  1. Hello again, I have issued a 1-2k claim against a service provider "Spottish Powder" using MCOL on 21 JAN. They filed an AOS, and time to file the defence expired, either today or yesterday, I think. MCOL will now allow me to file for a DJ. Should I do this, or wait? Thanks in advance.
  2. Hi, Can anyone offer me any advice on an issue I have with the FOS. I took out life and critical illness cover through a tied broker in 2012. In 2016 I claimed and my claim was turned down by the insurer as they did not know about surgery I'd had prior to applying for insurance. Trouble is both me and the wife know we told the brokers agent all about the surgery on the night he came to get our signatures after checking the application. I made my initial call on the 14/4/12, their agent visited my home on 17/4/12. The FOS got involved after my complaint to the company was turned down. The original sales phone call in which I tell the salesman about my surgery is 'missing'. The FOS adjudicator requested the application and signed declaration from the brokers. What she received (and accepted!) was amazing. Pages 1 to 5 were missing and the last 4 pages (the declaration) were scanned in such a way as to obscure the date in the top left hand corner. There were no other dates on any of the remaining pages. It took me 4 subject access requests to finally receive the complete form including dates. Their excuse for their inability to supply what I'd asked for previously was that their scanner could not scan complete pages the right way up!? On each of the replies to my requests the broker states the completion date of the form as 16/4/12 The FOS is not upholding my complaint. I've always maintained that I (and my wife who took out cover at the same time) told the broker and agent all about the surgery and that therefore, knowing that it was unlikely the insurer would offer me cover, the broker and/or agent altered the application without our knowledge. I even had a photo dated 2 days prior of the 4" scar on my part shaven head clearly visible on the night of 17/4/12! Turns out the date on the missing 5 pages was the 19/4/12 - a whole 2 days after my signature was obtained on the declaration. The date on the declaration was 16/4/12. This appears to be the date the declaration pages were sent to the agent and therefore the declaration was produced on or before 16/4/12. This is where I'd really appreciate some advice - the FOS Adjudicator and Ombudsman actually used the application/declaration in their decision. Can they do this?, should they do this? and where do I go from here? Thanks
  3. Hello! This site has proven of great help. I am posting here on behalf of my nephew. to cut it short, nephew was supposedly parked in an Ibis hotel car park and was not a guest. Received a ticket from Civil Enforcement Limited . He ignored it because it was not his vehicle having repeatedly told them. As a result, they took nephew to court. He was able to set aside the judgment because the claim form didn't specify what the amount being claimed for was and also, it was not signed by a 'person", but by a company. I accompanied him to court and the judge set aside the judgment. Nephew received a letter following on from court hearing where it said: 1. The judgment against AU dated 27th Nov be and hereby set aside. 2. Claimant to file and serve a fully particulated Particulars of Claim by the 5th March 3. Defendant to file and serve a defence by the 19th March 4. Direction Questionnaires by the 9th April. Nephew spoke to court and they advised C's have not filed a particulars of claim. Question is - should nephew still file his defence? AND Can he counter claim for compensation? Many thanks, Jay
  4. Hello After a period of ill health I am finally back to work. I checked my credit history which is so shocking. i have 1 x default June 2016 for £5K (company offering to settle for 2.5 K - should I settle and what difference will it make). I have four missed payments on my credit card and its maxed to £3500 - again should I pay and clear the whole bill now and request they remove the missed payments from my account? how do I convince them to do this as a gesture of good will? I have also got a 3 x missed payments for a phone Three - I closed the account and genuinely dont know why they are marking this against my file - again should I just pay this and request they remove the marks as a gesture of good will? My parents have offered me money to clear all of the above debts. Will doing so improve my credit score? and how quick will that happen? I am hoping to get a morgage in the next couple of years.   5. I hired an arbitrator as an ADR between me and my accountant. However it turns out that the contract between me and my accountant does not have a clause for arbitration. The arbitrator took on the job without checking this. He says he doesn't work for free! Given that almost all other professionals would do such a check, as it saves a lot of time - is there is legal requirement for him to do this check?

After the recent changes to unauthorised overdraft fees/charges, i believe every effort should be made to force the banks into repaying the money they have squeezed out of their customers, especially Lloyds. The fees/charges were disgraceful, £10 a day for a maximum of 8 days and then the interest on top, also a charge for being overdrawn was applied, basically there were months i received almost £90 in charges for being merely £20 overdrawn, it's downright disgusting that these banks have been allowed to get away with this for so long. I tried on a few occasions to arrange an overdraft but was refused, yet Lloyds were quite willing to allow me to go overdrawn without authorisation and squeeze out these fees from me. They are honestly a disgrace, and should be made to payback what they have taken, i would love for this to go the same way PPI did, so the FCA needs to make this happen.
  8. I've been on benefits due to health issues for quite a long time now, I was on Incap Ben until Oct 2013 when they moved me to ESA and that's been static since then. Not had any kind of increase in 4yrs. In 2014 I finally had a diagnosis of one of my health issues that had been ignored for years by doctors... Dismissing my issue as weight related when it was in fact a condition called Spinal Stenosis... which is 'made' worse by being overweight. This explained the shocking spasms in my lower back which could turn my legs to jelly and make me slump to the floor at any time and I couldn't walk more than 20-30yrds without getting one. Since then I have lost over 140lbs the condition has remained and not gone away as previous doctors claimed. I have also been diagnosed with osteoarthritis in my knees which is further impacting my. the small increase in the distance I could walk has been decreased again by limited movement and pain in my knees. I've also got early stages of the condition in both shoulders and struggle to lift my left arm above my shoulder but can rotate it, whilst my right shoulder doesn't rotate properly but my arm can be lifted above it. Back in either 2014 or 1015 I got the forms for PIP but never sent them in... to say it was a confusing mess of questions that repeat themselves over and over again and with reports that the vast majority of claims are simply dismissed anyway put me off ever sending it in. I'm not getting any better and losing over 10st hasn't had the kind of impact that I had hoped it would... I admit that my weight was out of control due to severe depression and 19 deaths of family and friends between 2008-2016... In short I was broken and whilst I'm still broken, my financial situation continues to deteriorate. I can just about cover the rent due to the fact I rent from family (all legal, proper tenancy agreement in place and council know everything) at a rate well below average (they're doing it to give me a safe place to live not to make a profit). I can just about cover utilities and household expenses, but there's not enough for anything else and although I do have a car it's 12yrs old and I limit how much it's used due to the cost of diesel, insurance and car tax. Without transport I would be housebound and unable to get out and about on my own... I can't even make it to the local corner shop which is about a 300-400yrd walk. On a very, very, very good day... I might make it to the corner shop, but would then struggle to get back carrying anything I bought. By the time I got back (after stopping repeatedly to sit and let the pain subside) it could virtually incapacitate me for hours and I'd be unable to go out again for a few days at least. When I am able to go out to do shopping (once every 2 weeks on average) I have to normally go with some one and require a trolley to hang onto to support myself. Even then after doing a small amount of shopping, we stop at the supermarket cafe for a rest and a drink before carrying on. I tend to load my shopping in small amounts into multiple sturdy bags with handles, so I'm not carrying heavy ones into the house. I can park on my drive so the boot of the car is no more than 6-8ft from the front door and it's an estate so a low tailgate means no bending to lift things up. I know I could do my shopping online but I actually look forward to doing mine as it gets me out of the house for an hour or two. The arthritis needs me to keep moving more not less, but I can't do that where I live due to the area, hills and so forth... it would be nice if I could drive down to the lakes nearby a couple of times a week and do a little walking there, as they have benches and rest points all around them... But parking isn't cheap. After reading so many threads on here about people applying for PIP and being refused... it's making me wonder if I should at all... I'm not asking for expecting a disabled badge or motability car... I desperately need a little extra help so I can perhaps pay for a little more fuel each month, or parking charges... an extra £20 a week would have a huge impact provided it wasn't taken away from my other benefits like ESA/LHA. If I get the forms... where can I get help to fill them in... a lot of it seems designed to confuse and deliberately make it as hard as possible to complete. I think doing it my own will only result in me not bothering like I did last time... which is what I now think is the main objective of the form.
  9. Hi, Trying to sort a few things out and get myself back on my feet and would really appreciate some advice please. A few years ago I got myself into a debt mess (best way of describing it). Had charges put on home and avoided creditors for many years so that debts became statute barred. Sold house and paid off the charges on the house in full, other debts are now statute barred as over 6 years old and no payments or acknowledgement of debt made. I was wondering if it is safe and okay to reclaim PPI on these old debts (some of which I did not finish paying off). The charges put on the house were considerable (£40,000+)........yes, I got in a big mess and wish I had known about CAG back then! Just some advice as to whether the PPI is worth pursuing or whether I am going to drag up old issues/problems would be much appreciated. I know I paid some PPI, especially to Household Bank and it would just help me start getting back on my feet after a really hostile divorce in which I basically lost everything. Many Thanks

The importance of this subject prompted me to approach CIVEA (The Civil Enforcement Agency) and yesterday they provided me with a copy of their official Guidance Note on the subject. A copy of this should be featuring on their website this weekend. Dodgeball's important and interesting thread on this subject has run to 5 pages and with 100 replies, I thought that this Guidance would get better publicity if it was posted on a separate thread. Hi, was caught shoplifting in boots, picked up 4 items nearlly worth £700 (as per Boots). security staff took all my details, called police, and i had to wait until police turn up, but nobody came. security staff called police 4 times, they were given a log no. but were getting told that no police officers are free at the moment to attend. after 4 hours of waiting, i was let go, as the store had been closed and they waited over an hour for police even after the store was closed. i was escorted out , i was given banned notice and RLP recovery letter. was cautioned in 2009 for shoplifting in past (in another part of uk), never did anything wrong again after that. then in january this year i was in trouble with another retail store, they called police for shoplifting goods worth £40, police didnt arrest me since i had no id on me they wanted to know if all my details given to them were correct, they brought me home, they didnt enter my house but waited outside in car until i brought my id and showed it to them. then they just said that it was a slap on wrist this time but dont do anything wrong again. At that time i told them about incident of 2009 where i was cautioned but they seemed not to have that on their record. My question is that what should i do next? do i need to go to police station myself for last night event? will police come to my house to arrest me? (they dont have my phone no to contact me on.) will i go to prison or get a fine or get a caution? or will i be luckiest and police wont turn up at my house? will they search my house or enter inside (if this happens then i will loose my accommodation as i am living with a relative as i didnt have anywhere else to live, and slept two nights in a park two months ago then this relative finally helped and sheltered me, if they know about this then i will even loose the roof from my head) i am very very stressed and dont know what to do. (i asked security staff and he said that i dont need to go to police station, if police contact him then they wil pass my details to them and they will take it from there) they waited that long because of the worth of items stolen were about £650.
  12. And Hello everyone, I have just registered on the Forum and this is my first post! I was hoping to pick your brains a little regarding a similar issue I have found myself in. I have travelled from St Pancras to St Albans on the Saturday just gone. My partner and I have stupidly used my bank card - thinking that St Albans was still covered by the London zone! It's a complete mistake on our part which I have admitted to the staff at St Albans station, and apologised. I have asked if it's an option for us to purchase a ticket now (hoping they would exercise the discretion) which they have not. In fact, the first officer said that I ought to pay the penalty of £25 which I thought was too much (given the standard penalty is £20). I have simply asked him to explain to me why it is more than £25 pounds. At the same time my partner was speaking to the second officer who said to him that he can pay the amount £11.80 now, and the rest he can appeal later. When I heard this, I asked "my" officer if I could pay the same to which he said no. I asked why that was the case but he just said that was up to him - essentially charging me more than my partner, and for the same offence. I though it was not fair, and refused to pay the £25. He automatically started filling in the MR 11 notice (the "witness statement"). I had no idea what that was, and asked if he could explain which he just said - this is a legal document. I asked if he could please confirm that he is indeed entitled to serve this to me - I asked for his employee reference number and to show me a badge with his picture on. He told me his employee number, and refused to show any documentation to support it and said that I would just have to believe him. At this point I said I would rather pay the £25 penalty fare (I did not understand the MR11 but it sounded scary), but "my" office said that it was too late. I suspect I will be receiving the notice to prosecute very soon. My question is whether I should wait for it to arrive, or should I contact the Prosecutions department now, before the notice arrives. I never not wanted to pay the penalty fare, I just wanted to be treated in the same way my partner was - i.e. pay £11.80 penalty fare rather than £25. I still want to pay for the journey I made/penalty fare, but I can't do that via Thameslink Customer Department (because Penalty Fares Department is independent to GTR).   13. Hope this is the correct place to ask this. Daughter is a Uni student and was in a mixed shared house with a number of others both male and female. All paid in to a deposit. A few months ago the basement toilet got blocked and overflowed. It's one of those macerator types and when the plumber inspected it a new unit had to be fitted - tampons were found in the system and were blamed on the failure. The landlord is now wanting to deduct the £600 cost of replacement from the deposit. Of course the chaps are saying this is nothing to do with them. The ladies are (reasonably) asking how can it be proven that they would be responsible? Can the Landlord do this or does s11 of the Landlord & Tenant Act (Landlord repair responsibilities) apply here? TIA Andy
  14. Hi All Earlier this year I had a Final Charging Order applied for by my local Council to my local County Court. This secures a long-standing Council Tax debt from a past period of financial difficulty. I’ve no problem with that, it’s right and proper and appears to have been done procedurally correctly. The issue I have is that the Final Charging Order, issued by the County Court with a case number etc, has found its way to Registry Trust so is now listed on my credit file by the credit reference agencies. I’d always understood that credit reference agencies didn’t list council tax debt, so I’ve done a bit of research and made a few calls and I’m now in a position where I need some advice – hence my post here. I rang Registry Trust, the guy I spoke to said normally a charging order wouldn’t be listed but the info they get sent to upload from the County Court Money claim centre doesnt specify what the Judgement is - it just lists case number, amount, claimant & defendant names. He advised me to call the County Court Money claim centre, who have asked me to put my case to them in a letter or email. So what I’m looking to find out is: 1. What and where is the legislation or rules saying what Registry Trust should list? 2. How do I go about getting them to remove the record if it shouldn’t be there? 3. What about the credit reference agencies themselves, what and where is the legislation or rules saying what they can list? I dont want this blighting my file for 6 years if it shouldnt be there.   15. Hello everyone yesterday out of stupidity and mostly boredom if i'm completely honest I attempted to shoplift a pair of £15 headphones from Tkmaxx, this is my first time ever shoplifting. Once being caught I was asked to come back into the store halfway down the street, upon entering some little room in side the shop I was searched and my bag and proof of my age, i showed him my provisional , being a bit nervous and realized how silly it was of me to do this I said to the man sorry etc and for wasting his time. Until he goes on to tell me i'm going to be getting a fine from the so called "RLP" and would have to pay 'debt' for losses , administrative costs ,investigation costs and time wasting which I believe is an absolute joke, especially after doing a bit of research these fines can be up to £190! The headphones were returned to the shop in pristine condition, i'm not bothered if they get the police involved all they will do is give me a caution for such a petty mistake. Does the RLP have any sort of legal right, or are they just preying on the vulnerable to make a profit, as I am certainly not going to pay that fine, is there any way I can get around it or send them a letter back to end this. Although this happened just yesterday I will keep everyone updated when I get the letter from the RLP Thanks for reading
  16. Hi I'm new here so hoping I'm writing in the correct place. I was hoping someone could help me with a query I have regarding a shopdirect/very account I have. Back story - I fell into financial difficulty a couple of years ago and have 6 creditors and a large outstanding debt balance. 5 of the 6 creditors have defaulted my accounts and they show as such on my credit file however shop direct haven't, it says 'up to date' but when you go in to the details there's red marks with differing codes that cover the period since I stopped making the contractual payments. Now although I'm the one that's not kept up their end of the deal and not in a position to moan as such I think it's unfair and going to be more detrimental to my credit file in years to come that I haven't been defaulted. Am I able to make them back date a default date online with all my other creditors in the hope that in 6 years time I can leave this mess behind me or can they keep this going for as long as they wish, the balance has spiralled out of control and I will be lucky to have paid it up in 6 years so feels like I'll have to wait double time to get this to disappear if that makes sense? Thanks in advance for any help or advice.
  17. Good afternoon everyone. This is going to sound pretty silly but I have been paying Lowells £5.00 per month for nearly 3 years now, but I have no idea what it is I am paying for. Some of you have been helping me with an actual claim, so know the state my life was in a few years ago, so I won't go into that all again. Anyway - I think (but am not certain) that the debt was an old littlewoods catalogue. I have not missed a payment ever in the nearly 3 years it's been going on for - but my credit file just shows default every single month, so I am getting no benefit by paying it back. I'm rambling (as always) sorry; I just wanted some information on how I can find out what this is for. I am loathe to call them as they've lately been writing to me about an old mobile phone contract, and I'm nervous that getting in touch with them may open another can of worms. My credit score page just says Lowell, and nobody else so I don't have a clue what this is for. I imagine most will think it insane that I've been paying them all this time without knowing what it's for - but I just agreed a small amount to get the off my back at the time, and being homeless I have lost any paperwork they might have sent me long ago. Hi everyone Sorry if something like this has already been posted a million times before but I'm at work and I haven't got time to trawl through all the posts trying to find a similar situation to mine! I took out a gym membership in October with Xercise 4 Less. It was £9.99 and I was going 3 times a week. On New Years Eve I badly dislocated my knee whilst at work and was put in a leg brace which had to be on for at least 6 weeks. I (stupidly) cancelled my gym DD because I knew that I would be out of action for a while with very little money coming in. Just £80 a weeks statutory sick pay and that's not a lot when you've got rent/bills to pay. Today I received a text saying ; 'Dear Member. Your account is in default and if left unresolved will be passed to a third party debt collectors. To prevent this call us on 01132038602 to settle '. I've just called them and explained the situation/why I cancelled but they've said that I need to send them a sick note before they will let me cancel. I'm now back at work and technically I can exercise but I do struggle going down steps etc. I'm not sure that my doctors would write me a sick note because I could probably go to the gym but in reality I'd rather do my very limited and basic physio exercises in the comfort of my own home. The only other option that they gave me was to pay my account in full. My contract doesn't end until October so that would be quite a lot of money for a gym membership that I just won't use. I also asked if I could set up my direct debit again to finish off my contract and they said that they could but it would have to be for another 12 months which is essentially a new contract. Should I just pay it all? What will happen if I don't? Thanks X
  19. My Dad got work done at his house where I live 4 years ago. The electrician didn't do something he asked for so he cut of £500 from a £20,000 bill. Today I get a update from Experian that I have a CCJ under my name issued yesterday. Having spoken to the court it turns out that the Electrican issued a CCJ at our old address where we moved from 4 years back. I never got any of the letters or did I get any intimation from the court AND I am not a part of this at all. I only live at my dad's house and the claim should be between these two. I have nothing to do with the bills for the building of my dad's house. My Credit score just dropped from a 5/5 to a 1/5 for something I am not involved in or knew anything about. Spoke with the court who have suggested I pay £150 and do a application to set aside the judgement. Also spoke with Experian who say they will put this down as fraud as it has nothing to do with me but they will need to investigate and can't guarantee that this will clear my record. Also the claim is issued under a misspelt surname. Does that make any difference? What should I do????? Some guidance would be highly appreciated. I have worked hard to keep my Credit history good and one wrong swipe has just ruined it.
  20. I am the owner of a car and my wife the driver. On 31/03/15 my wife met her friend on for a meal one evening and parked side by side with her on what they thought was a free car parking space at the side of the Croma Italian restaurant in Prestwich , Manchester. neither of them saw any signage and plus it was about 7:30pm in the evenings wasn't expecting to pay parking. Apparently there were signs according to excel? After now numerous letters from excel parking, zenith, rossendale (all ignored). We have a letter from BW legal - a final notice saying that as i have ignored the last letter offering a discount of £80 they now have been instructed to commence proceedings in county court if i do not pay with 10 days of the letter date . The letter is dated 9th may 2016 and I received it on the 14th may. The letter states i have to pay £54 excel costs plus £100 fine. - Remember i am not the driver (I'm the owner). I have never corresponded to parking charges before and they always stop after a year or so but these seem more "legal" and possibly I'm now entering a reality whereby they will take court action? Q. has anyone had this "final notice" letter and when or how did you deal with it?
  21. Anybody on here who are on JSA who feel they should be on ESA and get more support/ help than just JSA claimants ? My story is ive been in between both as was diagnosed with chronic back and leg pain. Was deemed fit for work. Had little explained to me so was even looking for full time hours and i was riddled in pain. So much so i was having to job search and eat lying on my front. Having had to do that i now have RSI in both arms all the way down to my hands. More recently ive been getting neck pain and head aches. Doctor thinks it's all connected to my back pain which ive never been able to find a proper diagnosis. Feel helpless and after hearing stories of people getting benefit stopped is it worth me trying for ESA again as i was messed about before and lost out on money which i just cant afford to do. Partly their fault as my ESA form never got here and whilst in between job seekers and ESA i had a dentist appointment. I ticked ESA as it was going through but endeded up with a fine. Had i known id of just cancelled the dentist for a few days I also now suffer with a bit of depression ( didn't go out socially for 3+ yrs) and anxiety which i struggle to explain but having the pressure of being made to search for work when you wouldn't employ yourself as i once looked in the mirror and see a vibrant out going confident young man and now i'm just drained. Pain/ meds drain me. Any help/advice much appreciated.
  22. Hello. im new on here but ive been reading some of the threads with interest. In 2010 i took out a payday loan with Quickquid as my credit cards were maxed out at nearly 16k...... id just come out of a relationship that had left me financialy challenged. It was so easy to borrow from them ... had the loan and paid it off as planned. Anyway i had a 2nd larger loan when i needed work doing to my car....... this where it all went wrong because when it came to payday time i wasnt going to have enough money left to live on...... so i took out another payday loan with a different comapny. Yet again so easy to borrow, things just spiralled out of control and between 2010 and the end of 2013 when i finaly saw sense and seeked help id been using QuickQuid Payday UK Wonga Payday Express Lending Stream Pounds to Pocket 1 month loan Swift sterling Mr Lender every month for the time period, either rolling over loans or taking out new ones to pay off exsisting ones the borrowing off them again. I was so stupid, they ruined my life for 4 years, if id been turned down id have faced my issues sooner and got sorted.... at one point i was doing 80hrs overtime per month and still couldnt get straight. How could these companies not see by the credit checks that i was in meltdown? Last week i added up everything id borroweed and paid back to payday loans companies....... i borrowed £38,711 and paid back a whopping £61,409. Im worried about asking for refunds because i dont think i was honest about my disposable income...... i was in such a mess and not thinking straight, i was just desperate for the money, to pay tha payday loans etc. Im so stupid.   23. About a week ago my sister of 24 years of age and my under aged self arrived in London for holiday visiting our cousin,who is currently a university student. Neither of us has any source of income other than their parents and not having a lot of time to save up for this trip made it very hard for us to get by with the money we were given.Yesterday was our 7th day and we thought it would be a good idea to take some presents for back home but without much money it would be hard to acquire them. We finally decided to steal some but of course it was a STUPID idea.We were taken to the room downstairs by a really kind lady.She asked us for our info name,date of birth ,Addres.We contacted our mother with her help and she confirmed everything we told her. She told us a letter would come demanding we pay an unfairly high amount of money which could be 300-400 pound,around 10-15 times the amount of money we attempted to steal.After that she took copies of our ids and we returned home. I was mainly concerned about my mother as she would have to pay the "fine",so I started doing some intensive research and came across this site.Almost in every single case you guys provided amazing support to other members and always advised against paying the money. I know there are a lot of people like me out there but I wanted to know if the fact that I am a resident of a different country would change things.My personal opinion is that it would be even harder for them to do something that would affect me negatively. The security Guard constantly tried to remind me to pay that money and if I wouldn't they could inform the local authorities.I find it really unlikely but I would also love to have some feedback from you about my situation.   24. Greetings Ladies and Gents how often should Landis and Gyr 5235A / Ampy Automation 5235A Electric meter be replaced? The meter is the cheapest no frills anti-reverse digital electric meter they cost around £20 when they were introduced. I read somewhere ??? that it should be replaced every 10 years, however when I spoke to my current energy provider they said 2031 (25 years), that Centrica note above the meter was the provider when the meter was installed. I was hoping that if I ended up on JSA, I could do their token jobsearch on the abysmal Jobmatch site and then do my own jobsearch later on at home at proper sites like Indeed or whatever, but it seems they're not letting you do that without a sanction. Why is that? Don't they trust us to look for ourselves? They honestly don't want people claiming benefits in the first place so it would be obvious that they would help us in our OWN jobsearch rather than theirs. In fact, I heard a rumour that those upright machines with the touchscreens that print out jobs for you have disappeared entirely from ALL JCPs - is that true?
