  1. I wonder if you can help. As i have stated elsewhere I am in a bit of a financial pickle I am trying to wade through it. I wrote to barclaycard about 6 weeks ago telling them that I was in financial hardship and could only pay a token amount £2 for 6 months etc - following the advice dx100uk has given to others. since that time they have written to me twice and bombarded me with phone attempts - up to 20 times a day! but they have not even acknowledged that i have written to them. Today i got a pay up or its Mercers for you boy letter. What should I do? Should I write again? I have kind of been assuming up until now that my letter was playing catch up with their system, but now i am wondering if they are either ignoring it or it got lost in the post/ lost internally.

Hi there I have heard good things about this website, and very very helpful people, kudos to especially the likes of 'thedogs[naughty word]' who can hopefully shed some light on this situation So i parked on a single yellow line, not realising, i normally park here always with no problems. THIS time i was late and a little negligent as i was already late for class Anyway. Honestly speaking i parked around 10am. Went out for lunch at 12pm and found a pcn on the car, now i made a huge mistake of leaving the car there as i thought i already have a ticket. The car behind me also received a pcn I went back into university and came back out again. Around 3pm. The car was gone I called police, trace etc and lead me to a private impound in white city. Who did not answer the phone. Very annoying. Anyway I finally collected the car etc (A) Paid £200 for recovery charge (B)£55 for the pcn Total £255. I am sure with all previous pcns, paying the pcn upfront eliminates any right to appeal, i explained this to the evil man behind the counter and he said it all needs to be paid now and challeneged after Am i right in saying, first of all the charged according to parking act 2007 are £105 for removal and £12 a day storages charges maximum These guys advised £200 plus £40 a day storage charge Can this be one ground of objection? Furthermore i found some scratches on the toof of my car I agree my mistake. I take it on the chin and happy to pay the £55 pcn after dispute that signs were not clear or whatever But are there any other grounds of appeal? Signs not clear? Did they remove my car unlawfully? I am a young student living away from parents and money is tight Thank u in advance for anyone who gets back to me If it helps. Its greenford road this all happene

I have defaulted on a logbook loan with lbl and they want to repossess the car what can i do I have moved address too but not told them and am trying my best to hide the car How can I get out of this agreement somehow pls help Thks ash Also does anyone know how Anglian repo will trace me to new address
  4. Hi guys, I was caught shoplifting at boots a few months back (which i'm not proud of). As i was leaving the shop, a plain-clothes officer stopped me and told me to follow him back to the store. I agreed, knowing what i had done. Along with him, there was a security officer who took down my particulars such as my name, my current college as well as my address. They decided not to call the police and told me to sign the RLP form as well as the ban from the store. Apart from that, they also made racist remarks on my ability to read or write. As i'm a international student studying in the UK and was about to leave the county for a school break back to my homeland, i could not pay within 21 days, which was the requirement they had given me. I called up RLP and requested if they could reduce the amount as i'm not 18 and whether a delay the payment was possible as i wouldn't be in the country for a few months. They agreed on my request to delay the payment for a few months and reduce the amount to £145 . Also, i told them that the address i had previously given them was a temporary address and i would update them my new address when i am back in the country. Reading through the forums, many people have said that not a single cent should be given to them, however i still have a few questions i would like to clarify. 1. As i'm about to renew my visa this july, will the RLP have any effect on the application? 2. Also, should i update them my new address and number when I'm back in the country? 3. If i do not update them, will they be able to track me down? 3. Will boots charge me in court if i refuse to pay up?

  6. I received a summons for a careless driving charge, which is due to be heard this weds. It relates to an incident last November, where I was speeding & did a stupid undertake-overtake on a dual carriageway. I was subsequently pulled by a Traffic car, who had video'd the whole stupid incident on an ANPR camera. I've been charged with "due care & attention", with the speed tacked on as aggravating - the speed mentioned in the coppers' statement is "in the region of between 100-115mph".This is not VASCAR, but ANPR - Now I intend to plead guilty by post, the charge mentions "this offence carries penalty points". I'm aware this could be a lot worse, but I can't afford a solicitor, & would appreciate any help with my statement. The copper's statement basically explains that he observed me join the carriageway, & accelerate at speed. He then mentions the above paragraph's range of estimated speed, then documents the undertake of a vehicle in lane 2, & then overtake of a LGV sightly further ahead in Lane 1. I really don't have much excuse for the driving, I am mentioning my previous good character, clean driving record, & lengthy NCB etc. Here's my intended response: Statement On (date removed) 2012 I was driving along *** Road, towards the A**. The road conditions were dry, & the temperature mild. On joining the carriageway, I unwisely accelerated, & inadvertently exceeded the posted limit for a short period. As I proceeded over the ***** Bridge, I approached a vehicle in Lane 2, which was about to overtake an LGV ahead in lane 1. I adjusted my speed to match the vehicle in lane 2, which I estimate to be 60mph. I decided to pass this vehicle in Lane 1, this maneuver was executed within the posted limit. I Then left the A** at the ******* Junction, when a following traffic Police car illuminated it's blue lights & sirens. I immediately pulled in. At no point did my actions cause any other road user to adjust their position. I was in full control of the vehicle at all times. I accept this was the wrong thing to do, & I regret my actions on this evening. I have been driving for 17 years, & have driven many hundreds of thousands of miles. I have a clean license, 17 years' No Claims Bonus, & I'm normally a careful, considerate driver. Now, this was a stupid lapse of judgement, I had been tailgated just prior to this & was p***d off about it, & drive stupidly for a brief time afterwards. I genuinely do regret it. I've had advice from another forum suggesting I leave that out, as it's not good mitigation, but I have NOTHING else. Any help much appreciated
  7. Hi After searching the internet for an answer I have come across this forum - I really hope you can help My partner has recently began to provide deliveries for his takeaway business. I have been parking in a close by loading bay after the loading only times are over (after 6.30pm) but have been harshly told today 1. that this road is not supposed to be used by 'private vehicles' (there is a steady flow of traffic through this road despite this!) 2. you need a permit to park in a loading bay unless you are a van or truck or bus Please note the delivery is brought to the car, the car is never left unattended, the engine is always running - the car is not parked and left. Oh, at least one other business provides deliveries and also parks in the loading bay, but they are actually parked between deliveries as the driver also works in the restaurant. Thanks for any help available

Hi, we are struggling to pay various debts at the moment, we have approached most asking for reduced payments, interest freeze, etc. However, CCA'd Next and they have openly admitted (in writing) that they cannot locate a signed credit agreement, please see http://freepdfhosting.com/626c0a8d51.pdf for full masked response from them. They also sent me some sort of account summary, which shows "Total Sales TD"of over £8000 which i assume is total of goods purchased, and "Cash Since Start" of £8700, which i think means i have paid them more than the value of the goods purchased ( have been making minimum payments for almost 10 years), but not the approx 30% interest they like to charge, which leaves the outstanding balance of approx £900 I'm unclear as to whether, in the absence of a true signed CCA, I am liable for the amount outstanding, given that i don't believe i ever signed a written credit agreement when i first bought goods from them some 10 years ago, and i have paid them more than the total value of any goods. Can anyone advise my best course of action in response to this letter please ? They have also obviously contradicted themselves by stating that the true copy must include "original name and address of the parties" which it does not (are they simply allowed to reconstitute another CCA which does ? or are they limited to 1 attempt to reconstitute it ???)

Tomorrow is the last day to write to them, I really appreciate your help I have received three of these cctv pcn on 10, 11, and 12 /01/ 2013 there is a photo of the location it was oposite 303 romford road. I went to an agency to discuss a house for rent three times and there was other cars tow or more parked there and I thought it was a parking place. I drove up and down the road for a parking space there was none before I fall into this trap and parked here.... there are two hours free parking or something there but they always full... Not being local and only was looking to find a house which I never got. any advise what shall I write to the council, to be honest I don't have £200, I only stopped for a five minutes or saw to ask the agency on the other side of the road to show me the house, it took them three days to show me the house hence I got three tickets.
  10. Hi Was having a chat with a friend of mine who is in debt. He has had these debts for over ten years. Last year he recieved some letters form a DCA and he started to make payments to them. He made no payments for over eight years. Would he still be able to claim he does not have to pay these anymore or because he has started paying does the six years start again. Thanks Fernal

Dont know if this is the right place but im in desperate need of some advice on the next step dealing with Martsons bailiffs after being extorted by £860 yesterday a removal notice was put through the door last week addressed to my partner xxxxx, bearing in mind we moved into his propety only 1 month ago. I called the number and told them she wasnt here and to go and check their information. That was was it then very early yesterday morning>>>>>>>> Bailiffs called our house phone & asked for xxxxx xxxxxx@ 07:30 am 18/12/12 xxxxx answered, said they were bailiffs and that they hadclamped the car an were about to tow it away. 7:32 I called them back, the bailiff Mr Gxxxxxx said he hada warrant to seize my vehicle and that it had been clamped on our privatedriveway. I then got dressed, exited & locked the house andapproached the van where the 2 bailiffs were in at the end of our driveway. The older 1 then stayed he was going to take my car &then come into the house via a locksmith to take my goods. I asked him why& on what grounds & he wouldn’t tell me and said the papers wre in thevan, his colleague meanwhile was frantically writing paperwork in the van onthe dashboard doctoring the warrant & fee documents. He then got very close in an intimidating manner and statedthat I was “beginning to f**k him off” I then called 999 as I was in fear formy safety and that of my partner & 2 young children I still at this point did not know the reason and on whatauthority they were treating us like this. I was then advised by the police on my phone to go inside& await an officer. They also advised me that the bailiffs had also calledthe police. I waited in the kitchen and still had no idea as to why mycar had been clamped and why this was all going on. The police then arrived to me after first speaking with thebailiffs and informed me that I had been acting in a threatening manner &intimidating the bailiff. I then gave told them from my point of view what hadhappened and in no way were they helpful and quite on the contrary weren’t reallyinterested in my version of events just in reinforcing the position &authority of the bailiffs. The police woman then went away to speak to the bailiffs toestablish why they were here. She then re appeared a few minutes later with afew documents which I was not allowed to touch or read initially. I was then advised that my car had been levied on because ofa parking penalty (which ive never had any notification of) for a vehicle that i sold 6 months ago and that they also had a warrant to enter myhome to take goods due to an unpaid fine relating to a criminal offence for mypartner Ms X. This is the first either me or xxxxx had known about theparking penalty, and xxxxx has never commited any criminal offences nor has acriminal record. I advised the police woman of this and was told by her thatthey had the court authority to carry out the actions the bailiff had stated.The Amount she told me I had to pay (as I wasn’t allowed a copy or to even readmyself at this point) was £429.82 or that the bailiff would seize my vehiclewhich would incur more costs. She then presented a court document and a Martsoncase details document with the detailing an printed outstanding balance £125.44although this had been crossed out by the bailiffs in biro pen to show £429.82!. This is the first time I have been contacted or dealt with by Marstons overthis incident and they have managed to clamp my car firstly then verbally &physically threaten me. The policewoman then hesitantly allowed me to read the documentsrelating to myself, I objected to her about the fact they had plainly justdoctored the document and she wasn’t interested & again re-iterated thefact that it was a court issued document and that it must be paid or they wouldbe taking my car. I then entered my house through the kitchen door from outsidethe rear of our property & informed her that I wanted to copy the documenton my scanner, the policewoman then put her foot in my back door and forcedherself in to take the document back. She stated that I may attempt to defaceor destroy the document, I again stated i just wanted to make a copy for myreference. - She then also mentioned they had a court warrant to enter ourhome to take goods for the debt relating to xxxxx xxxxxx and that too was £430exactly, although I wasn’t shown or allowed to see any documents relating tothis nor were me or xxxxx allowed to copy them. They were simply waived infront of me by the police woman as she again told me the bailiffs were acting onauthority of the court. After awhile it was established through the police andbailiffs phone calls to their office that it was not relating to a criminaloffence and that it was something to do with council tax although no further informationwas given as to the source of this debt nor do we still know any more about it. The bailiff then stated being re-enforced by the police thatif I did not pay the £430 for xxxxx theywould get a locksmith to gain entry to my property (as i would not invite themin, and the house was secure) to take mygoods using some domestic violence legislation. The bailiff then thrusted intomy face & then pulled back some sort of Marstons branded card stating thisand The police then reiterated they were acting lawfully & that they could& would do this if I didn’t pay the amount being extorted. I had no option than to pay both the amounts in full on thespot using family Christmas money and was given 2 cash receipts. The car clamp was then removed and I noticed they scratchedboth the passenger side sill + wing & also scratched & chipped thepassenger side alloy wheel. This seems like extortion by the appointed bailiffs with thefull backing of the Lancashire Police Constabulary. This has left myself &my partner plus our 2 young children traumatised & feeling completelyunsafe within the confines of our own home. We still do not know where the Debt for xxxxx hasoriginated. And the Marstons & court documents relating to the parkingpenalty notice for myself are all that I know about that matter. We moved house to our current property on 16/11/12 thebailiffs mentioned they had been trying to contact us over these matters at ourprevious address, although we received no correspondence or visits relating tothese. surely this isnt legal???
  12. hello all, i quit my first job 5 yrs ago when i relocated..i attended a first interview 10days ago in a well know co..wen asked, wat was i upto in past 5 ys, i told i tuk off to spend time with my family & applied for visa & work permit & by the time i got it, it was last year but the fact is i got my visa in 2008....i actually wanted to say that i strtd lukin for work since a year ! he wrote down somethin at my visa status on my resume ! i shud have corrected myself but i was so tensed attendin an interview after 7 yrs now i got a final intervw with vp.. i'm so tensed & guilty that i'm unable to prepare..this job would help me with my financial situation..i'll b interviewed by a diff person..what shud i do, say if the topic arises abt my visa status ! the date on my work permit is 2008 ! any suggestions wud really help me out here ! thankyou, yum
  13. Hi all, I have gone through the threads but cant seem to make sense of how i should calculate my PPI refund. Here are the details. I took out a loan in June 2001 for 12k with the interest @9.9 credit charge was 3113.40. The PPI on this was 2531.49 with charge for credit being 656.41 (@9.9) total PPI 3186.40- so my total loan was £18299.81 over 60 months = 305 pcm.My agreement shows monthly PPI amounts of £53.11 28 months later i took a new loan, consolidating the first loan and my credit card. ( i do not have the loan agreement for this but do know from bank statements what was paid. - Also am not aware if new PPI was taken out, although i don't think so) Loan 2- £245.16 x 96 payments = total loan of £23535.36- I made 9 payments However from my bank statements it shows that i took a new loan ( loan 3) - 9 months later. This new loan paid off my existing loan. Loans 3 - original amount of loan £24500 @ 8.9% = 96 months at 353.32pcm. This final loan was completed - the last payment was made august this year. I would like to reclaim my PPI from the first loan. If i am correct, it would seem the second loan paid off the remaining 32 months of PPI at the outset. How do i work out my claim. I have tried some of the spreadsheets available here but don't get - how i continue to calculate the "rollover" PPI from loan 1 and the actual interest on what was paid and with i can reclaim to when the loan was paid off and to the point from when my claim starts which i sent the questionnaire in Sept. Any help or rough calculations would really help. I would love to be able to learn how to do this but would need simple instructions initially- then i could get my head round it.. ps. from what i can make out- the PPI amt on the first loan was 21% of the loan ( using some of the guidance on here) and then on the second loan - the continued PPI loan amount repayment was 21.18 form the 9 months- then i get stuck. thank you in advance!
  14. Hi all, about 6 month ago i came into some hardship i wrote to very and littlewoods explaining this and that i would be paying X amount on both accounts. Of course they are not accepting this but i am every month without fail paying amount i said i would via internet banking. They have got Ndr involved now and i just dont know what to do i don't want to be dealing with debt recoverys as still paying shop direct. Any advice would be great. Thank you.
  15. Been called in by j p fraud investigation team to give me the opportunity to explain as they have grounds of employment and living with a someone as husband and wife . After some fishing around on what ive done wrong as i don't live with my husband and have not since 2008 due to my children from a previous relationship did not get on with him and we decided to live apart , over the past 4 yrs its been on and off but when my children go to my mums the odd weekend he will stay and as i live in his house where he still pays the mortgage any diy or gardens need to be cut he will come up and do them only cos ive got asthma and i ant doing it as they r big and up hill , he has his own place where he pays council tax and his bills ,ive been told that i will get classed as living together but iam not and i don't want to also they are accusing me off working which yes i am but its no more than 16 hours a week so i never declared it since 2008, which now ive just found out that i should of . Worried is not the word ive been told they will stop my benefit there and then , do they stop everything or do they just stop income support as i will hold my hands up to working and happy to pay it back as i believed i could work under 16 hours but i will fight about living with my husband all the way . Hope someone can help as i dont know what will happen thankyou
