  1. This is in the Scotland forum because I live here, but if it would be more appropriate elsewhere, please move it. I recently wrote to Kensington regarding the interest rate that they are charging on our mortgage, which I believe to be excessive. They wrote back (and I quote): I've just checked the current LIBOR rate - assuming that they are referring to the 3 month rate - and it is 0.50813%. This is more or less the same figure as at the start of December. Surely this means that the current VR should 2.55% (rounding up to the nearest 0.05%), not 3.50% as they have stated? They seem to have pulled an extra 1% out of nowhere. Or am I misunderstanding where they get their figures from? Can anybody enlighten me?
  2. I've been looking at miss sold mortgages do most people go to a firm with no win no fee or go to a solicitor or DIY themselve? I first purchased my property from my local council through my bank on a right to buy. I took out a loan with my present company secured on the property 6 months later this same company sent out with regards remortgages by letter. They offered a self certified mortgage with a fixed rate for 3 years,consolidated some loans and released money for home improvements,It had early redemption figures added to it if I sold my property within 3 years.It has a redemption fee of 250.00 if the house is sold.Added into it is the completion fee as well as the Legal Fee. On the application only loans/credit cards show as any financial status no household out goings.On the mortgage illustration and offer it states that 'The terms of this mortgage reflect past or present financial difficulties'. They sent out letters stating that they might of miss sold the mortgage.Then later on they seemed to want people to move their mortgages to their Business Partner.They stopped lending sometime later which they never told me about so when I had difficulties they couldn't offer me anything else. I'm tied in by the interest rates which are linked to the Libor rates which are 9.44%.They'll never go down only up.The mortgage also goes past the retirement age.
  3. Does any one know please how to complain re mis sold mortgage? I had a company look at it I have a case but they said to pursue it my self as having debts would be unfair for them to add their charges to my debts. I am not sure what to write and do I go to the mortgage company (db mortgages) first? Any help appreciated. Thank you
  4. I am looking for help with a claim against Mortgages plc, regarding the unfair charges applied to the mortgage account when in arrears. I have filed a allocation questionaire recently, The claim is for less then £2000, but the defendants solicitors want the claim struck out and have also requested a fast track proceedure. The claim was presented back during the bank charges period and ended up being stayed. I managed after some time to get the stayed lifted and a new particulars of claim accepted by the judge. Mortgages Plc also claim that the account was with their sister company mortgages 2, but all the correspondence, and mortgage payment were made to them.
  5. Hi my mortgage was with gmac from 2001 to 2009 hit with dd charges and late paments 50 pounds a month these were added to mortgage arrears i calculated at least £3500 in charges what can i claim back plus interest
  6. I have read of many individuals considering attempting to recover mortgage arrears charges and I have read the FSA's statements on the subject but I have never read of anyone successfully recovering a meaningful amount of mortgage arrears charges back. Have you?
  7. I have two mortgages coming to and end in April 2013 and both have never been in default with a missed payment. I have written to Messers Topaz Finance plc and Ameber Homeloans by ecorded mail that both propertiteis are in negative equity and to sell them will leave me with owning them money i do not have. Both Companies have come back and stated that they will be exercising the natural redemption on the appropriated date. Can some one please point me in the direction I should be going I used treating the customer fairly it falls on deaf ears
  8. hi i have paid my arrears now i need to claim the money back .My interest is 4.34 and i used spreadsheet but something is wrong . my charges om the account is £576.27 can someone please look on the spreadsheet and help me to put the claim through i think maybe i am using wrong spreadsheet or the interest thanks [ATTACH]39983[/ATTACH]

  10. Have received a letter from Acenden stating my claim is out of time. Mortgage redeemed in 2006, but I only found out about mortgage arrears claim back after browsing for PPI information. Could I use this in my follow-up letter - as they consider it to be 'inappropriate to consider any fees applied to an account over 6yrs old!' Any advice on how to word this 'appropriately'.....
  11. I need advice in regard to Redstone's inability to reply to correspondence. I jointly owned a business which unfortunately closed July 2011 due to financial problems ( Care Home ). I advised Redstones in August 2011 both by letter and telephone about the situation and asked to pay interest only and also explained that the property with the support of Barclays business who held the Mortgage for the business was hopefully going to be turned into a House Share for Students etc. They duly sent me Income & Outgoings form which was filled in and returned, i also told them that i could only pay up till September 2011 the full mortgage amount which was £937.23. I was put on Interest only on January 1st 2012!!. Which meant we had arrears of £2174, as i had managed payments of £200. As i am now 60 i had some Annuity money and managed to pay off the arrears as we had letters threatening court action etc. T he interest only finished in July 2012, Redstones sent me another letter saying that my full mortgage payment would be commencing, if i disagreed send back the Income & Expenditure Form etc, which i did and a letter explaing that the situation had not changed, i am working part time only. The House Share is not full and due to the financial situation we are in i need to stay on interest only for the foreseeable future. I received a letter in August stating that due to my assumed income from the lets my Repayment Mortgage would start 1st October 2012 0f £1,044 per month. I wrote to Redstones on 9th September 2012 sent by registered post in i asked for a reconsideration of their decision, which included Breakdown of my business debts, Bank Statements which showed income from the lets, Barclays Mortgage Agreements this was signed for on 11th Sept, i have had no reply to this correspondence . I have also written to them on 7th October. On 15th October they attempted to take £1044. 82 out of my account which bounced so i a now in arrears. I have major hearing problems so it is easier to write to them as when i have telephoned them in the past they try to get me to agree to ridiculous payments. Do i have a case to complain to FSA due to their lack of communication as i am under the impression that they cannot implement full mortgage payments if i can prove Financial hardship and that i am in dispute and they haven't given me a reply. I am at my wits end with them. We cannot sell the Business property as it is now in negativee equity Sorry it's so long
  12. Hi there, Very new to all off this, but had a couple of people urging me to claim. Long story short, i got a mortgage at 21 had a few loans for improvement remortgage at 23 and brought a shop unfortunately unsuccessful, i had done a little bit of research mainly on here for companys i had used for loans what i am wondering is are mortgages paying out too ? brief history april 2001 mortgage 40000 (25yr) - paid off in november 2002 may 2001 egg loan 1yr (believe it was a yr loan) paid of in 6 months (think this was paid not reloaned) poss december 2001 egg loan 7000 (5yr) paid off in may 2002 may 2002 ocean finance 12000 (5yr secured) paid off in november 2002 november 2002 birmingham and midshire remortgage 60000 (15yr) paid off in april 2004 with a cheque for 2000 ? and was reposession when shop went soar and that was difference of what it sold for and what i accrued i debt (74,000) it sold for. They told me i was around 1800 in arrears. Does it look like i may have a claim or is it clasping at straws
  13. Hi has anyone heard of a company called DMS (Debt Services management Ltd) their letter head says they are members of the association of arrears mediation. First thing is - is this kind of service any good and will it help. Bit of background. Have a friend who is in arrears to the tune of about £1,500 on their mortgage due to short term problems - they did bury their heads a bit. They brought a letter round to me this morning from this DMS stating that they would be calling in the next few days to discuss their arrears and possible repayment plans etc. that is affordable and agreeable to the lender. the letter was dated yesterday. i said to leave it with me and i would try and find few things out. After he got home from seeing me he had had a letter pushed through his door from the field agent of this company. (Bit quick) The couple concerned are now both back in full time employement and able to afford to pay their mortgage and a little extra to clear the arrears - though this will take a little time. Any advice on what they should do? I could do a repayment plan for them or is it worth using this DMA firm - or is that a no no and rip off, (as my instinct tells me it is)
  14. Hi, I thought I had opened a new thread but I can see it so starting another one.. I had a paragon mortgage, I took it out in October 2000. I had the mortgage until 6 yrs ago. I was going through some old documents looking for something and I realised that I had been paying PPI on the mortgage. So I phoned them up and asked them if this was the case, the person I talked to went onto my account on his computer and said yes you did have PPI you need to write to us, he then gave me the address and told me to write to their PPI complaints department. So I did that on the3rd of July. today I got a letter from them saying that Thank you for your letter dated 3rd July regarding the alleged mis-selling of PPI appertaining to the above account. I would add that the policy was taken out in excess of six years ago. As such, any allegation relating to the mis-selling of the poiicy would be statute barred under the Limitation Act 1980 whether such claim were brought in contract or as an allegation of negligent mis-statement. I trust this clarifies the position. I know they still have all of my information, the guy on the phone went back through it while i was talking to him. Is there anything I can do, I though that anything to do with a mortgage was not statue barred for 12 years?
  15. Please can anyone give us advice... Back in 2009 we were in arrears with rooftop mortages and it went to court - we were give a suspended possession order and had to pay back £100 on top of our monthly payment which we kept up with well at first but did struggle to pay on occassions, called rooftop explained and was told it was fine each time. A couple of weeks ago rooftop sent us a letter saying we were £700 pound odd behind with this order so we requested statements to check the amount was correct, we did and it was - called and said we couldn't pay it all at once and also that this month we would be late paying our monthly payment but paid the £240 we could pay then. They told us this was fine and that they would not take our home over a small amount like that. Today we got letters saying that as the order from 2009 has not been adhered to they are putting in at court for a warrant for possession of land and that we will be notifed in due course of the eviction date. We have been staying with family a couple of days and have just arrived home to find the letters hence why I am on here so late Please can anyone advise if this can be stopped and what we need to do, I can't lose our home, im so stressed and upset and don't know what to do Been looking on the interenet and am getting so confused Thanks so much
  16. Evening all I thought i would post a new thread as i need as much accurate information as possible! Me and my girlfriend have decided to buy a house, I need some information as she has a great credit score and has been accepted in principal for a mortgage we need, I have a very bad credit score defaults etc... So how does this work so we can protect her great credit score: Am i right in saying as long as we dont no apply for something jointly we will not be connected financially? If this is correct how do we go about, Council tax etc Can i get my mail to my new address( My debts) Thanks in advance for your help Im on a journey!
  17. Can anyone help me sort out a claim for being mis sold a mortgage, is it true that this only applies to residential mortgages or does it also cover buy to lets? Also, is there a timescale in which you must claim? Has anyone ever done it sucessfully? Has anyone used one of these companies who do it on your behalf, like the PPI ones we constantly get hassled by! Thanks all

  20. Hi Everyone, I need your help. I had a mortgage with Halifax in 2004 and started having payment problems because I lost my job. Halifax started harassing me with phone calls, demand letters etc - all what this did was stress me out, in the end I went for help at Citizens Advice Bureau who recommended bankruptcy, so was made bankrupt and the hosue was sold. At the time I was not able to think right of any insurance in my mortgage because it was included in my monthly payment. Having checked the insurance document, the Halifax Insurance Ireland Ltd should have paid for my mortgage during the difficult time of my unemployment, unfortunately this did not happen and therefore lost the house and all the money I had paid into it and the house was repossessed. Could someone please advise me on how to claim this back from Halifax.
  21. Hi Everyone I have had a mortgage for what seems a lifetime with the Halifax (1985/86). This was on an endowment basis. I have subsequently transferred to a repayment tracker mortgage before the proverbial hit the fan. Over the years i have successfully staved of one repossession order, but i have another for which i have made an arrangement for. I have decided to try and get back the various charges that have been levied on my account, and I have just recieved the DSAR information from Halifax (3inch thick pack). Question. How far can I go back? I have noticed that way back 2007 i was paying repayment insurance, Is this the same as PPI? (i was self employed then) Peter
  22. hi we have found out that our current mortgage lender has sent letters to some of it's customers encouraging them to go to a new lender and they they will waiver the fees and even pay them money to go... we want to move but are concerned about the fact we will have to pay a penalty as we are still in a fixed rate mortgage...do you think we will have any chance of getting out of the penalty given that the option has been offered to other customers...
  23. I have just attempted to start the process of small claim court action - and where you inpit the address, as SL's address is in Scotland it wont let me continue... Can anyone advise me on what to do? STANDARD LIFE WAS BOUGHT BY BARCLAYS recently - should i be suing barclays instead?   24. Residential market update There was an improvement in market conditions in April according to the RICS. Fewer surveyors expect price falls, new buyer enquiries stabilised and sales rose slightly. The number of housing starts was 22% higher in the year ending in March 2011 than the previous year. While this shows more activity, the RICS has warned that house building is still at historically low levels Cost of running a home still rising The average annual cost associated with owning and running a home rose by 1.4% from £8,956 in March 2010 to £9,083 in March 2011, with gas and electricity charges and maintenance being the highest risers.
