  1. Hi, can someone please advise on the above? I am reading here that I shouldn't ignore. I had read on other forums that I should ignore. I have jotted a letter up basically stating that I will not pay due to the fee being disproportionate and according to the unfair consumer contract regs the charge must not exceed the cost to the landowner etc. I have also put that the signage is insufficient (which it is) so I was not made aware of the terms and conditions as I didn't see them. So I have not entered a contract etc. Is this the right thing to do? basically I have parked in the said place for years at night, but it seems NCP have arrived and changed the rules there. I was not aware and parked there as I have done so for the past 5 years. There is no lighting and I genuinely wasn't aware of the such new inforcement so I didn't buy a ticket. The ticket price should have been £3.50 and the fine is £100!! I hope to get this letter off today so appreciate any help as I do not intend to pay this 'fine'
  2. Hello CAG, First post ever... have been a lurker for a long time, and now need some advice myself! This is the email sent to NCP on 12th December 2013: ----- Dear Sirs, I have received PCCN#: (photo attached) this evening after parking my vehicle at your car park at Ickenham Underground Station. I have contacted the number on the parking ticket itself to report that the machine is FAULTY and they have asked that I contact yourself in regards to the PCCN. Upon purchasing my ticket on MONDAY 9th DECEMBER 2013, your machine did NOT state the expiry DATE or TIME. Just the PAYMENT AMOUNT and the DAY/MONTH. No expiry TIME was shown. The machine is STILL doing this. Please see the attached photo this evening which shows exactly the same as Monday, and just shows the expiry as FRIDAY. This to me, as the consumer, means that parking is covered for the WHOLE of the day, not just until 02:59 on THURSDAY/FRIDAY as this is actually printed on the ticket. I aware that it’s up to me to check the ticket issued is correct via the machine, but I was in rush on Monday and just put my card in, chose the number of days, so pressing + to move the day till Thursday and pressed the green button... If I had known I needed to buy the ticket until 02:59am on FRIDAY, I would have. Please be aware that I have been using the machine and the one at North Ealing underground station for over SIX YEARS so have paid a substantial amount of parking fees to your company, let alone the parking fees I pay when in other towns and city’s across the UK. And, to be honest, as the machine just STATES on the screen, THURSDAY, then in effect this means, the WHOLE of THURSDAY. If you have any queries in regards to the above, please do not hesitate to contact me. Kind regards, 123NeilyB ----- NCP then replied back on the 30th December 2013, saying basically my fault... should have checked the ticket, and YES, in theory I agree with this but on the type of machine in the NCP operated London Underground car parks, if you have to park more than 1 day you press the '+' button to increase the day, which I did and scrolled it along to Thursday, and even though ive been using different car parks with the SAME machines, didnt clock (haha) that the expiry time was missing. In my eyes, the MACHINE was faulty and sold me the wrong ticket. If the time had been working then I would have paid for the extra day... NCP included the link to POPLA, which I have done, and appeal hearing day is this Thursday, 6th Feb. What do you think my chances are of POPLA telling NCP to cancel the PCCN? All in all, I owe NCP a days parking in effect, which is £4, but they want £75 as per the PCCN (no discount for early payment either!). I have attached a photo of the machine, which if you look above where there is a small dot, that part should display the time... Cheers, thanks & keep up the good work!
  3. I have an interesting issue with NCP at the moment and a PCN issued for a car park run on behalf of the train company Greater Anglia. I use this car park from time to time and pay using the Ringo App on my iPhone, have used it for several years and had no problem until now. I recently used it to pay, all fine, but what I didn't notice is that the App issued the ticket to a car I no longer owned even though the day before it issued a ticket correctly to my current car. The old car was deleted from my account but for some reason it has re-appeared. It isn't very clear when the electronic confirmation appears to verify you have paid which vehicle it is for so easy to miss. subsequently I have received a penalty notice for parking with out payment even though technically i have paid NCP. I am arguing that this is an administrative error and that there is intention to pay, and payment has been recieved. NCP are rejecting that claim. Any ideas anybody???
  4. Hello there, Could someone point me to the most recent 'Standard' response to a parking 'fine' please? I only need a bog standard one because I paid on a Friday (up till 4am is the NCP time limit for some reason), went to London on the train, stayed over a friends, and the following morning paid for an additional 1 day's parking via RingGo..... it appears the 'fine' was timed at 9.30am but I used RingGo at 10.15am..... i found the fine at 6pm when I got back to the station. Thanks guys and gals!
  5. Oh, dear looks like NCP have issued this ! What are the chances of being taken to court on this one???
  6. Hi I parked at a rail station, forgot to pay until 90 minutes after I parked and then paid by ringgo. In the meantime I had got a ticket. I appealed, stating that I'd paid by ringgo. NCP has now rejected my appeal. I've read all of the threads and am considering ignoring this and everything else they (and any subsequent debt collectors / solicitors etc) send me because of the advice on this forum, but I wanted to get some reassurance that by appealing with the reason I gave I should still go down the ignoring route. Any advice would be appreciated! Thanks Mike
  7. Last week I was driven to a shopping area and used a PRIVATE NCP car park, We obtained a ticket and drove in, we found a Disability Parking Area and I displayed my Blue Disabled Badge on the Dash Board. When we returned to the car, a Fixed Penalty Notice was attached to the windscreen, stating I was liable to a £100 charge because the Badge date had expired. The date had expired without me noticing, and Social Services are now arranging a replacement. Can NCP really apply this charge. Have they any right in law to enforce such a charge/ The NCP note says. Parking Contravention Charge Notice
  8. i think this will be an ignore one but i will ask anyway (you are friendly arent you ) went to preston railway on my motorcycle over this weekend found out previously that bicycles and bikes could be parked in the cycle bay which is on a platform this was confirmed by the helpful chappie at the taxi rank with a rail jacket guiding people about bike was parked end on to the bike bay as there was a concrete plinth at the end of the bay stopping me putting the bike in parallel with the others (it was fairly full also) so it was parked in front of the plinth and chained up came back this morning to find an ncp parking contravention charge notice on the bike- says on the back (7) causing obstruction bike was clear of the entrance and there wasnt anything immediately around it to cause access issues as it was on the station and not in the car park can they enforce it? thanks mark
  9. Please help. I got a 'speculative notice' from an NCP owned car park in Edinburgh for failing to park within a bay. Won't bore you with my excuse, but I had a good reason. I have no intention of paying the £120 demand (generously reduced to £60 if paid within 14 days). Am I right in thinking that I can just ignore all the threatening letters likely to come my way, or are things different under Scots law? Does Scotland's small claims court system make it easier for them to take action? Thanks for any advice/help.
  10. Silly me! Blue Badge application in for renewal, I had completely forgotten that my current badge would run out. SO I got a ticket. As I have ongoing entitlement to the badge, can I claim forgetfulness as a reason not to pay? PS I am not a new CAGGER but have a problem finding which email address I used previously as not been here for a couple of years
  11. Hi guys several months ago i parked at a network rail carpark, im a railway subcontractor and i had to measure up some fencing i didnt have any change but i was only going to be 5 minutes so i chanced it, but got a ticket. After some investigation the advice was to ignore it as it is unenforcable. The vehicle is registered to my company which they got from the dvla but they have no idea who was driving. After several threatening letters which i ignored they have passed it over to a debt collection agency who want £129 and the threat of considerable cost to myself if i ignore it. should i pay it? many thanks in advance
  12. Hi, Just looking for general advice on a recent ticket. NCP at Milton Keynes - Parking Contravention Charge Notice £35 up to £70 after 14 days. Reason - no valid ticket displayed. We had a valid ticket at the time which had blown off the dashboard in the windy weather. I still have this ticket. I spoke to the parking attendant who gave me the ticket who showed me 2 photographs of my car without ticket in windscreen. Given the fact that I don't actually owe them any more and that they didn't lose out on any money as I had paid and have proven I'd paid, is that sufficient reason for me feel confident in ignoring the impending demand letters? I sent an appeal on the day of the ticket being issued which has since been rejected.
  13. Hi i went to get a ticket from a machine in an ncp car park, the machine would not take my money, then it stated that only credit cards... i went to get my credit card and received a ticket within 1 minute of looking and parking. please help:mad2:
  14. I got the following notice, having paid and displayed the ticket but seemingly parked in a permit bay on a SUNDAY when it wouldn't even be used by permit holders in any number. I wasn't aware I'd parked there and although they were markings on the floor they were not in a good state of repair. NOTICE OF BREACH OF TERMS AND CONDITIONS OF PARKING AT A CAR PARK OWNED OR MANAGED BY NATIONAL CAR PARKS LIMITED Location: Shenfield Station SP Contravention: Parking in a permit bay without clearly displaying a valid permit Parking Convention Charge of £75 is now payable within 28 days. A discounted amount of £50 will be accepted as full and final settlement if received within 14 days. I'm sitting tight on the advice here, and successful conclusion it seems!
