  1. OH just got letter from MBNA selling and assigning CC debt to ARROW GLOBAL telling her to pay debt or contact AIC. This relates to CC taken out around 2001 and defaulted 2010, previously done SAR to MBNA and found lots of charges on account. Now that MBNA do not own debt we feel time is right to reclaim charges. Looking over SAR can find lots of late payment charges of £20 and £25 around 2004 - 2006 and many £12 charges 2007 -2010. Whilst I understand that reclaiming bank charges is a no no would I be able to claim back all charges for previous 6 years from now or could I only reclaim those over £12. Also is it too late to CCA MBNA, or should I in fact CCA ARROW or even AIC. My OH will not want to fight legalities of account in court even though she could win regarding T & Cs on reverse of Credit Application/agreement. So would really like to a) claim back charges from MBNA (as they have been awful to deal with). any b) put a good case to ARROW to accept a reasonable F & F settlement. and help would be welcomed, sleepingdog
  2. After 6 years of hell my credit file is now completely clean with equifax and experian but callcredit are still showing a default that should have gone 12 days ago! I've raised a dispute and they said it could take 28 days! Any idea on how I can get this gone ASAP!?
  3. Hi Caggers, The agreed written terms of my Full and Final Settlement for my debt with the Post Office Credit Card (Bank of Ireland) were The balance would set to £0 CRA files would be marked to show the account as "satisfied" or "settled" in full The account would be closed All three to be actioned within 14 days after payment which was made two years ago. I supposed I should have checked my CRA files sooner but I did so today and found the balance is shown as £2100, The status is "Default" and the account is still shown in the "Open Accounts" section. I will write a complaint letter demanding that they modify the entry as agreed. Do I have a legitimate claim for compensation on the ground that they made my credit rating files worse than they would otherwise have been? I realise this could be tricky as the agreement was made with The Bank of Ireland who are based in the Republic of Ireland so can I claim compensation under UK law because they operate the Post Office Credit Card here? I will be grateful for your advice.
  4. Hello all, Has anyone encountered this before? I have an CCJ that was satisfied over 2 yearsago, yet showing on my credit reports as unsatisfied. Due to an previous issueregarding this judgement, I contacted HM Courts and Tribunal Service to getthis rectified over two months ago, and have had no response from them. I also have contacted the credit reference agencies, one of them hascorrected this while the other has informed, that the Registry Trust has saidthat the CCJ isn’t satisfied and that I have to contact the local court. I havecontacted the local court who have admitted that the CCJ is satisfied, but isat a loss as to why the Registry Trust wasn’t informed, as this is an automaticprocess. The local court will contact the Registry Trust to correct this. I am rather annoyed as I have had an job offer withdrawn because of thiserror. Any advice, would be most appreciated.
  5. Please dont judge, i honestly feel so sick, i cant sleep, and i cant eat. I need help asap. I have a partner, who doesnt live with me, due to the fact hes getting help for anger problems, and tbh we cant afford to live together. He stays on his mates sofa 3-4times a week and then at mine the rest. Obv he leaves for work and comes home when hes staying here. He pays £100 to my landlord for the extra hb doesnt cover, which helps alot else i would be in debt. He doesnt pay any other bills, apart from halfs on sky internet, which he uses when he stays. we have two children together, he has never "lived"with me, apart from when we lived at my mum n dads for a year, but he had his own room, and paid rent. I have a feeling i know who has "grassed" on me, a women we had a kind of thing with a year ago. OH ended up cheating on me with her. I finished, He realised what he did, so stopped it with her and came back to me. She was jealous, and said some very hurtful things, and did hurtful things. Anyway, heres the awkward bit. Were engaged. He proposed last year. weve set a date for July 13th, and have gave notice of the marriage. So i dont know if there going to believe were not living together, even though we have two children and are "getting married". Although the wedding is on hold until he sorts his anger out. He has until Jan. I feel sick everyday, I have postnatal depression, which is all time high, So feel like breakingdown all the time. Forgot to add, he did stay with me for a few weeks this year, As my depression got so bad that i couldnt even get out of bed. [my mum passed away two years ago]. WHAT evidence could they have on me? I know all his bills ect does get sent to the house. what am i going to do? i cant live without my own money, i feel sick and worried
  6. Hi, I am in the process of trying to tidy my CRA files. having been on a DMP for 7ish years through PayPlan. I have attained most of my information from my creditors through SAR and CCA requests and I have found the majority do not update the CRA files with a true reflection of payments made etc. (I know I shouldn't really be surprised ) I am in the process of reviewing one of my creditors, for whom I did not make any payments from Feb 06 for 5 months, then I started a DMP. This is a great example in that Default Notice and Formal Demands were made after 3 years of being on a 'temporary' DMP (at the start the DMP manager showed a budget to last in excess of 7 years!) and they defaulted me in 2009 as I only just then entered into a 'long term' repayment plan. (Not sure whose fault that was, Pay Plan or OC). At the time I didn't challenge the entry of the default, I was bit 'head in the sand' whilst just making the repayments every month as I wrongly assumed that Pay Plan was sorting it all out for me! I didn't think for one minute the OC would default the account after 3 years, and for no reason. I hadn't missed any recent payments before the decision for them to default. I had a couple of blips on 2007 and 2008, where I missed a couple of repayments (thats another great story - I was was bullied by a well know loan provider into making additional payments in excess of DMP so failed the DMP for a couple of months as I didn't know any better at the time!). I attach a PDF of my CRA for this file, I think the first '6' should be in July 2006, and an AP thereafter, however I am contacting them under the DPA etc as I believe it should have defaulted in 2006 - when all of the payments were missed. So that's the background, but my question is : Shouldn't the CRA file only show the past 6 years? I.e. should it only go back as far as Aug 2007? I'm trying to tidy up my files, but if the records are now showing OVER 6 years then I'm not really going to be making any progress (I have a few others who have also messed up the date of default and I'm trying to clear them all). Also any advice on what angle I could use to get them to update the Default to 2006 would be really appreciated. Currently Im thinking of the approach of : no payments made for 6 months, no DMP approved until FEB 2008, at Marker '6' it is clearly seen that the account is severely in arrears and defaulted, sent to 'collection' etc. Oh, and the fact that their internal notes 'charged off' the account in late 2006 - this I think is the key point to the Default being recognised as 2006. 7. Hi I have just received a speeding ticket & a fixed penalty. On my pink slip part of the ticket it only shows the £60 fine & nothing in the points box. Can I contest the ticket?
  8. I've got an historic CC debt with HSBC which I CCA'd in August 2007 and they wrote back saying they couldn't find the Credit Agreement. There's been no potentially payment since Summer 2006, however unlike my other debts this ones completely missing from my credit files (Noddle & Checkmyfile). Has this already disappeared off my file or is there a chance its not linked correctly?
  9. Hi all, Having just paid off the last of my debt, I'm in the process of tidying up my Credit File. I've looked at my Equifax report, and just noticed that a defaulted Barclaycard account is showing twice. It appears that when Barclaycard sold the debt to Lowell Group, the original entry was marked as a default and "satisfied" then Lowell have registered it again as a default (both the same date). Can anybody advise the best way to proceed? I've raised a dispute via Equifax already but I'm not sure how long this will take for them to sort? Any advice would be gratefully received. Thanks jpd070
  10. I have an account with Vodafone and have had for many years, just noticed on my Credit Files that two seperate accounts are showing, both up to date with payments, both updated 01/08/2012. Not sure why 2 accounts are showing.
  11. I just viewed my credit file with Experian. There are no debts on it at all, which cannot be correct as I have several unsecured debts. (all in my maiden name) I applied to view my credit file in my married name, but I am sure it asked me when I registered for other names i,e maiden name. So I would have thought it would have linked my maiden name and married name together. Do I have to view the file in my maiden name separately?
  12. Hello, I had a CCJ 6 years ago - I settled it in full within 2 months. However all 3 agencies are still showing it on my file & it should have dropped off this month (it is from Aug 06) I contacted checkmyfile about this & they said it would be removed after 1st Sept Equifax are still showing the CCJ as active even though it was paid in full Checkmyfile have told me that equifax will therefore not remove the CCj from my file even though it is over 6 years old Does this mean I need to go through the process of getting a certificate of satisfaction etc. to get this CCJ removed from my file? All I have is a receipt from the creditor (from the time of payment) showing the payment. I don't have a letter of satisfaction from them. One cofusing factor is that although I paid it in Sept 2006, the other 2 credit agencies show it as being satisfied in Nov 2008?! Does anyone have any advice?! Thanks in advance.
  13. Hi, Need some help on how best to deal with this. My OH today received her credit report which showed an entry for a current account with Co-operative Bank. She closed the account in 2007. The entry shows an overdraft balance of £156. However her statements show a balance of £0. Plus, would they have allowed the account to be closed if there was still an amount owing. Any advice please on how best to deal with this. Thanks
  14. Hi, Very new to this, but have been informed that this is good site to getanswers, so here I go! I have recently checked my credit reports from Experian and Equifax and have noticed that a CCJ isn’t shown on them. I have also check the registryonline and it’s not shown on there either. The court case was back in 2009 andI have been paying the judgement amount since. Has this happened to anyone else and what does this mean? Do I have a CCJ or not? Thanks
