  1. Can somebody please advise. The story so far in a nutshell. NRAM were granted repossession notice in Nov 2010 on arrears of 10k. We are paying it off and with the penalty payment that NRAM had to pay this year we now owe 4.5k. In August due to a finger fault the wrong number was pressed and they received £50 less than they should. Next that we knew Wallers were threatening repossession unless all arrears was paid. NRAM were contacted and they said that they could see it was an oversight/error but not to try paying the shortfall as it might play havoc with their system. They did say that the error meant that we had not kept to the court agreement so technically they could repossess. We went through the Income and Expenditure stuff with them and we thought everything was going alright. Got home from work this evening and there was a letter from Wallers saying that a Bailiffs appointment for repossession had been arranged for 4 weeks time. Where do we stand on this please?
  2. Hi all, I wonder if you can help? I have a personal loan with NRAM, was £20K but on a DMP and it now has £13K left. Paying £180 per month. Received a letter this morning saying that on the 28th, the debt will move across to some company called Marlin s thought I would call NRAM and see if they will accept a F&F of around £3K. They stated that even if accepted, it will show as partially cleared on my credit rating.... this worries me as I assume it will stay like tat for ever and also, I guess they can sell the remaining debt to someone like Marlin. Can I push for a F&F and request this is "closed"?
  3. Hi am after some help, my house is due for repossession on the 21st october by NRAM. I have arrears of just over £3400 and have been to court twice before but in September I lost my job which meant I didnt have the money to make my payment on time. I phoned NRAM who said this would be ok as long as I made the payment. I did make the payment but it was late and since then they have said ive broken the court order so they are going for possession of the house. I now have a date which is the 21st. I am now back in work. Since I last went to court I have made all payments on time just this one was late. Can some one help with my statement for court. Thanks
  4. Hi - Not been on a while but have had the following happen over the last few years - 2011 repo order applied for and granted, to let lie. Also an unsecured portion of the loan was made subject to a Charging Order - This last two weeks I have been lucky enough to clear arrears for the both loans - Mortgage and the unsecured bit, eviction was due tomorrow morning. What I'd like to know is, is the repo order still in force or should they nram, terminate it, they have stopped the eviction but was wondering what officailly happens with the Order ? also the unsecured portion is paid via payplan and is not in arrears now nor has it been for a while, should I have the Charging Order taken off ? by them too. Thank you
  5. Hi, Can I just say what a fantastic site this is and the way people go out of their way to help others is very admirable. I only wish I had found this site before tonight and there may have been a chance for me I have been reading a lot of threads regarding repossession and see that others go to court hearings having done loads of preparation beforehand. Unfortunately I havent and now fear I am going to lose my house on Wednesday 18th Sep. To cut a long story short, and of fear of boring everyone, myself and my husband (although mortgage only in husbands name) have mortgage arrears of £3785, well I have paid £1000 in the past week so now £2785 with NRAM and have a court date on Wednesday so very soon. We are also in Scotland so from what I read things are done differently here? We had arrears from Dec 2010 that we set a payment plan up to pay back. We stuck to this arrangement but NRAM continued with court action. They issued a calling up notice and we received a court date after but this didnt reach court as the arrears were cleared before then (March 2012). Things were fine from then and all payments made until Dec/Jan this year. Myself and my husband split up for 6 months and during this time my husband didnt really pay much at all ( not sure if this is because he has never paid a bill in the 15yrs we have been together or head in sand). He made a few part payments but the arrears are now £2785 having paid £1000 recently. We are now due in court on Wednesday and im making myself ill worrying that I am going to lose my home. My husband cant make the court case due to an interview at work for a higher paid position, so I will have to attend for him (im assuming this will be ok?). Im just really looking for any advice on whether I should have done something before now to prepare better for this as the paperwork from the court did not have anything to fill in, so I assumed I just had to turn up, explain why we were in arrears etc and hope we can keep our home, or god forbid, not.   6. Hi , i am looking for advice regarding a debt i am being chased for. Back in 2006, i took out the together mortgage with northern rock. Part of this was an unsecured loan. To cut a long story short,by 2007, i couldn't afford it any more and i left the house and the debt behind and tried to get on with my life. I realise now that what i was actually doing was burying my head in the sand! I heard nothing more about it until today when i received a letter from "drydensfairfax solicitors" saying i was still liable for the unsecured loan element.(£20881.52) From reading through various forums and message boards I have learned that after 5 years in scotland unsecured debt becomes statute barred. However I am confused as I see that mortgages may be slightly different. There is no mention whatsoever of the rest of the mortgage in the letter. Any advice on what my next course of action should be would be of great help.
  7. I redeemed my Northern Rock mortgage some years ago now but I've had a letter through this morning enclosing a cheque. The letter says: 'NRAM is committed to providing our current and previous customers with a great level of service. To ensure we maintain these levels, we have reviewed our previous Mortgage Application process and have identified that whilst your account is now redeemed, it appears that we made an administrative error when your account was originally set up. Therefore a cheque of £XXX.XX is attached to rectify this error. Included in this amount is £XXX.XX representing 8% simple interest on the amount charged in error.' Now I'm not one to look a gift horse in the mouth but I can't help feeling really suspicious about this. No bank I've ever dealt with has voluntarily sent customers cheques for errors - I mean just look at PPI claims and bank charges refunds. I can't help wondering if there is some sort of reasoning behind it - such as the error actually potentially requiring them to pay out larger amounts. For that reason I was wondering - should I hang fire from banking the cheque? Anyone know what this is about - the letter doesn't even state what the charge was!
  8. Hi, I am going through a divorce. My ex and I have a flat with a buy-to-let mortgage in joint names. There is some negative equity, about £15k. Mortgage payments are up to date, but a few have been a few days late over the last year or so. There are credit card debts - defaulted and now with debt collectors. We have decided that the flat should become wholly mine and want to apply to NRAM for an equity transfer. How likely are NRAM to agree to this? What are the criteria thay are likely to use when making the decision? Thank you, Sue
  9. Hi I wonder if anyone can help me, I had a northern rock together mortgage many years ago that I fell behind on and I lost my property. The repossession of the property covered the mortgage and part of the unsecured part of the together loan however part of it was still outstanding - approx. 10k. This is now over 6 years old and is statute barred. The thing is I have received a letter just recently from NRAM saying that they have reviewed their previous mortgage application process and have identified that although my mortgage is now redeemed that have noticed they made an administrative error when the account was originally setup and because of this have sent me a cheque for over 1k. The thing is although I would love to cash the cheque I am worried that if I did this would I be setting off the clock again for the unsecured part of the together mortgage as this is now statute barred I really do not want that to happen. So I am not too sure what to do, the letter does not say anything about the unsecured part and only mentions the redeemed mortgage but I really do not want to bring anything back to life from the past. Any advice would be more than welcome.
  10. Hi my wife and I are moving abroad in around 6 months. We have been trying to sell the house for the last 18 months to no avail. We have had the house since 2007 and have come to the end of the fixed rate period. We have a NRAM together mortgage total £127k (£112k secured £14k unsecured) the house is on the market for £114950 we have had viewing but no offers. We cant rent the house out as the rent would not cover the mortgage payment. Our credit history is already shot to bits from when my wife was redundant. We are sending money out to the "new" country to set up life out there however we are running out of time to sell the house over here. Once we move we will not be moving back here (other than the odd holiday to see family) We have contacted NRAM regarding voluntary repossession. they say no matter what we are still liable for any short fall - which there will be, and we will have to sign paperwork to say we agree to this. We may not be able to afford repayments to NRAM as well as the mortgage in the new country, however we don't want to go Bankrupt as we will have to declare assets in the new country and therefore put our future life at risk. Please could we get some advice as to what to do? should we give the house back to NRAM sign the forms and negotiate an affordable repayment, or do we just post the keys back on the way to the airport with no forwarding address?
  11. I currently have a 'together' mortgage with Nram, so this is part secured and part unsecured. The unsecured loan is in breach of cca regulations and have notified all customers affected. I am affected and due redress, how much still to find out, others have already had redress and terms changed to reduce X amount of years. Now my questions is - can they (Nram) decide how this repayment of interest is paid? Also can they change terms without your consent? Thank you in advance. C
  12. Hi My NRAM loan has been passed to Allied International credit. I wrote to NRAM directly in April telling them that my situation hadn't changed and I could only afford to pay a token £15 a month -my debt is £4949. I'm working with Stepchange at the moment to assess my options and have told NRAM that too. Unfortunately due to other family issues I haven't been able to progress this very quickly as I have other battles to fight for children at the moment and they have to take priority. I've been paying NRAM £15 a month but today received a letter from Allied. to cut a long story short I wondered if somebody could please check before I go any further with NRAM whether the CCA they've sent me on request is enforceable? I've attached in two pages and would like to know how much chance I have of keeping them appeased with a token payment so if the CCA is unenforceable that'll help and give me time to look at the rest of my debts, one of which is being pursued through the court by Lloyds at the moment.   13. i have got behind in our mortgage repayments and been in constant contact with NRAM. They told me that they would charge £90 if I refused to meet their 'field rep' so I called the 'rep' some weeks ago and arranged a meeting. I was to meet him at my local library but he didn't turn up but instead went to a different library in another nearby town. He says he phoned NRAM and told them I didn't show. Is he just playing games to wind me up or is there any point to his shenanigans? Anyone had a similar experience?
  14. There was a problem highlighted with the wording in loan forms when secured loans under £25k were taken out. All loans paperwork have been looked at and I received a letter today stating Some of NRAM communications taken out by certain customers did not comply with all of the requirements prescribed by the CCA. They have stated they have looked at my paperwork and stated that as the loan taken out clearly states the purpose of the loan was for home improvements (Conservatory) this loan is specifically exempt from CCA regulations. They then go on to say that there were references made to the CCA in the loan and account documentation that I have been sent in the past. These references were wrong and will not appear in future statements. We apologize for any inconvenience caused. This reeks if the paperwork is wrong it is wrong surely - any advice?????
  15. Like many people I have been refunded on my NRAM mortgage for the interest paid on a loan when NRAM were failing to provide the correct type of statements. To be honest I am happy to have the size of the debt I owe reduced and do not want the repayment in cash to me. In August 2009 I had to fight to stay in my house and had to go to the courts and ask for a repossession order to be set aside. This I was able to do. It seems to me that subsequently NRAM have been found to be in contravention of FSA regulations and have been ordered to repay the interest that had been paid from april 2009 to april 2012. In August 2009 they presented evidence in court that was wrong. ( They combined the 2 loans the mortgage and the advance and presented figures to the court that included interest payable on the advance which was subject to FSA regulations .) In efect they were claiming payments for interest on the advance for 74.20 per month that have subsequently been ruled against by the FSA. so : NRAM said I had payments of 420.20 per month to pay. FSA have had a look at the loans subject to FSA regs and have ordered NRAM to repay the interest on those loans going back to April 2009. So at the time of the hearing in the court in August 2009 NRAM provided statements to the court that were inaccurate. Can I have that repossesion order removed and can I have any expenses that NRAM added at that time removed as well? If i have not been clear it is because I am struggling to get my head around it. I might add that I was only able to save myself again from eviction this month due to the sound and sage advice I have found on these forums. I currently have 4 complaints lodged with NRAM and will be taking 2 of those on to the FSA.
  16. Hello there, this is my first post so hopefully I'm doing everything right! Five years ago my husband was given the opportunity to buy into the company he was working for, we had to do this using the equity in our home, as we did not have quite enough we were offered a Northern Rock Together mortgage, little could I have imagined how expensive this was going to turn out to be. Anyway five years on, we have somehow managed to meet all our repayments, never missing one. Things have been getting progressively more difficult for my husbands business and rather than make staff redundant he and his fellow Directors decided to take a 20% pay cut for a period of 6 months, thus making is very difficult to meet the mortgage repayments. We called NRAM with a view to going interest free for the next 6 months. We thought this would be easy as lenders want to help you if anticipate problems with repayments. I could n't have been more shocked when to even consider this request we have to supply 3 months bank statements, 3 months bank statements relating to my husbands business, prove we have tried to reduce our other outgoings and prove we have contacted one of these debt companies that help you reduce other debts, one we have done all this they still may not agree to our request. Maybe this is the norm, but I find obstructive rather than helpful and they obviously have no sense of urgency. Before I start to do all the things they are requesting I just wondered if this is the norm, having not been in this position before, I have nothing to compare it too. Many thanks

Sent a PPI questionairre claim to Northern Rock which royal mail say was delivered on 4th March, still hadnt received a reply to even acknowledge they had recieved it, so my husband called them today and they said there was no PPI account number attached to the paperwork, dont know if they meant the paperwork we sent in or their own?! Anyway, he was given Pinnacle's number and they have provided him with the account number. We want to send a SAR but after reading NRAM website it keeps mentioning to go straight to Pinnacle, is this correct? Northern Rock sold us the policy, and made out we had to take it, with no option to use anyone else. Then when my husband was made redundant he was unable to use the policy and got into mortgage arrears!
  18. Hi all, looking for some advice. Got mortgage with Northern Rock (NRAM). £135k secured on house and £25k unsecured loan to top up to value of house when it was bought. Bit is paid off by now (well, negative equity any way). Inherited some money from parents. What is better way now: pay off unsecured part of it or actual mortgage on house? If anything happens and i will not be able to pay instalments for both, only for house part, can they reposes house for pay off that unsecured loan or as it is unsecured they cant`t do anything? Just can`t get grip on that. I know I can go to solicitor, but trying to get some advice here first, as really value opinions here.
  19. I have had my 'together' Mortgage with NRAM for 7 years. It comprises of £25K unsecured loan and £150K mortgage. I have never missed a payment or been late paying. However, I bought a new build house 7 years ago and we are only just climbing out of negative equity. The house is currently worth circa £180K and my liability is around £175K as it is an interest only product I have. I am paying 5.99% IIRC and what hurts is my next door neighbour (same LTV & property but different lender and rate) is paying £400 a month while I pay £750 a month. I want to change lenders as 5.99% is an insane amount but obviously, with only 5K in equity I'm lost as to which mortgage company might look to take the mortgage over. Can anybody point me in the right direction please?
  20. Hi No doubt, lots of people will be aware of the total mess NRAM has caused with regards to the wording in their statement regarding the repayment of interest on loans under £25k. If not, here is an article... http://www.guardian.co.uk/business/2012/dec/11/northern-rock-loan-blunder-270-million-pounds I am myself affected by this "mistake", which basically means that I have paid more money to NRAM than they are legally due. Now according to the wording in the letter received, NRAM will not be paying cash refunds. Instead they will be amending the amount owed on the Loan. I for one, am not happy about this. If I have overpaid NRAM any amount of money that they are not due, then I, like other should be entitled to receiving this money in full to spend any way in which I see fit. This is legally my money and NRAM had no right to take this from me. This money could have been distributed elsewhere and I feel that I, or rather everyone affected should have this money refunded in full and not just "redressed" to their account. If anyone can offer any advice on the legality of this I would be very grateful. The fact that NRAM has taken money which they are not legally due to them should be enough to justify a cash refund. Remember not so long ago the drama regarding Energy Companies withholding Customers credit? Same thing, is it not? Also, to clarify, this is my current standing with NRAM. - Together Mortgage taken out Pre-April 2007 - Unsecured Loan part of Mortgage under £25k - Currently up to date with all payments, no arrears, never missed a payment! Any thoughts or people in the same boat, would like to know your thoughts.
  21. Hi, just wondering if any one can help me. NRAM are trying to evict me from my house. I went to court for not paying my mortgage this july and got a second suspended eviction order. I have now broken this order again by missing 2 payments this was silly of me but my car broke down and needed to by another car for work as no car no work. I have phoned NRAM and told them this but they are proceeding with the eviction. I did another income & expenditure form over the phone with them and sent in everything they wanted ie Bank statements & Pay slips and even made them an offer but after waiting to hear from them they have said they want full arrears of £4500. I have not been given my eviction date yet so should I proceed and go to court as I do not want to lose my home.
  22. We have arrears with our Nram mortgage it is less than a months payment. We got in this situation due to a one off large bill. We can continue to pay the agreed monthly payment and then to overpay a bit each month. i rang up to offer this and was told they could not agree anything until i had done an income and expenditure form I said i was not prepared to do one over the phone as i had no information to hand. They then said that they would send a form and rearrange a return call. I do not want to do this What are my rights as they are still phoning all the time
  23. Hi Ell-enn/all, NRAM are taking me to court on 12 Feb 2013 for possession of my property. I have read your very helpful guide titled 'Dealing with the threat of Repossession or Eviction' and have picked up several tips in order to put forward my defence. My circumstances are that due to depression (for which I was on medication) I was unable to maintain my (self-employed) business and fell into arrears (about £4,500 on a monthly payment of £898 (interest only) at the moment). I am currently actively looking for work and claiming benefits for my wife and I. I have no current income (and savings that are heading towards zero) before the benefits kick in (which shdould take a few weeks from here) so I am not able to maintain my current contractual mortgage payment (or work to clear the arrears) until I get a job (hopefully in the next few months). Other than following your guide (i.e. showing evidence of my illness that caused my work issues and a copy of a recorded delivery letter I am writing to NRAM tomorrow (referencing conversations I have had with them)) is there anything else you would recommend I give to the court before the hearing that would be beneficial for me? Is the fact that I cannot offer payments to NRAM at the moment until benefits/job kicks likely to be quite bad news for me via the court? Many thanks.
  24. First off, hello all! I've decided to join in on the forum to let you know how I get on with a PPI complaint against Northern Rock (£7k personal loan). I borrowed £7k over 36 months in Jan 2008 via a telephone application. Sales guy at NR told me he had run everything through the computer and it was recommending I took out "Gold cover" (sic) and that the success of my application sort of depended on it. I never thought any more about it and paid off the loan early (Feb 2010). It was only when I was looking at my credit report online that I remembered it! After my initial claim form ended up with Bradford & Bingley (who dismissed it), I managed to get hold of NRAM again today only for the assistant's PC to crash after 15 minutes of me providing details. Next person I got passed to basically told me to sod off as I had no paperwork and call Cardif Pinnacle and ask them if I had PPI. She claimed it would show as a separate payment on my bank statements (which it didn't) Called Pinnacle and managed to confirm I did indeed have PPI and they supplied me with a policy number which was the loan reference too apparently. So back to NRAM and after 1 dropped call and 1 non-answered call (:-x), I got through and have now started a claim. Strange that they cannot simply do the same search that Pinnacle did! Anyone estimate what the interest rate would have been on a personal loan back in 2008? (Trying to work out how much the PPI portion of the loan was!!) Anyway, I'll keep this thread updated with how I get on... I did submit a complaint to HSBC a year or so back regarding their PPI on a credit card but they dismissed my claim as I had signed a box on the paperwork to accept the Ts & Cs of the insurance and I never got around to taking it further...

The possession hearing was for 27/11/12 - the arrears were cleared by 30/10/12 - I have received an 'adjournment' letter today, and then spoke to the solicitors about it, they said it would remain open for 12months, is this correct? When I last spoke to NRAM they told me the case would be dismissed, and is that what the judge would do? I am very concerned about these tactics and are they legal? any advice would be greatly appreciated.
