  1. Hi all, we have a problem with the NatWest. We have no overdraft facilities on our account, yet the NatWest got our account overdrawn with charges for charges for charges.. get the picture? Anyway, we have not had my husbands money go into the account for that reason and have been on the phone to them numerous times over this, with no success. On saturday we received a letter of notice of intention to register a default notice. On the front of the letter it says they are giving us 28 days form the date of the letter, which was printed on the 9th october. Now on the next page they tell us to make payment by the 26th october. Tell me I am dumb, but that is only 17 days not 28, thats not even just working days.. i have scanned both letters, but I can't attach them as I have not posted 10 times yet :/ maybe somebody could shed some light on this for me? Isn't that illegal? Any help on this would be very much appreciated. thanks daniela
  2. Hi, I returned home from work yesterday to find 2 hand delivered letters from Newlyn waiting for me. One is not for me but is for my wifes son who no longer lives with. I only assume this is from newlyn also, i haven't opened it but from the contents of the letter addressed to me i can only assume it is for the same or similar. The letter to me states that newlyn have been instructed by Colchester Council to seize and distrain my possessions for the outstandng amount of £475.84 for a road traffic contravention dated 23rd October 2011. I have no idea what this is! I have not received any other letters from colchester council or newlyn about this! The date of the alleged offence is about a month after i moved house so i suppose some post about this may have gone to my old address as i have no contact with the current tenants at my old address. I recently managed to clear my name with HMRC from alleged tax credit overpayments after a 2 year fight and i don't intend to be hold to ransom by these people for some unknown reason! What should my first steps be and how long do i have to make them before a second visit? Many Thanks for any help.

After all the trails of this last year with Housing benefit, they suspended my claim in January 2012,, the asked for evidence Bank statements going back to August 2011 wich were duly handed in. 2wks later they say they know of another account in which transfers were made from, which is true but was one back in 2009 but had no funds in the account when I applied for HB and JSA and in actuality I gave them the account details, it didn't come from them, plus all of which was handed into the compliance officer. So since February i've literaly been handing in the same documents, even when they moved the goalposts and have handed in statements from the begining f my claim, inlcuding the defunct account which is closed and has had no activity. This has caused horrid problems with my landlord a housin society who tried to have me evicted back in June, that was suspended until 2nd August when I appear in court again. I feel that I'm being harrassed and they are working in conjunction with the housing society (hence why the judge through it out the last time) now the investigator who wasn't available prior intiial evction hearing has since returned 3wks ago and despite several letters/phone calls has now told me that a formal interview is planned for 24th July a mere 10 days before my next eviction hearing. Where can I go for advice I've no money will the CAB be able to have someone in court with me, I've no idea what is going to happen, I literally cannot give any more information that asked for. I've proved I don't have or never have had the excess capital the statements bear that out and yet they still persist, I fear my eviction will go through on the 2nd August and why has it taken them so lon to resolve this 7 months.   4. Hi All, I’m new to this forum and would please like some advice if at all possible. This time last year I got myself into a lot of trouble with payday loan companies. I could not keep up to date with all the payments and extortionate charges were added. As I could not repay them all, they would empty my NatWest bank account as soon as I got paid, like dogs fighting over a bone. All taking whatever money they could get out of the account. This in turn left me with no money to pay mortgage, loans etc... I spoke to NatWest and they stated that they could not stop these companies taking money as they had my card details. As any logical person would do, I cancelled my card, this did not stop the same happening the next month. After this happening for a couple of months, I received a letter stating that the account would default in 28 days, as I had missed several monthly payments on my loan and lots of NatWest current account charges added. I contacted NatWest and explained my problem again to the collections team. I was advised by them that I should open another account and allow the account to default, once this had happened I could arrange a reduced payment plan for the debts owed to them. I took their advice and opened new bank account, with a different bank, with wages paid into them. This allowed me to set up payment plans with PDL companies and start to get by finances back on track. 28 days past and no default, instead lots of charges added to my account. I phoned the collections team and went through the whole story again. Again I was advised to let the NatWest debts default. Another default letter arrived about two months later, stating the account would default in 28 days. Again after 28 days the account did not default and more charges added. I finally decided to make an formal complete, stating that I had not been advised correctly and all the stress I was under regarding this issue. The complaint was made over four months ago. I keep receiving letters stating that the complaint is taking longer than expected and further time is required to investigate. This has happened three times. The whole episode has been going on for roughly a year and still nowhere near conclusion. Is there anything I can do to take this matter further, because the stress is becoming totally unbearable? If the bank issues a formal demand on a joint account does that formal demand have to be made on both parties that are named on the account? or can they go after one party and then move onto another party after exhausting measures with that party? A formal demand was issued to my Father and not to my mother (the demand was made on 6 accounts three of which were joint accounts). I am fighting the case on behalf of my mother as my father disappeared a few years ago leaving her with the debts. Can the bank issue a formal demand on a joint account to only one party? Do you know what laws govern this? Any help would be greatly apperciated! Thank you Alan
