, very few calls, but up to 5 textes a day. i tarted keeping some of them.. one of the messages was this: No Payment has been recieved towards your balance, we will now be looking to contact your employers or references if you dont contact us today another was: a telephone message was left saying collection officers would call at my door if not paid. anyway after a lot of arguinf the texts stopped. and they recently rejected the offer from payplan, though e continue to pay. now i have recived letter stating i can have a fantastic 75% discount off, so i should pay £890 before end of august!! now if that is 75% off, they have my balance on a loan of £800 at near £3600. consider the apr is 59%. the interest accrued from april on the £1020 is maybe £200-£250 so they have wacked on near £2000 of charges.......... the letter they sent also stated this: this is a 'clear the slate offer', the added benfits of paying are: no more late charges/accrued interest no home visit debt recovery company cost to you no baliff costs to you no adverse effect on credit rating no legal fees no more worry. help!!! should i go into the shop and ask for all information they have on me? you know my customer file???? thanks an sorry for the long post.

I had a Debenhams store card that was opened in a rush, the PPI was added, she thrust the application form at me and put crosses where I sign, I cancelled when I realized but was diagnosed with cancer shortly after so it was 3 years before I cancelled. Debt was sold to Link and I am paying back monthly but having done my rolling credit, once the PPI is off the card went into credit and would have stayed in credit if it were not for interest and over limit fees etc. So do I draw attention to this or just claim PPI for now? And once again do I go to Santander who sold the debt or Link who will probably equally ignore this one.

Starting a claim against Santander, was originally sold by to my wife by Evans at the tills, pressure selling, sign here gets loads off, and great deals ect, you know how it goes She didn't know it had PPI on it until i did SAR, there's a small box which has been ticked which say "I wish to purchase Account Cover insurance" her signature is above and below it, the box has of course been ticked, but other than that the only mention of the insurance is a box mention some benefits and nothing about conditions, the terms of the store card are actually tine I don't know if that's just because they have been shrunk when they copied to send me (A4) but I really doubt it. Now I have tooted up all the payments and done the Questionnaire, the thing I need to know now is which spreadsheet should I be using to work out the interest?
  19. In the process of starting to claim late payment charges on a store card. Have put all of the charges into spreadsheet and have used 26% for interest, this was the purchase interest in t&c's. Would that be correct? It comes out as.. Charges £474 Compound Interest £1046.51 Total £1520.51 Should I not be using 8% or is the higher rate correct? Just seems a lot!! Many thanks for looking.. D
  20. Hi all, found this site via MSE and have just registered after having a look around. After reading through some threads it dawned on me that I had a Topman Store Card (not sure how long ago, about 5-10 years) and its possible I could have had PPI and be able to claim some back!? Not sure where to start. Dont have my account number or any statements, so what would be my 1st step to making a claim? Thanks in advance Kev
