  3. Hello All, Can I force the Agents to share the reference given by my landlord? Can Freedom of Information act be of any help here? Thanks
  4. Hello there and congrats on a great website that has helped me loads. Yesterday I had a bailiff turn up who I dealt with by opening the gate to our property and asking him to step outside. As this person has been following me around for the last 5 years turning up like a bad penny about once a year I commented on this and told him he really was a sad little man. Naturally he didnt like that and took my photograph with his mobile phone! I was standing by my gate about to go back in. Can a bailiff do this?
  5. Hi all, I have an unverified debt to a former employer who is now threatening to issue a revised reference to my new employer if I don't agree terms to repay them. Is this not harrassement? Apart from anything else, if I lost my current position as a result it would be self defeating as I won't be able to pay them anything without working! Any views appreciated. Thanks. Exchange
  6. Could someone help me, I was informed on friday that my telecoms company have a fraud investigation and have a crime reference number, What does this actually mean. Should I expect a visit from the police anytime. I am quite worried why they have do this when i've not done anything. Thanks
  7. My credit isn't great, so I looked at my credit reports on Equifax, Experian CreditExpert and CallCredit. I was amazed at how much of the information was completely wrong. I've now written about two dozen letters to financial organisations, including letters to the three agencies themselves, but although I've got some things corrected, there are still dozens of errors. It's pretty serious because anyone searching my file will get a bad report, even though all debt was cleared two years ago. Has anyone else had a similar problem and is there an organisation that will force these financial institutions to make the required changes? Frustrated of Shropshire
  8. My wife was sacked from her last job but was lucky enough to get another job not long after (she works in a school) At the interview stage she declared that there had been problems with her last employment her sacking was down not following a management direction (Parking issues) within and around the school grounds this was also in her reference from the school. Despite all that he took her on and there has been no issues since. She has now been looking for another job since she got this new one and has been informed by the headmaster that when giving her a reference he has to "declare" on it that she was sacked from her last job and the reasons for her sacking. I've never heard of an employer doing this before as I would have assumed a reference would relate to current job and her role and not inc information relating to the employer before them? The headmaster has said that he spoke with HR about this and wife also had her Union present (Unison) who also agreed they could do this. Would appreciate some advice on this as I didn't think they were allowed to do that?
  9. Hi all and I am sorry if I am posting in the wrong place I will try to condense the information has not to ramble. I worked in an admin post that was well paid and a decent pension for 12 years. My mother had set up her own business with her partner a couple of years earlier. In 2010 her partner left her and she begged me to leave my job and work for her doing the admin has she could not do the work. In July 2011 she met another bloke, moved him in and went on holiday with him leaving me in charge to run the business for two weeks. I worked long hours but I did very well doing her work also. She came back and told me she was making me redundant in a weeks time and then she too him on to do my job! Heart broken and angry I left. How could a mother do that to her daughter? She refused to pay me my last months pay and also refused my unspent holiday pay. I took her to an employment tribunial and she ended up paying me a month before it went to court. I put the heart break behind me and set upon finding myself a new job. I applied for around 200 jobs but with no reply even with jobs I was over qualified for. I went self employed for a year has a gardener but has winter set in I did not have enough work so I began applying for jobs again. I have applied for over 100 jobs and still nothing. I took a part time waitressing job to get me and my kids by (I am a single parent) 6 weeks ago. My boss is really impressed with me but I love admin so I have still been applying for other jobs. My boss called me into the office today and said they have checked my references out and my mothers boyfriend has given me a shocking reference. I told my boss everything and she told me not to worry has I am one of the best staff there. Is there anything I can to to stop anymore bad references from him? I only met him once and I have never worked with him. I do want to further my career but he has been putting a stop to that for the last 17 months!! Please can someone help me Thanks in advance to you world wise people
  10. Hi All Last month I contacted virgin media about having their tv and internet put in my house. The person I spoke to said yes I can have it but I have to pay £145 that I owe them first ? In 2003 I switched from VM to SKY because they offered me a better deal, now at the time I was fully paid up with VM and didn't owe them anything when I closed my account.. I told the person that I didn't owe them anything and therefore didn't continue with switching back. Today I have just signed into my credit file and VM have put it on my file it is in the green saying account is open yet I don't owe it, it's been 9 years since I was with them and I've been living here for about 14 years now, yet I have never had any debt collector get in touch either which if I owed what they say then why not ? Thanks for looking hope someone can help with this... Regards FL
  11. Hi, I have today been in touch with Equifax regarding the exact meanings of their search descriptions. I specifically was interested in the one listed as DEBT COLLECTION, I asked them what this is which I was duly informed. However I enquired further as to the parameters that mean a search of this type can be carried out, to which after a heated discussion she hung up on me. Anyone??? Do you know what the parameters are that mean a company can perform such a search??? To me, these searches can be misleading and potentially have a disproportionate effect on your credit rating. Thanks in advance
  12. I have a friend who has worked as a nurse in a care home for the past 20 years. Recently conditions and moral in the home started to deteriorate. She recently (about two months ago) ended up been disciplined for use of her mobile phone during working hours (she works part time by the way). She was given a written warning for this (a bit harsh I thought) She was also disciplined for something else can't remember what it was now. I think they may not be relevant anyway. As a result of this and how conditions are at the home, she went off sick due to stress. While off she came across a similar job closer to her home. She filled out her CV and applied for the job (all done online). The home phoned her the next day to arrange an interview. It went well and she told me it was just a matter of waiting for the necessary checks to be done. She has already handed in her notice with her current employer. I got a message from my friend this evening to say that the new place wrote to her current manager who has apparently given an unsatisfactory reference. So therefore the job has fallen through. Am I not right in thinking that an employer is not allowed to give a bad reference?
  13. Hi BRIGADIER2JCS I have been searching posts relating to problems regarding credit reference agencies & have noticed that you are quite popular with these issues. I have recently been notified by a credit ref. agency that there is key changes on my credit report. At the next opportunity I contacted their customer services to see what this meant & to my horror was told that my credit score is showing POOR. This I know should never be the case as I am very punctual with my financial affairs. I see that you have help many & obviously interested if you can help with this? Just like to add that since this has come to my attention I have learnt in the last year my score has dropped by approx. 300 points & have also discovered many issues with this agency that are very disturbing. I have also been a good customer for many years now & feel let down especially as I have plans for new biz. that involve a lot of credit & will cost me a small fortune if I cannot go ahead. So I do hope how urgent this is to be corrected! Yours faithfully Theactionman
  14. Have just had my latest Credit Reference Agency report, and apparantly my credit rating has dropped from 3/5 to just 1/5 but with no explanation as to why. Nothing has changed from previous months. I am up to date with any payments/direct debits and haven't used my overdraft, and the only new thing on there is a check by my new insurance company for my car insurance which looks like a pretty standard thing. I am not even paying my car insurance in instalments this year, I've managed to pay it all upfront, so the only checks they have made are for money laundering and to confirm my address. Seems a bit rough that my credit rating should fall simply because of a standard check by an insurance company. Does anyone know if this is usual? Good job I'm not looking for any credit or loans!!
  15. Hey all, I have a quick enquiry if someone could take two minutes please. I'm applying to rent a flat and the agent has informed me that I am required to fill out a form that is then given to a company called Homelet who will conduct credit and employment checks on me. My job is secure, have been here over 15 years now, earn good money and my credit is about average with nothing adverse on my file. I have several credit cards but they are all clear of debt. For some reason I've myself into a fuzz that I am going to fail the check. Does anyone know what reason they would fail somebody for? Thanks in advance
  16. Hi, I have a question but will briefly explain my position first. I have 3 debts, first and second usecured loans and i believe will be removed september this year as the default status was september 2006 the last is december but a secured loan, i,m hoping and preying they will be removed cos this is stopping me and my family from pursuing a mortgage. I believe they should 100% be statute barred sept/dec 2012, however my only worry is on my credit report, well, 1 of them (the secured loan) was updated as follows. Date Updated 06/06/2012 Does anyone know what this actually means?, it clearly states D = DEFAULTED in the payment history december 2006 but last updated as above, i have not accepted the debt or made any payments ever to these companies, as it was infact not my debt anyway, it was ex husbands debt using my name, police wont do anything as its too old, the cra,s say nothing they can do, the creditors arn,t bothered when i told them it was harrassment and fraud but they didn,t reply , just recieved a form to fill in from ombudsman, I have not acknowledged the debt ever and can,t understand what last updated means, all i want is for these to be gone by december to get on with my life. Please Help, as i,m at my wits end and would really appriciate anyone who can help. Kind regard,s Claire
  17. I have come across this recent case Smeaton v Equifax, accessible for free on bailii. It has been decided that where a credit reference agency has not been complying with their continuing obligation of retaining accurate data, they will be in breach of the Data Protection Act, Section 13. Furthermore, if they have been negligently, by positive acts or omissions, showing wrong information about a data subject, the CRA's would be negligent and can be sued in negligence to reclaim any losses the data subject may have suffered. The CRA's have lost it to a litigant in person, and have now appealed it in the Court of Appeal, but it goes to show that if there are people who have suffered because of these people, you may be able to sue them. One point to note is about limitation. Cheers!! **Any information given here is not to be considered legal advice and should not be relied upon. 18. Hi all. I have been unemployed for almost 12 months, and have finally been offered a job. Obviously, I had to supply two referees, one of which was my former employer and the other was the manager of a day service for people with Cerebral Palsy, where I have been volunteering for the past 8 months. The problem is, my former boss has not responded to the reference request. I know employers are not legally obliged to give references, but I'm really really worried that having only one reference will jeopardise my chances. The reference they have received, from the manager at the place I volunteer, WILL be an excellent reference, I know. I've been working there, unpaid, 3 days a week, for 8 months and I know I've done a good job there. Do you think my future employers will accept me on just this reference? It's more recent than my last employment anyway, as I left in August 2011. The terms of me leaving my last job - I left of my own accord, because I wasn't happy there. But my boss had issues with my teamwork apparently, although nothing was ever said to me at the time. I was told specifically, when I left, that he wouldn't mess up my chances and would be prepared to supply me with a reference. I'm really really concerned, because I desperately need and want this job. I have one good reference, and I can supply character references or go back further, but I'm just really stressing out now. Any advice would be greatly appreciated. Many thanks in advance.
  19. I am currently in dispute with PAyday express over an account i have never had with them. i now find that they have made a credit search without my permission. 20. Hi, I was working in IT Consultancy for last 2.5 years. I have to visit clients site and spent good 2 years at one of our client for almost 2 years. Since they outsource their IT operations, I have to come back to our office in early this year. After I came back to our office, I never get any good work and just doing support. Then they start making my life difficult and finally they put me into disciplinary in bases of I am not doing good work etc. I am so stressed out and resigned myself. Now I am looking for job but no joy, yet. My question is, what should i say to job agencies about my current position? If i say 'i resigned because they put me in disciplinary', would it be acceptable to job agencies? They may start asking all kind of questions about what happened, which is painful for me to explain the whole thing again and again. What will be happen, if they ask Reference from current employment? What should I say? Thank you for your time,
