  1. Hello, I got a PCN from CPS Midlands Ltd, I looked and they are not registered with the BPA (British Parking Association) and they also not registered with the IPC (International Parking Committee). I checked through their members today (17th of July 2018). I paid £2 initially for parking and got a machine error and the machine did not accept any more change. And it does not accept cards either. I then paid £5 and got my parking ticket which I displayed on my dashboard. There were two machines at their premises with the same tariff sign next to each. One of their machines were inaccessible as it was fenced off by a building company, hence I used their other machine. I wrote a complaint to them by signed for post, but they wrote back to me requesting my full details including full name, phone, and e-mail. I believe I do not owe them anything and I believe they are trying to scare me into paying. This was an interesting read: www parkingcowboys . co . uk / independent-parking-committee, how they can even allow a non-independent investigation (IPC). I read on other forums, I read that IPC does not seem to be a fair association, rejecting all appeals, hence probably they don't want to be transparent www knowyourparkingrights org / News / faq The following link is also interesting www appealaparkingticket . co . uk / cps-midlands-ltd. But in my case, I am not only totally innocent but I overpaid their parking fees by 40% due to their machine error and this company charged £25 for help so they are not for me. If anyone knows more about "manage parking on private land knowyourparkingrights . org / News / faq If anyone knows what I am entitled to obtain from CPS Midland Ldt legally and what legal phrases to use to finally get them off my back, please help. Thanks. Newmosses seem to have a good success rate. Best K
  2. Hi everyone, I know this car park, operated by Smart Parking, has been the subject of many threads here. I nevertheless thought I'd find out whether my situation is different from others. I got a PCN for failing to pay for the time (15min) I spent on the car park. I had no idea I had to pay to park, as I thought it was a regular retail car park. I received three documents: I one PCN (pay £54 within 14 days or £90 thereafter) one reply to my appeal (which was rejected) and one DRP letter. Here are the details of the PCN: 1 Date of the infringement - 20/04/18 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] - 03/05/18 3 Date received - can't remember 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] It refers to the possiblity of appealing through POPLA on the back of the letter 5 Is there any photographic evidence of the event? - Yes, 2 pictures with my number plate and time stamps 6 Have you appealed? {y/n?] post up your appeal] - Yes Have you had a response? [Y/N?] post it up - YES - I claimed I did not see any sign and they replied: 'several signs are situated around the car park that advise of the terms and conditions and we can confirm that all signage on site are BPA approved' 7 Who is the parking company? Smart Parking 8. Where exactly [carpark name and town] - Heavens Bank Retail Park, Exeter I have not responded since my appeal. Can you help at all? Cheers!
  3. There is a registered all monies charge against my house. It relates to a business banking loans/overdraughts etc that were subsequently repaid. The LTD company was wound up in 2010. Shortly thereafter commercial recoveries contacted me regards how I proposed to repay outstanding monies. I replied that as far as I was aware it was all taken care of. That was the end of that for a couple of years, I was contacted again as above and gave the same response with similar effect. I was contacted a couple of years ago in the same manner but this time it started to escalate i.e. threatening to commence legal proceedings etc etc. I reiterated that as far as I was concerned nothing was outstanding and requested all info regards default. Turns out fellow director owed money to the same bank and they realised there was a dormant charge so apparently provided a loan to the company and repaid themselves whilst shifting liability to the charge ie me. It's all a bit sketchy as they weren't giving much away, but did say that there is no paperwork for the loan. I basically told them where to go and that if they wanted to do anything it would need to be through the courts. Nothing is going on atm regards this, but was just wondering that given the changes around SDR (read free) if it is worth getting a on in before they claim that they had all the info but binned it. Charge is still there at LR and not sure on exact amount but was a lot and with compounded interest will easily wipe out any equity I have due to repaying mortgage. We feel like we are renting.... Any advice?
  4. Ive been in a dispute with npower for a few years now ever since they stopped us paying by standing order saying it was no longer available wilko and chapman (npower soliciters) have taken me to court which ive never known about and it looks like they have put a charge on my property because attached to their letter is the deeds to my house. I owe them £4000 and the only reason its that high is because they wanted me to pay £250 a month which i simply cant afford they tried the " we are going to fit a meter through the courts" which was declined due to 3 members of family having asthma. I really have no knowledge of this going to court am worried sick can anyone help me.
  5. Hi all I have received a PCN through the post, This is the first time I was aware, Does CPM have to put a ticket on the windscreen rather than send the PCN with pictures through the post This is not an ANPR it was one of their goons checking Thanks in advanced
  6. Hi Every one, Please help/Advise. I was photographed entering the haven banks car park on the 22/dec/2017 at 11.42am. Paid £1.00 for 2hrs /120mins parking at 11.46. Was then photographed leaving at 14.03pm on the same day. Unfortunately I entered the last two digit's of my registration wrong ****LKX when it should of been ****LXK. So received a parking charge letter on the 01/01/2018 stating that I needed to pay £54.00within 14 days ,if I was to appeal and fail this would go up to £90.00. I of course contacted Smart Parking and forwarded on the parking ticket which I paid for hoping they would see scene and cancel the charge.(Ya Right!). There letter arrived on the 27/01/2018 ,stating that as the motorist and that there are signs clearly stating not to make mistakes it was my fault. Also I was over my paid 120mins by 20mins.(I understand that this is the 5mins entering the car park parking and paying for ticket and the 15mins leaving). I again appealed To POPLA, stating that I was in my car within my paid time ,but due to the excessive amount of vehicle's entering/leaving this car park over the xmas period ,I was unable leave hence the 10 to 15min wait ,but didn't realise I was over my time when I eventually drove out. But on the 5/3/2017 while POPLA agreed the wrong reg details should cause the fine my overstay still did. So the charge is £90.00 Sorry that there's so much to read , I have all letters and the £1.00 parking ticket so can forward them on . haven't paid the charge yet ,hoping there's some one that will advise me. Cheers
  7. Dear all, I had some NHS dental treatment whilst believing I was in receipt of JSA. However the DWP had stopped my claim without informing me. Consequently I have been hit with paying £43 for the treatment and a £100 penalty charge. I am no longer on any benefits and have no income whatsoever. My question is: What if I just don't pay the £143? Are they likely to take me to court for that amount? What would be the likely outcome of my refusal? Thanks in advance.
  8. Hi there, My pregnant wife and I parked in the Haven Banks car park in Exeter on a Sunday afternoon and paid the parking charge for 2 hours. We have subsequently received a Parking Charge Notice showing images that say we left the car park 2 hours and 15 minutes after entering and so we are required to pay up to £90 (£54 with early pay discount). I am new to all this but see from the forum that this is not the first time their charges have been brought into question. My wife is over 6 months pregnant and so is obviously slower at moving than normal and also takes time to get organised and comfortable in the car and so a fine of up to £90 for 15 minutes in a fairly quiet car park is excessive. Furthermore, the signs are not very clear so we almost missed them when we first arrived. I have not yet responded in any way to the letter as I have just received it in the post, but would be grateful for suggestions as to how best to approach this situation. Many thanks in advance.
  9. I can see a few things against UKCPS however I thought I'd start my own thread. Someone driving my car today receiving a "Parking Charge Notice" on the car for leaving the site, of £100 or £60 within 14 days. I've attached photos of the PCN and of the sign at Bristol Abbeywood Retail Park. I'm the keeper of the vehicle however I wasn't driving the car (I was at home!) so is there anything they can actually do?
  10. Hi all I am trying to help my Aunt who has received one of these parking charges through the post. 1 Date of the infringement 18/06/2018 2 Date on the NTK [this must have been received within 14 days from the 'offence' date] 20/06/2018 3 Date received 22/06/2018 4 Does the NTK mention schedule 4 of The Protections of Freedoms Act 2012? [y/n?] Not that I can see 5 Is there any photographic evidence of the event? Yes. Driver and occupants not visible though. 6 Have you appealed? {y/n?] post up your appeal] Sent emails to LIDL Have you had a response? [Y/N?] Yes. LIDL are unwilling to cancel the charge and are now ignoring emails 7 Who is the parking company? Athena Parking 8. Where exactly [carpark name and town] LIDL Manchester - Ashworth Street, Denton M34 3LJ Appeals Body says the IPC. I have been reading a few threads on here and a few other places, and I was under the impression that emailing LIDL direct usually killed these things off ? I had had a few replys but they are unwilling to cancel it, and are now ignoring emails on the date in question my Aunt was an occupant in a vehicle that is registered in her name . She is partially disabled and walks with the aid of a stick. There was also a Blue badge on display if that matters. The charge is because the vehicle overstayed by 30 minutes. The occupants of the vehicle did shop in LIDL on the said day (No till receipt though unfortunately). I am thinking next course of action to write direct to LIDL head office ? Just want anyone's thoughts before I do. Thanks for any help Lee Here is a copy of the parking charge notice which I meant to post. http://i65.tinypic.com/rvjzi1.jpg http://i68.tinypic.com/f9nsib.jpg Pics are not displaying for some reason. I used tinypic for reference.
  11. new to this site so hopefully someone can help? On the 9/5/18 20:53 I was at Wembley near the stadium where I parked up to watch a match. and return to my car and found a parking charge (PCN) on the screen.. I ignored it.... On the 15th June I received a FORMAL DEMAND letter telling me I have to pay £100. I rang them up and told them that this was a joke and I'm not paying for it as its not a council ticket.... I also made out that returning to the car there was NO ticket as someone may off removed it but on the site theres pics to show it was on the car.... The reason for the ticket was because I was parked on private land and did not display a permit ..... I've only spoken to them on the phone and yet to send them a letter...... what shall I do ... thanks Nike99

  14. My on-going battle with Dart Charge continues as once again I made the crossing on a Sunday when I got back the local Paypoint shop was closed. I tried 3 others in town and the surrounding area only to be told they had got rid of the PayPoint machines or they weren't working. Subsequently I forgot all about it until the Tuesday when I called Dart charge and told them I'd forgot and they said 'tough, you'll get fined now even if you pay'. I appealed on line after calling them today to ask if I could pay and avoid the fine (I knew it was hopeless but others tell me this has worked for them), only to be told there's no other way to do it, which is wrong as you can appeal by post. I can't understand how it is legal for a private company (Le Crossing) to issue fines, I thought only court, plod and LA's could do that? For what it's worth my appeal is below, I know it will get laughed at by Dart Charge but I'm making them work for their highway robbery: Once again I had to use the crossing on a Sunday and on returning I found that all the local pay points were either not working or closed, I tried 4 shops. Your call centre was down on the Sunday so I couldn't make payment until the next day. I work for the NHS so I am extremely busy and I am not allowed to leave the medical area while I'm at work and our phones can't dial your number. When I remembered I hadn't paid, I called your call centre on Tuesday to make a payment and was advised that I would still be fined. I believe there should be a longer period to make a payment and there should be easier ways to pay, as I do not have access to a computer (I'm in the library now) and if paypoints are not working and your call centre is down, how can I pay the charge? Also why does each crossing incur a separate fine? A journey consists of outbound and inbound, that's one journey so it should be one fine per day. I also question the legality of a private company imposing fines on the general public, I'm sure that only Local Authorities, Police and Courts can issue fines, what right does Le Crossing Company Limited (Limited means it is a private company) have to issue fines?
  15. Coporate services have sent a parking charge notice to a friend of mine, after 5mins of parking there. they state that the reason for the charge is because they didnt use the premises. im wondering do they need to prove that they didnt need to use the premises of KFC, in order for them to charge this invoice? if so will a simple email stating that they did indeed use the kfc on the day in question and its down to them to prove that they didnt in order for them to pay.
  16. My wife has received a Parking Charge Notice for a hotel car park, she was meeting a friend in the car park, her friend went into the hotel to use the toilet but that was it. The notice states 38 minutes onsite and has photos of the car. She cant remember seeing any signs on entry but I will check later as its quite local. She never actually left her car, the keys stayed in the ignition and the door remained open, so technically was the car actually "parked" The fee is £100 reduced to £60 if paid by tomorrow. Can anything be done about this?
  17. 0n 29/11/17 I received a parking charge in Aldi, Heswall wirral. The date of the the first notice through the post was 14/12/2017. I appealed (on line) on the grounds I was not the driver of the vehicle. It was rejected. I was given 14 more days to pay. I appealed again (on line) using a template letter from this site, asking for a breakdown of charges etc etc. I received none of my requested info, simply a rejection of my appeal. They continue to pursue me and the charges have now increased from £40 to £70. What should I do next? They provided photographic evidence and mention shcedule 4 of the protection of freedoms act. The appeals body mentioned on the documentation is IAS (POPLA) All responses greatly appreciated.
  18. Good afternoon all, I'm sure you're all busy so I will keep this as short as possible. Was a VM customer for 8 odd years. Had to cancel their services last year as my Ex and I separated and I was moving to a new place. Account was in my name, so I phoned to cancel it. Phone call lasted about 10 minutes as they tried to get me to shift it to the new address etc. They explicitely said "there is no further charges to pay" on the phone. (I have it recorded as an .m4a file.) In fact, we were due a refund. A week or two later, I get a letter (at my new address!) asking me to pay a £23 cancellation charge. I wrote them a letter explaining both the phone call, and my annoyance at them chasing the additional charge when we'd been good customers for 8 years. I got another chaser a few days later, and expected the letter hadn't been processed yet, and then nothing.... After not getting any correspondance, I assumed it was done. It was £23, and I thought it would all be sorted. Last week, i'm at the bank applying for a loan, and I am denied and told to check out Experian. Three strikes from Virgin Media over the late payment of £23. The rest of the credit report is absolutely sweet. Credit score tarnished by their mistake and incompetence. Any advice on how best to rectify this, and if I should pursue any further action? All the best, D

  20. Hi, I am writing this on behalf of a disabled friend, who has received a Parking Charge Notice through the post from Civil Enforcement, mid last week, around the 26th of Feb. Some info: Date of infringement: 15th Feb 2018 Issue Date 22nd Feb 2018 Date Received 26th or 27th Feb 2018 No photo evidence mentioned, but possibly auto cameras. Cannot see any Section 4 mention on the letter. Just says Maximum Parking Allowance Exceeded. Not appealed yet, we will, and I will detail in a moment what we are thinking to say. Parking Company is Civil Enforcement Spinning Gate, Leigh. Says they have appeal procedure, and if unsuccessful, then Popla. So most importantly, the car park in question is shared by Cineworld, Tesco, and several other food chains such as Frankie and Benny's. The entire car park has a 3 hour parking time limit. We were parked at the side of the cinema, and during the 6 hours we stayed, we went into Tesco, and into their restaurant, and stayed well in excess of an hour as the disabled person was not feeling well (Primarily pain). Once she recovered sufficiently well, we then shopped in Tesco for around 45 minutes to shop. After that we attended a screening of the new Black Panther film. We went into the cinema early so that the disabled person could sit a while. This was around 45 minutes, including purchasing tickets, and getting sweets. We then watched the film, which has a running time of 2 hours and 14 minutes, but including trailers and advertising was closer to 3 hours, for the film alone. As such the film alone would have taken much more than the three hours allowed, inclusive of obtaining tickets, food and seeing the entire film, so on the basis of this, we would have incurred a parking charge, simply for attending the film at the cinema and parking in their car park! Given my friend is disabled, I thought to provide proof of her disability, with a copy of her blue badge, numbers redacted. The letter they have sent already has her name and address in full so they know who drove, and she is the sole driver. I also intended to provide a photocopy of the cinema ticket to prove our attendance. This and a covering appeal letter stating exactly what I have written here. Should we appeal? I figured CE will just decline it anyway, and likely Popla too. What happened if it is declined, and we don't pay? Surely if they took her to court they would lose, simply based on the fact we were parked to see a film in their car park, and in order to see that film we would have to be there longer than 3 hours, or miss the end of the film Given the person being claimed against is disabled, obviously she is slow to move around, and needs a lot of help and support. She is naturally very upset about all this absurdity. Any advice on how to proceed would be most welcome. Thank you.
  21. Hi, Hope everyone had a good bank holiday. I (and three others!) missed crap signage and got a Contractual Breach Charge from Ethical Parking on my windscreen over the weekend. Just double checking that it is currently still best to do nothing until a notice to keeper arrives (between 28 and 56 days) before I take any action on one of these? Then if it (NTK) arrives on time post photos of it and signage on here for assistance? Just don't want to get it wrong! Thanks!
  22. Hey, I've pretty much shot myself in the foot too. I appealed and was rejected, ignored the requests for payment and now have a MoneyOnline County Court claim against me for £160. I'm confused, I used the argument that there was no free parking at Liverpool Airport, but I read stories that say there is .. did there used to be but they removed it?? On my first visit, dropping off my son, I assumed that a simple 60 second drop off/pick up would be free like Manchester, I entered the airport road it led to a roundabout, after following the signs for Drop Off/Pick Up I entered the car park, at this point I was on a one way road were I couldn't do anything but enter the car park. I dropped my son off, I was no more than a couple of minutes, I went to leave and couldn't get out of the car park without paying. A couple of weeks later when I went to pick him up I thought I might have gone into the wrong car park, I followed the same road and realised that I would be entering the same car park and I'd have to pay, I spotted a barrier and pressed the buzzer to get off the road and go back out, I then saw him, pulled over for about 60 seconds to let him in and was nailed. I appealed, it failed, I ignored and now I have a claim for £185.00 Any ideas?
  23. This 3rd party mobile provider contacted me (Unsolicited) around Feb 2017 telling me that my small business contract with o2 was coming to an end. As an O2 "Partner" they had all my information and could provide me with a great deal. I stupidly signed a 3year contract with a "Deal Incentive" whereby they would pay a sum to me to reduce my line rental to £25 a month, I got 1 payment in April then nothing until in Jan 2018 I sent them a letter of contract cancellation due to "Material Breach of Contract". My bill rose from £35 to £92 for 3gb of data and no phone !! Despite several letters and calls to o2 to cancel this contract I am still waiting. Beware of this company please, I will keep you updated !!
  24. Hi i have recieved a PCN from athena anpr for going over the 90 min parking limit in lidl. I was 14 mins over. I have read previous threads and i am 50/50 on whether to ignore or pay. Please help
  25. Hello, I have received a number of letters from DRP (the debt recovery company that NE Parking Ltd use). My car was parked outside a hotel that has been closed down for over a year from 8-11pm at night. put a ticket on the windscreen so far down that I didn't notice it was even there until 3 days later when I turned my wipers on to wash my windscreen. The picture they included on the original letter shows my car but doesn't have the ticket on the screen in the window. I have ignored about 6/7 letters from them and now have received a 'final settlement offer to avoid court action'. Has anyone else got this far with them? Do they actually issue in Court? Thanks in advance.
