  1. I have a few threads going, but this is my Nat West one. I had a few issues and worked away a lot in the last 4 years, and my Nat West current account was overdrawn. I guess it went to collections but i never heard anything in the post and just forgot about it (stupid i know). I have checked my CRA and it shows as defaulted back in 2009, for around £1500, although strangely in the last few months the balence has reduced by about £100?? I do want to sort it out now, but i guess there could be charges on the account, I did get a load of charges refunded around 2006/7 so i know the process. First step is to SAR them i guess? I also had a business account which appears to have been closed as well, can i just phone them about all this or should i keep it in writing?

Hi all I just need a bit of advice. 2 years ago I got behind with our car loan repayments, we went through a bad patch husband was nearly killed in a car accident & our son has a very serious heart condition. However upon attending court the the judge suspended the repossession on the basis we paid xxx amount each month until the balance was cleared. Now our problem, our son recently had to go into hospital for a surgical procedure on his heart, this resulted in me taking a considerable amount of time off from work. Because of the lost income we have got behind by 2 months on our arrangement. My question is does the lender have to return to the court again to enforce the possession order, or can they just come and collect the vehicle? As my understanding is they have to return to court to enforce and a court bailiff carries out the repossession, which gives me time to suspend the possession again, is this correct? To be fair we have in two years reduced the balance by more than half from £9000 to under £4000, so our intentions are to clear the balance. All we are asking for is the two missed months just be added onto the end, is that an unreasonable request? And how would that argument prop up in court as last time the judge did not want to repossess as the vehicle is registered disabled.
  3. Hi all, I've been a lurker here for a while now but our own money 'problems' are about to come to a head and I'm hoping I can get some advice. Ok, from the beginning; My husband and I have for the longest time wanted to move across the country to where his mum lives, however we've never been in enough of a stable position to attempt it. Our situation came to a point recently where we decided that it was a case of now or never; either we just go for it or forget all about it. So, we went for it So my husband handed in his notice and moved in with his mum while signing up for JSA contribution based at the end of August, and is desperately trying to fine a permanent job. No luck yet, but he has got an agency job atm that is looking promising. I've just handed in my notice to my work with my last day being 16/11/12 and am hoping to also sign onto JSA contribution based (I cant see this being a problem) Our 'Problem' is that we do have a couple of debts that we will be taking with us, and while on JSA might cause a few money issues. While we believe that our income will cover our outgoings, but if an emergency crops up then we will probably be stuffed. Firstly; Are there any other benefits we'd be able to claim for? (I don't think so but it doesnt hurt to ask ) Secondly; Is there anything I can do about the two Loans and credit card we have? I don't want 'find a way' to 'get out of them', I made the debt and I'm happy to pay them back. I'd like to say it shouldn't be an issue, but I'd rather think about it now than when we're up to our ears in Debt Collector threats. In other threads I've seen ppl get their interest frozen and charges halted, but that's when the debt is already defaulted. Is there anything like this I can request of my bank during the next few tough months, just to help us out a bit?   4. my high street bank have closed my student current account "due to dormancy" and placed a default on my credit file without any correspondence being sent to the correct address. I downloaded and sent a 'change in personal details' form to my local branch informing them of a change in address. However, they did not update my details. I still have the PDF form saved, clearly showing the 'last modified' date as significantly before the letters carried on being sent to my old address. I also still have proof of postage from the post office which has the recipient's address (my branch) and the date of posting on. I found out about a problem with my account via not being able log into my online bank account. Following this, I discovered they still had my old address on file, despite me updating it months earlier. I complained to say that they had been sending any letters to the incorrect address. The letters sent to the wrong address apparantly included numerous (~10) warnings of account closure etc... I did not know there was a problem with the account as I was well within my overdraft limit and didnt receive any of the letters warning me of account closure. If I had received any of these letters I would have responded appropriately and paid some money into the account. However they were sent to the incorrect address. This was the banks written response to my complaint which does not seem to properly address my main complaint that I never received any of the letters because they were sent to the wrong address: " Dear Mr. XXXX Thank you for your patience while I have reviewed your complaint. I apologise for the delay. Following my review, I am sorry I am unable to agree with your complaint about reinstating your bank account and removing the default from your credit file. The default was rightfully applied due to arrears on the account. You opened your account as a Student Account and you signed in 2010 to confirm you had received the terms and conditions of the account. The terms and conditions of your account state "you must use your student account as your main current account by depositing at least £750 every 6 months and making a minimum of 3 debit transactions each month". Because you have not maintained your account in this way it has rightly triggered as dormant, and as we have received no contact or repayment proposals from you, we have followed bank policy in applying a default and transferring your account to recoveries' control. Whilst I appreciate the concern regarding your address, you acknowledged receipt of the first dormancy letter which confirmed the way you needed to manage the account. The account was credited in March 2011 and whilst you continued to debit the account, no further credits were made until August 2012. I understand that this in not a decision you were hoping for, but as the terms and conditions of the account were not followed I am not able to reinstate your bank account nor remove the default from your credit file. While I am unable to agree with your request to reinstate the account, as a gesture of goodwill I will write off the remaining balance of £24.08. This means the bank account will now be closed so if you have not done so you need to seek alternative banking elsewhere. I believe I have resolved your complaint satisfactorily following my review. If you are unhappy with the decision and want to take it further, you can get in touch with the financial ombudsman service.. If you decide to refer your complaint to the ombudsman, you should do so by 15th March 2013 as they may not consider your complaint after that time. Yours Sincerely, Mrs XXXXX XXXXXXXXXX Expert Complaints Handler " The part where she says that I "acknowledged receipt of the first dormancy letter" refers to the last letter which the bank sent to my correct address. This letter did not explicitly warn me my account would be closed. It stated: "We've noticed you haven't paid any money into your account recently. It's important that you use your account regularly, particularly as we've given you an overdraft facility. When we first gave you your overdraft facility we expected you to regularly pay money into the account. .... (the rest of the letter only discussed payment methods, helplines etc.)" I understand that I did not follow the terms and conditions of the account, however, the bank did not send the any written warnings or account closure or defaults to the correct address. What position am I in? Is this worth fighting?? If so, how? Do I say they never sent me the default notice? Any help much appreciated!!
  5. Hi, I have recently SAR'd Gmac/Paratus. I have arrears fees, councellor visits etc,etc. Within 2 days a slab of paper arrived. The one I was interested in detailed my payments on the account and the arrears fees they charged me. The charges amount to £2100. They are hounding me for arrears for £714. About 5 years ago I missed one months mortgage payment. No money. I have offered to increase my monthly mortgage payment by £53 to clear the arrears in 13 months. They still plague me and want to send another councellor home visit. My account balance has increased by around £3000 since I failed to pay that one month. Can I claim back the charges and if so, where would they go? Would it be detrimental to me by claiming from my current provider? Could they force me to sell? What are my options please.   6. Back when I was working full time a few years ago now. pre 2008, I applied for an overdraft of £1000 on my current account. Since then I used the account regularly, but unfortunately was made redundant during the crisis in 2008. I have been unsuccessful in finding fulltime employment since, other than the odd 2-3 months here & there. I have been claiming JSA on/off since that time. my overdraft was below it's limit for a while, until the situation got worse & worse. now living on £260 p/m JSA & electric/gas being nearly £120 p/m doesn't leave me much. I'm single & living in council accommodation. since the interest was added to the overdraft which took me over the limit, natwest have been charging £6 per day. & now they have been charging me nearly £180 p/m in charges because I am unable to pay those charges to bring my overdraft back under 1000. so in essence it is only the interest & concurrent charges that are keeping the account over 1000. so the next month comes & another £180. since april, when my account was struggling to keep below 1000, my balance now stands at £-1524 £524 is pure bank charges. I emailed them back in april/may saying I found these charges absurd & extortionate. I also said point blank, that I will no longer pay anymore charges related to that account because It's unsustainable. They sent me a letter saying to contact them & that they were sorry to hear of the difficulties blah blah blah. i contacted them via telephone, the assistant said as a good will gesture they would refund the £53 charges accrued for that month, to which i replied, But what about the charges that will be taken next month because this months charges had taken me over the limit which resulted in the charges for the following month. they said they couldn't refund those, so I said next month then i'm back to square 1 & the account will be over the limit because of bank charges again. I have not paid any of these charges since my contact with them, as I told them I wouldn't. neither have i used that account for well over a year. for the £1000 overdraft, I would say I have actually paid well over £1000 in bank charges on that account over the last 3 years, so in essence, was it not for those bank charges, the account would not be in that state in the 1st place. but now they are threatening to send the debt to a debt collection agency (power2Contact) who will visit me at my home (i would never let them into my home anyway) & asking for the full amount + interest + fees. where do I stand with this & how should I proceed. I can't even afford a £1 a week at moment, let alone anything else. I do not think they have acted responsibly in this case & i don't see how they can justify those charges at all. But there's no speaking to them because they want their money, & I can't give them their money. & there's no reasoning with them. it's always the poor that get taken for a ride, if you're rich you just get a telling off and given millions by the governement in bailouts or rich tax avoidance schemes & so on.
  7. having just checked my credit report,its showing an rbs current account that i have defaulted on from a few years ago.i no longer bank with rbs. after looking at the details it states the start date was 27/01/1999...i would have been 12 years old on that date and in 1st year at high school which makes me suspicious. tried to get the address where to send an SAR to and chat and telephone agents i spoke to just keep giving me the branch that the account was run froms address,is that correct? so glad i checked my credit report,i know for a fact there are some dodgy charges on the account cause i disputed them about 5years ago i gave up cause i was getting nowhere and being young and naive. im not 100% sure the default date is correct either
  8. hey everyone, i wasnt 100% sure if this was the right forum to post this in but it is a lloyds topic. Problem - I was looking for a "Payday Loan" and i fell short for one of those "we will supply you a loan brokers" but was mis-lead to thinking it was an "Actual Loan" anyway i added my partners deatils to the form and sent it. 2 Days later she received a letter from Lloyds TSB telling her she have been taken overdrawn, so thinking "*$*%&%*$& how did this happen? anyway called the bank and said this is unacceptable what should she do she was advised the following. Advise - 1) Cancel Bank Card(s) 2) Set up an Account Feature wich is supposed to stop extra charges and things taken out 3) DO NOT give out new card details My Main Concern is ofcourse "The Accounts Overdrawn" and still is im on JSA (Income Based) and my partner Receives Child Tax & Child Beneifit, the Lloyds TSB Customer Service Advisor said if my next pay goes in and ofcourse the bank will take it, he said i have to go into the branch and tell them i spoke to him on the phone, and they should give me the amount of credit that was paid in not what remains after the monies were recoverd, but the total monies owed for being overdrawn are £117.06 because im on benefits how do i consolidate this? am terrible at explaining situations so please if i have missed any info you may need like amounts of money ect then please ask or PM also Thanks 2,000,000,000 Times in advance.
